Manager’s City of Palo Alto Summary Report 9 TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: Public Works AGENDA DATE:June 10, 1996 CMR:298:96 SUBJECT:Public Hearing - Assessments for University Avenue Area and California Avenue Area Parking Bonds - Plan G: FY 1996 - 97 REQUEST This is a request that Council approve the annual assessments for the University Avenue area and California Avenue area parking bonds. RECOMMENDATIONS Staff recommends that Council adopt the attached resolutions confirming the Engineer’s Report and Assessment Roll for: California Avenue District, Project No. 71-63, California Avenue District, Project No. 86-01, California Avenue District, Project No. 92-13, University Avenue District, Project No. 75-63, University Avenue District, Lot J Refunding and 250 University Avenue Acquisition POLICY IMPLICATIONS Approval of this action does not represent any change to existing policies. EXECUTIVE SUMMARY Council action is necessary to levy assessments for the five active parking projects on an annual basis. A public hearing is-required in which property owners can question the assessments. The five projects include three surface lots and the Ted Thompson parking garage in the California Avenue area as well as two surface lots, and the Cowper-Webster parking garage and a portion of the 250 University Avenue parking garage in the University Avenue area. The total amount levied for the California Avenue area is $307,010, and for the University Avenue area it is $709,437. This year’s assessments do not reflect any change in bonded indebtedness in either of the districts. For most properties, rates have remained essentially unchanged from last year. ROBERTS Director of Public Works CITY MANAGER APPROVAL: JUNE FLEMING City Manager CMR:298:96 Page 2 of 6 SUBJECT: of Palo Alto Manager’s Report Public Hearing - Assessments for University Avenue Area and California Avenue Area Parking Bonds - Plan G: FY 1995 - 96 RECOMMENDATIONS Staff recommends that Council adopt the attached resolutions confirming the Engineer’s Report and Assessment Roll for: California Avenue District, Project No. 71-63, California Avenue District, Project No. 86-01, California Avenue District, Project No. 92-13, University Avenue District, Project No. 75-63, University Avenue District, Lot J Refunding and 250 University Avenue Acquisition BACKGROUND Parking bonds issued under Bond Plan "G" (Section 13.16.150, Palo Alto Municipal Code) require that a public hearing be held annually (the second Monday in June) on the assessments which must be levied to pay principal and interest on the bonds. The purpose of the public hearing is to allow each property owner the opportunity to question the computation of his/her assessment and the elements which comprise it, that is, the square footage of each occupied building, the off-street parking requirements for the usage, and the off-street parking provided. Assessments are levied on the basis of building square footage, with a credit given for the off-street parking provided by the property owner. An addendum is attached which lists changes made to the assessment rolls (Exhibit C). The estimated assessments were sent to property owners within the districts on May 15, 1996. The addendum modifies assessments due to recent changes in business site conditions (square footage, vacancy, etc.) brought to staff’s attention by property owners since the estimated assessments were prepared. Because the hearing itself is the legally prescribed process by which questions about the basis of assessment and the property owners’ individual circumstances may be heard, it may be necessary to have a second addendum available at the Council meeting which reflects changes brought to staff’s attention over the last four days. The public hearing for one or both of the assessment districts may need to be continued, if last minute information brought forward by property owners cannot be verified and included in the amended rolls prior to the hearing. CMR:298:96 Page 3 of 6 POLICY IMPLICATIONS Approval of this action does not represent any change to existing policies. DISCUSSION. By virtue of the prior establishment of the districts and issuance of debt, Council action is required to levy assessments for the five active parking projects. These assessments will be utilized for the payment of principal and interest on bonds for capital improvements which were issued pursuant to the attached resolutions. These funds are separate and distinct from permit fees which are used for operation and maintenance of parking facilities. The five active projects are listed and described as follows: California Avenue District. Project 71-63: Surface Parking Lots at the corners of Cambridge Avenue and Birch Street, and Sherman Avenue and Birch Street, and a Feasibility Study for a parking structure on one of the lots. California Avenue District, (former) Keystone Lot Parking, Project 86-01: Surface Parking Lot on Cambridge Avenue, construction of interim improvements, and a Feasibility Study for a parking structure on the lot. California Avenue District, Ted Thompson Parking Structure, Project 92-13: Construction of a two-level parking structure on Cambridge Avenue between Birch Street and Nogal Lane. University Avenue District, Project 75-63: Surface Parking Lots on Bryant Street and at the comer of Kipling Street and Lytton Avenue, and a Feasibility Study for a downtown parking structure. °University Avenue District, Lot J Refunding and 250 University Avenue Acquisition: Refinancing of bonds for an existing seven level parking garage (Cowper-Webster) and acquisition of one level of public parking (250 University Avenue). Approximately $341,000 in excess construction funds remain in the California Avenue District bond fund for the Ted Thompson parking garage, Project 92-13. These funds will be used to reduce the tax roll required to pay off the bonds sold to finance the project. To equalize assessments, the funds will be spread uniformly over the duration of the bonds (20 years) beginning with this year’s assessments. On December 17, 1984, Council increased parking permit fees in the California Avenue Parking District to pay for all maintenance costs, including sweeping, landscaping, signing CMR:298:96 Page 5 of 6 and lighting. Staff has been accumulating and monitoring information abOut the actual cost of maintenance for the parking lots. Based on the past few fiscal years’ experience, no maintenance assessment will be levied for FY 1996-97. If maintenance costs exceed permit revenues in any future year, the shortfall will be recovered by levying an assessment as provided for in the California Avenue Off-Street Parking Maintenance District. FISCAL IMPACT The projects are funded by the Assessment Districts and no City funds are involved.
