SUBJECT: Proposed Amendments to the Municipal Code for Parks
Staff requests Council to review and approve the ordinance making amendments to Chapters
22.04, 22.08 and Appendix A of the Municipal Code, which will implement changes in the
Parks Ordinances for parks and Open space areas, including revisions to streamline and update
the Code.
RECOMMENDATIONS
Staff recommends that the Council approve and adopt the ordinance amending the Municipal
Code contained in Attachment A.
EO_LI C Y IMPLICATIONS
Several policy issues are related to the proposed amendments contained in Appendix A. The
changes include the types of use and access and changes in hours of operation. The requested
changes would also revise the process for adopting park regulations, which affords
administrative flexibility on such things as the permit process and hours of use for park and
open space facilities.
EXECUTIVE SUMMARY
Some sections of the Park Ordinances in the City’s Municipal Code have not been revised for
twenty-six years. Many changes in park usage have occurred since that time. After thorough
review by City staff, it was determined that both the City’s parks and the City’s open space
lands need a combined set of ordinances that update the Municipal Code consistent with current
use and that specifically:
Simplifies the parks permit process;
Maintains, with the City Clerk, all park regulations for parklands and facilities; and
Modifies access, use, and changes the hours of operation of several City parks.

These changes are summarized below, with reference to the section of the Municipal Code
proposed for amendment.
Streamlining of the Park and Open Space Facilities Permit Process
The present Park Ordinances duplicate the permit process for use of parks and park facilities.
The changes proposed will reduce the amount of language in the ordinances by combining parks
and park facilities, where appropriate, and addressing various uses through park and open spac.e
regulations. (22.04.040; 22.04.050; 22.04.060; 22.04.070; 22.04.080; 22.04.090; 22.04.100;
22.04.110; 22.04.120; 22.04.130; 22.04.140)
Park Regulations
At present, park and open space rules are provided for in the Municipal Code and informally
implemented within different City Department operating procedures. The proposed changes
would amend the process for adopting, formal regulations for the City’s parks and open space
lands as outlined in 22.04.030 of the Municipal Code. This process would allow staff to
propose new regulations or changes in regulations that will become effective, only after the City
Manager has given approval, and they have been filed for a fifteen-day period with the City
Clerk and the Council. These regulations will be an adjunct to the Municipal Code and will in
no way supersede the Code. Park and open space regulations will simply allow staff the
operational flexibility to change some park rules, such as opening and closing hours, contents
of applications and permits, and other procedures that should not ordinarily require Council
action. (22.04.030)
Access, Use and Hours of Operation
Park Access:
Motorcycles would be allowed access to the paved roads of Foothills Park where other motor
vehicles currently travel (22.04.150). This change will give access to a popular alternate form
of transportation.
Except for established trails, horses and bicycles would be prohibited from Byxbee Park
(22.04.220). This change will address wildlife habitat issues.
Except for City staff or their agents, the use of electric power generators in parks and open
space lands would be prohibited (22.04.340). This addresses safety and noise issues.
Smoking on trails in Foothills Park would be prohibited (22.04.150). This addresses a health
and safety issue.
Charcoal fires in Foothills and other parks would be limited to City-provided braziers
(22.04.150 and 22.04.300). This addresses health and safety issues.

Two additional picnic areas in Foothills Park would become group picnic areas, available by
reservation (22.04.150). The public has requested this change and is an increase in customer
service.
Commercial activities, such as food vendors associated with events in park and open space.
lands, would be permitted only in conjunction with City programs or City-sponsored activities
(22.04.160). Clarifies the code regarding commercial use of parks and open space.
Except for City staff or their agents, entry to the nesting area of the Duck Pond would be
prohibited (22.04.390). Addresses wildlife habitat issues.
Except where designated, the play or practice of golf, horseshoes, lawn darts, and baseball
would be prohibited (22.04.190). This change addresses safety issues.
Sections 22.04.060- Contents of Park Application, 22.04.080 - Exclusive use of buildings,
22.04.090 - Building permit application, 22.04.100 - Contents of building application, and
22.04.110 - Action on building application, are to be removed from the Municipal Code and will
be addressed in park and open space regulations. The majority of these address the wording of
parks permits and applications.
Hours of Operation:
The hours of operation for the Arastradero Presei’ve and Esther Clark Park would change from
8 a.m. - 10:30 p.m. to 8 a.m. - sunset (22.04.310). This change addresses wildlife habitat and
public safety issues and makes these areas consistent with Foothills Park.
The hours of operation for the City-owned Baylands and Byxbee Park would change from
sunrise - 10:30 p.m. to 8:00 p.m. - sunset (22.04.315). This change addresses wildlife habitat
and public safety issues and makes these areas consistent with Foothills Park and other parks
referenced above.
The specific use hours specified for sections 22.04.321 - John Lucas Park - Use of or trespass
at skateboard facility prohibited when closed, and 22.04.322 - Rinconada Park - Use of or
trespass at pool facility prohibited when closed, will be removed from the Municipal Code and
will be addressed in park regulations. This allows seasonal flexibility in setting facility hours.
Chapter 22.08 and Appendix A
All of the changes made to chapter 22.08 and Appendix A update park name changes and
modernize language.
FISCAL IMPACT
No measurable fiscal impact would result from the proposed Code amendments.

AMENDING CHAPTERS 22.04 AND 22.08 OF TITLE 22 OF
THE PALO ALTO MUNICIPAL CODE REGULATING PARKS
The Council of the City of Palo Alto does ORDAIN as
follows:
SECTION I. The Council finds as follows:
(a) Chapter 22.04 of the Palo Alto Municipal Code relating
to Parks and RecreatiOn Building Use and Regulations requires
revision to reflect modifications to access, use, and hours of
operation in several of the city’s parks and open space reserves
necessary or desirable for safe and efficient public use; and,
(b) Certain regulatory controls over parks and open space
reserve usage are better addressed by deletion of legislative
provisions and substitution of administrative regulations affording
greater detail and flexibility of control, and to facilitate that
process while assuring public access to adopted regulations the
City Clerk as well as the Director of Community Services should be
designated to maintain the records of all parks regulations; and,
(c) The names of certain of those parks dedicated for
public park use in Chapter 22.08 of the Palo Alto Municipal Code
should be amended to reflect current usage as follows: Cameron
Park (formerly Berkeley Park); Edith Eugenie Johnson Park (formerly
Downtown Park North); William C. Werry Park (formerly Eton Park);
Frederick W. Weisshaar Park (formerly Hampton Park); Mayfield Park
(formerly Hollywood Park); Don Segundino Robles Park (formerly
Mayfield Park); Juana Briones Park (formerly Arastradero Road
Park); and John Boulware Park (formerly South Palo Alto
Neighborhood Park).

(a) Except as provided in subsection (b) of this section,
it shall be unlawful for any person to consume any alcoholic

(b) Notwithstanding subsection (a) of this section,
alcoholic beverages may be consumed in Rinconada Park only in
accordance with, and subject to the conditions set forth in, a

it shall be unlawful for any person to consume any alcoholic

(b) Notwithstanding subsection (a) of this section,
alcoholic beverages may be consumed in Mitchell Park only in
accordance with, and subject to the conditions set forth in, a

22.04.370 Reckless driving prohibited.
No person shall drive any vehicle, bicycle or moped upon
park or open space lands owned e~or controlled by the city in
willful or wanton disregard for the safety of persons or property.
Such conduct shall constitute reckless driving.
22.04.380 Unlawful riding and towing.
No person shall:
(a) While driving a motor vehicle, knowingly permit any
person to ride on such vehicle or upon any portion thereof not
designed or intended for the use of passengers; or.
(b) At any time, ride on any moving vehicle or upon any
portion thereof, not designed or intended for the use of passen-
gers.

SECTION 3. Chapter 22.08 of Title 22 of the Palo Alto
Municipal Code is hereby amended to read as follows:
CHAPTER 22.08
PARK DEDICATIONS
22.08.001 Purpose.
The purpose of this chapter is to implement Article VIII of
the charter providing for the preservation of city lands which are
used or intended to be used for park, playground, recreation or
conservation purposes, and providing the electorate an opportunity
to pass upon proposals to discontinue or change such actual or
intended uses or to improve such lands. This chapter shall be
liberally construed to effectuate its purposes.
22.08.002 Definition.
The word "park" as used in this chapter and in the general
laws hereinafter referred to, in every case means and includes
park, playground, recreation and conservation lands and uses.
22.08.003 Lease, abandonment, disposition of parks--State
law to govern.
Lands owned or controlled by the city which are used or
intended to be used for park purposes shall be sold, leased or
otherwise disposed of, or their use abandoned or discontinued only
in accordance with the provisions of this chapter. Except as
otherwise provided in the charter, the general laws of the state of
California as they existed January i, 1965, authorizing municipal
corporations to abandon or discontinue the use of lands dedicated
or placed in use for park purposes, authorizing the sale or other .
disposition of such lands, and providing procedures therefor and
for matters relating thereto (designated as Government Code
Article 2, Chapter 9, Part 2, Division 3, Title 4, commencing at
Section 38440) shall be applicable to the city of Palo Alto and to
all lands owned, used or held by it for park purposes, and said
laws shall govern and control exclusively in respect thereto.
22.08.004 Ordinance required.
The council shall by ordinance prepare a list setting forth
in separately numbered .sections the common name or other
designation and the legal description of each site, parcel or area
of land owned or controlled by the city which is Used or intended
to be used for park purposes. Each section shall be accompanied by
a map or plat of the land described, and said ordinance shall
contain a statement that the lands listed thereon are reserved for
park, playground, recreation or conservation purposes pursuant to
this chapter. As additional lands are acquired or held by the
city for park purposes, they shall likewise, by ordinance and
without delay, be added to said list and subject to the provisions

of this chapter. Any such ordinance may be proposed pursuant to
the initiative provisions of Article VI, Section 2, of the charter.
22.08.005 Ordinance required for substantial building,
construction, etc.
Before any substantial building, construction,
reconstruction or development is commenced or approved, upon or
with respect to any land held by the city for park purposes, either
by the city or by a lessee, licensee or permittee thereof, the
council shall first cause to be prepared and by ordinance approve
and adopt a plan therefor. All leases, licenses and permits with
respect to land held for park purposes shall contain provisions
requiring compliance with this section. The plan shall be
prepared in such a manner and with sufficient detail and
particularity to show, as applicable, the nature, function, size,
extent and general appearance of the proposed project. Any change
in the plan shall be prepared in the same manner and adopted by
ordinance.
22.08.006 Ordinance subject to referendum.
Whenever in this chapter action is required to be taken by
ordinance, such action shall be subject to the referendum
provisions of Article VI, Section 3, of the charter, irrespective
of whether such action would be characterized as legislative,
administrative or otherwise. One or more sections of any ordinance
adopted pursuant to Section 22.08.004 of this chapter may be made
subject to a referendum without including the whole of such
ordinance.
22.08.007 Provisions for land use.
All of the lands listed in this chapter shall be held~for
use for park purposes subject to the provisions of Article VIII of
the charter.
22.08.010 John Lucas Greer Park.
That certain parcel of land formerly known as Amarillo
Park as delineated and described in Exhibit A-I attached hereto is
named John Lucas Greer Park and is hereby reserved for park,
playground, recreation or conservation purposes along with those
certain additional parcels of land delineated and described in
Exhibit A-I.I attached hereto.
22.08.020 Byxbee Park and the city-owned baylands.
That certain parcel of land known as Byxbee Park and
city-owned baylands as delineated and described in Exhibit A-2
attached hereto is hereby reserved for park, playground, recreation
or conservation purposes. That portion of Byxbee Park and the
city-owned baylands commonly known and referred to as the "Baylands
