REO_UEST:
This report requests that Council adopt a Resolution (to be sent under separate cover),
declaring its intent to vacate street rights-of-way and a public utilities easement on the Palo
Alto Medical Foundation (PAMF) development site, and set a public hearing on the proposed
vacation for February 20, 1996.
RECOMMENDATIONS:
Staff recommends that Council adopt a Resolution, declaring its intent to vacate street rights-
of-way and a public utilities easement on the Palo Alto Medical Foundation (PAMF)
development site, and set a public hearing on the proposed vacation for February 20, 1996.
POLICY IMPLICATIONS:
The Resolution of Intent to Vacate does not represent an3; changes to existing City policy.
EXECUTIVE SUMMARY:
The PAMF is requesting City approval of a proposed new medical clinic and research facility
on a 9.2 acre site located on E1 Camino Real between the Holiday Inn and the Town and
Country Village Shopping Center. (See Attachment A, location map.) The 9.2 acre PAMF-
owned site consists of 13 separate parcels, mostly vacant, that PAMF proposes to merge into
one parcel via the subdivision process. The project will result in changes in traffic
circulation and relocation of existing utilities at the proposed campus site and in the

immediate vicinity; therefore, PAMF has requested that the City vacate certain street rights-
of-way and a public utilities easement (PL~) which currently exist on the site. The streets
to be vacated are the portion of Homer Avenue west of the railroad tracks and portions of
Urban Lane which connect to Homer Avenue. These streets and the PUE to be vacated are
shown on the attached map (Attachment B). The City owns Urban Lane and most of the
Homer Avenue rigxht-of-way to be vacated. The City has an easement for a 10-foot strip of
Homer Avenue and for the PUE. PAMF is the owner of the land rights underlying the City’s
easements.
PAMF has requested City approval of numerous applications related to the development of
its proposed new campus, including a tentative subdivision map to assemble the 13 parcels
into one parcel and to establish necessary new streets and other public dedications and
easements. These applications were reviewed and recommended for approval by the
Planning Commission on December 6, 1995. The Planning Commission’s recommendations
concerning most of the project applications are scheduled for review by the City Council
prior to this item on the Council agenda of January 22, 1996. It will be recommended by
staff that the tentative map application be continued by Council to February 20, the same date
proposed for consideration of the request to vacate the existing streets and easement. See
CMR: ! 04:96, included in this Council packet, for additional information.
PROPOSED VACATION OF STREETS AND PUBLIC UTILITIES EASEMENTS
In order for the City to vacate street rights-of-~vay and public utilities easements, the City
Council must find that the easement is not necessary for present or prospective public use.
Streets
With the approval of the tentative subdivision map merging the 13 individual parcels, there
will be no parcels requiring access from the portions of Homer Avenue and Urban Lane to
be vacated. New public ingess and egess easements and proposed street rights-of-way are
proposed and will be established through the subdivision map process. These new
easements and rights-of-way and the resulting changes in circulation are discussed and
shown in CMR:104:96 and its attached development plans. Because new streets are
proposed to be dedicated and constructed in conjunction with the project, the existing streets
are no longer necessary. The project Environmental Impact Report (EIR) indicates that the
proposed Urban Lane extension, which must be constructed as a condition of project
development, will improve circulation in the vicinity of the project.
Public Utilities
Existing utilities in the streets and the PUE to be vacated consist of undergound water, gas
and wastewater lines. These utilities will be relocated as a result of the PAMF project and
will no longer be necessary for present or prospective public use. The relocation of any

existing utilities and construction of any new utilities required as a result of the proj ect will
be done at PAMF expense and to the satisfaction of the Utilities Department, as a condition
of the project approval. A condition of both the development project and this easement
vacation is that PAMF grant or dedicate all required new utility easements.
RESOLUTION OF INTENT TO VACATE
To vacate the Homer Avenue and Urban Lane street rights-of-way and the PUE, the
California Streets and Highways Code requires that the City approve a Resolution of Intent
to Vacate and set a public hearing, and that it approve a Resolution Ordering Vacation after
considering the evidence offered at the public hearing. Because PAMF could not provide
the legal descriptions for exhibits to the Resolution in time to include with this report, the
required Resolution of Intent to Vacate will be sent under separate cover. The Resolution
will state the City’s intent to vacate the subject street rights-of-way and PUE, will set a
public hearing for the City Council meeting of February 20, 1996, and will include the
condition that PAMF grant the City the necessaI3~ ingress/egress, street and utility easements,
as shown on the development plans and tentative subdivision map reviewed by the Council
prior to this item on the same agenda.
FISCAL IMPACT:
None.
ENVIRONMENTAL IMPACT ASSESSMENT:
Council approval of the Planning Commission recommendations regarding this project
includes the approval of the Environmental Impact Report finding that it has been prepared
consistent with the requirements of the California Environmental Quality Act and adequately
analyzes the potential impacts of the project and related mitigation measures.

the City Council packet of January 11, 1996, to allow time for Council review.
Attached is the Resolution of Intent to Vacate Public Street and Utilities Easements on the
PAMF development site at 795 E1 Camino Real. The Resolution is discussed in
CMR: 107:96. As explained in the report, the Resolution is being sent under separate cover
because PAMF could not provide the legal descriptions for exhibits to the Resolution in time
to include in last week’s packet.

OF PALO ALTO TO VACATE PUBLIC STREET AND UTILITIES
EASEMENTS ON THE PALO ALTO MEDICAL FOUNDATION
DEVELOPMENT SITE AT 795 EL CAMINO REAL AND SETTING
A PUBLIC HEARING FOR FEBRUARY 20, 1996
WHEREAS, the Palo Alto Medical Foundation for Health Care,
Research, and Education ("PAMF") has petitioned the City of Pa!o
Alto (the "City") to vacate the following public street and
utilities easements:
A portion of Homer Avenue between E1 Camino Real
and Urban Lane, and a portion of Urban Lane that
connects to Homer Avenue, as shown in Book 6905 at
Page !55 and Book i413, Pages !!0, !!i, i14 and
1!5, Officia! Records of Santa Clara County in the
City of Palo Alto, County of Santa Clara, State of
California;
o Public utilities easements located between Homer
Avenue and the Peninsula Corridor Joint Powers
Board railroad right-of-way, as shown in Book !413,
Page !05 and !06, Official Records of Santa Clara
County in the City of Palo Alto, County of Santa
Clara, State of California; and
WHEREAS, P~MF has re_c~ested that the streets and utilities
easements be vacated because PAMF desires to construct a new
medical facility ("Project") on the property currently traversed by
the described public streets and easements, and the City Council
will consider the Project on January 22, !996; and
WHEREAS, the proposed Project includes dedication of new
public rights-of-way and easements as necessary to serve the
Project and properties in the vicinity thereof; and
WHEREAS, the Environmental Impact Report prepared for the
Project concludes that replacement of the existing street pattern
with the proposed new public streets, including an extension of
Urban Lane, would improve circulation in the vicinity of the
Project site, which would benefit the genera! public; and
WHEREAS, it is the intent of the City Council to vacate the
streets and utilities easements, as as depicted on the attached
Exhibit "A" and as more particularly described in Exhibit "B" and
shown on Exhibit "C," attached hereto; and
WHEREAS, the City Council intends to vacate the streets and
utilities easements according to the procedures set forth in City
Policy and Procedure 1-13 and California Streets and Highways Code
Division 9, part 3, Chapter 3, at Section 8320 et seq.;

NOW, THEREFORE, the City Council does hereby RESOLVE as
follows:
SECTION I. The City Council hereby declares its intent to
vacate the streets and utilities easements !ocated in the City,
County of Santa Clara, State of California, as depicted on the
attached E~ibit "A" and as more particularly described in Exhibit
"B" and shown on Exhibit "C," attached hereto.
SECTION 2. This vacation proceeding is conducted under the
authority of City Policy and Procedure !-13 and Chapter 2 of Part
2 of Division 9 of the California Streets and Highways Code, at
Section 8320 et seq.
SECTION 3. The City Counci! hereby orders that a public
hearing take place on February 20, 1996, at the hour of 7:00 p.m.,
or as soon thereafter as the matter may be heard, in the City
Council Chambers, 250 Hamilton Avenue, Pa!o Alto, California, for
all persons interested in the proposed vacation. Upon vacation,
the City’s interest in the vacated area shall be transferred to
PAMF. Such vacation wil! occur only after the fol!owing condition
has been satisfied: PAMF shal! grant the City all necessary new
streets and other public dedications and easements as shown on the
tentative subdivision map approved by the City Council for the PAMF
project.
