HomeMy WebLinkAbout1996-02-12 City Council (11)~.City of Palo Alto anager’s Report TO:HONORABLE CITY COUNCIL 6 FROM: AGENDA DATE: CITY MANAGER February 12, 1996 DEPARTMENT: Public Works CMR:141:96 SUBJECT:Public Hearing to Consider Local Approval and Adoption of County of Santa Clara Integrated Waste Management Summary Plan and Siting Element (CoIWMP) REQUEST Staff requests that, pursuant to the California Public Resources Code Sections 41721 and 41760, the City Council hold a public hearing to consider adoption of the County of Santa Clara Integrated Waste Management Summary Plan and Siting Element (ColWMP). Council is requested to consider all the public comments and to adopt the ColWMP by adopting the attached resolution. RECOMMENDATION Staff recommends that Council approve the attached resolution adopting the CoIWMP. POLICY IMPLICATIONS The adoption of this resolution does not represent any change to existing policies. EXECUTIVE SUMMARY The California Integrated Waste Management Act of 1989 (AB939) and subsequent legislation requires cities and counties to prepare, adopt, and implement Source Reduction and Recycling Elements (SRRE), Household Hazardous Waste Elements (HHWE), and Nondisposal Facility Elements (NDFE). It also requires counties to prepare, and cities and counties to adopt and implement, a CoDVMP. All of these documents comprise the CoIWMP package which must be submitted to the California Integrated Waste Management Board by February 29, 1996. The Summary Plan describes local integrated waste management programs and practices contained in local SRRE, HHWE, and NDFE, and identifies programs that will be implemented on a countywide basis. The Siting Element identifies existing and proposed solid waste disposal facilities, existing count wide disposal capacity~ and establishes goals and criteria for siting new or expanding existing facilities. CMR:141:96 Page 1 of 2 These programs are consistent with Palo Alto’s current activities, and no change or impact to Palo Alto refuse programs will result. FISCAL IMPACT The adoption of this resolution will have no fiscal impact. ENVIRONMENTAL ASSESSMENT The CoDVMP includes the required California Environmental quality Act documentation pursuant to California Code of Regulations Section 18783. RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING AND ADOPTING THE COIINTY OF SANTA CLARA INTEGRATED WASTE MANAGEMENT PLAN, SUMMARY PLAN AND SITING ELEMENT PURSUANT TO PUBLIC RESOURCES CODE SECTION 41750 ET SEQ. WHEREAS, the California Integrated Waste Management Act of 1989 (AB 939) imposes responsibility for solid waste management on cities and counties; and WHEREAS, the County of Santa Clara Integrated Waste Management Plan Summary Plan and Siting Element (CoIWMP) has been prepared by County staff in accordance with requirements of Public Resources Code (PRC) Section 41750 et seq.; and WHEREAS, PRC Section 41760 et seq. requires that the CoIWMP shall be approved by the county and by a majority of the cities within the county which contain a majority of the population of the incorporated areas of the county; and WHEREAS, pursuant to the California Code of Regulations Title 14, Division 7, Chapter 9, Article 8 (CCR), Section 18779, the Preliminary Draft CoIWMP has been circulated for a 45-day public review period (September 13, 1995 to November 3, 1995), and has been reviewed and commented on by the solid Waste Commission of Santa Clara County, acting as the Loca! Task Force; and all comments received have been responded to; and WHEREAS, pursuant to the CCR Section 18783, the adoption of the CoIWMP is subject to the environmental review requirements of the California Environmental Quality Act (CEQA); and WHEREAS, pursuant to CEQA, an Initial Study of the Environmental Impact of the CoIWMP, and a Proposed Negative Declaration of Environmental Impact for the CoIWMP have been issued by the County of Santa Clara Department of Planning and Development and have been recommended for approval by the Board of Supervisors of the County of Santa Clara; and WHEREAS, pursuant to CCR Section 18766, the City has conducted a public hearing on the CoIWMP, and after testimony was presented, and upon a review of all evidence in the record; NOW, THEREFORE, the Council of the City of Palo Alto does hereby RESOLVE as follows: SECTION I. The City Council hereby approves and adopts the County Integrated Waste Management Plan.~ 1960207 syn 0070913 SECTION 2. The City Council hereby authorized the County of Santa Clara to submit a copy of this resolution, the CoIWMP, and other related documents required to be submitted pursuant to PRC Section 41750 to the California Integrated Waste Management Board on the City’s behalf. SECTION 3. The City Council finds that the action hereby approved does not constitute a project under the California Environmental Quality Act.
