HomeMy WebLinkAbout1996-06-17 City Council (40)B;rDGET 1996-98 City of Palo Alto C ty Manager’s Report TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: POLICE AGENDA DATE: June 17, 1996 CMR: 312:96 SUBJECT:Resolution Authorizing Amendment to Automated Fingerprint System Agreement for CAL-ID REQUEST This report requests that Council approve the Police Department’s continued participation in the CAL-ID automated fingerprint system. Funding has been included in the proposed 1996-97 Police Department budget. RECOMMENDATIONS Staffrecommends that Council adopt the attached resolution authorizing the Mayor to amend the agreement providing for Palo Alto Police Department’s continued participation in the CAL- ID automated fmgerprint system for 1996-97. POLICY IMPLICATIONS No change in policy or associated implications are associated will result from this action. EXECUTIVE SUMMARY On January 1, 1986, Senate Bill 190 provided for implementation of a Statewide automated fingerprint system that could be accessed by local law enforcement agencies. This bill appropriated $7,000,000 to the Department of Justice for the purchase of equipment and services to create this Statewide system. The bill aiso provided procedures for local government to receive equipment based upon a sharing of costs with the State. The State paid 70 percent of the cost of the purchase of the equipment. All other costs for implementing local systems are the responsibility of local government. To be eligible to participate in this Statewide program and to receive the 70 percent matching grant from the State, each county was required to form a local policy board. The Santa Clara County CAL-ID Local Policy Board was ’formed in 1988 and oversees the operation of the system. Each year, in order to continue participating in the program, pal~icipating agencies are required to amend the agreement for providing automated fingerprint system services. RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AUTHORIZING THE MAYOR TO EXECUTE THE SEVENTH AMENDMENT TO AGREEMENT TO PROVIDE LOCAL LAW ENFORCEMENT ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM WHEREAS, the County and the Incorporated Cities entered into an agreement dated April 26, 1988, entitled "AGREEMENT TO PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM" (hereinafter "Original Agreement"), in order to fund, implement and operate a local automated fingerprint identification system (hereinafter "Local ID System"), which will provide local law enforcement agencies with direct access to the California Identification System (hereinafter "CAL-ID System") through the use of local remote access network equipment (hereinaf- ter "Local RAN Equipment"); and WHEREAS, the County and the Incorporated Cities desire to continue the Original Agreement and ’to modify its terms with respect to the financial contributions which the County and the Incorporated Cities will each make to the City ofoSan Jose in order to implement and operate the Local ID System and to extend the term of the Agreement for another year. NOW, THEREFORE, the Council of the City of Palo Alto does hereby RESOLVE as follows: SECTION i. The Mayor is authorized to execute an amendment to said Original Agreement to continue for another year implementa- tion and operation of the Local ID System entitled "Seventh Amendment to Agreement to Provide Local Law Enforcement Agency Access to the California Identification System." SECTION 2. The City Manager is authorized to send to ~the City of San Jose’s Finance Department the City of Palo Alto’s check in the amount of Thirty-Five Thousand Four Hundred Sixty-Eight Dollars ($35,468.00) for the Local ID System, which is the City of Palo Alto’s financial contribution to the operating budget for fiscal year 1996-97 for the Local ID System. SECTION 3. The Council finds that this is not a project under the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary. RECITALS WHEREAS, on April 26, 1988, the County and the Incorporated Cities entered into an agreement entitled "Agreement to Provide Local Law Enforcement Agency Access to the California Identification System" ("AGREEMENT"); and WHEREAS, since the date of the AGREEMENT, the County and the Incorporated Cities have entered into seven amendments to the AGREEMENT to modify various terms and extend the term of the amended AGREEMENT through June 30, 1996; and .. Section 3 of the AGREEMENT, e~titled "TERM" is amended in full to read as follows: "The term of this AGREEMENT shall commence upon the date of execution of this AGREEMENT by all parties and shall terminate on June 30, 1997, unless terminated earlier as provided herein. It is anticipated that the parties will renew this AGREEMENT beyond June 30, 1997, by an express written amendment." SECTION 2. As required under Section 6.c.3. of the AGREEMENT, a list setting out the operating budget for fiscal year 1996-97 and reflecting the financial contributions each party to the AGREEMENT for fiscal year 1996-97 operating costs of the Local ID System is attached and incorporated into this Eighth Amendment as Exhibit A. SECTION 3. This Eighth Amendment may be executed in one or more counterparts each of which shall be an original, but all of which together shall constitute one and the same document. SECTION 4.
