HomeMy WebLinkAbout1997-10-20 City Council (38)TO: City of Palo Alto City Manager’s Report HONORABLE CITY COUNCIL 4 FROM: AGENDA DATE: CITY MANAGER October 20, 1997 DEPARTMENT:Community Services 387:97 SUBJECT:RECEIPT OF CONTRIBUTION TO AUGMENT ART IN PUBLIC PLACES CAPITAL IMPROVEMENT PROJECT BUDGET (18617), AND BUDGET AMENDMENT ORDINANCE RECOMMENDATIONS Staff recommends that Council approve the attached Budget Amendment Ordinance, which recognizes the receipt of $23,550 in outside funding contributed to the City of Palo Alto to augment the City’s Art in Public Places Capital Improvement Project. POLICY IMPLICATIONS This recommendation does not represent any change to existing City policies. EXECUTIVE SUMMARY The Architectural Review Board imposed a public art condition on a project at 200 Sheridan Avenue in Palo Alto and instructed the applicant to work with the Public Art Commission and to seek their review and approval of the public art element. Subsequently, the Public Art Commission and the applicant selected and commissioned artist Brian Goggin to sculpt a work to be installed in the plaza fountain at 200 Sheridan Avenue. The sculpture will not be ready for installation until November 1997 well before the applicant’s need to apply for his occupancy permit. To accommodate the applicant, and at the same time, to ensure that the public art condition is satisfied, the applicant has made a contribution to the City of Palo Alto Art in Public Places program. The contribution, $23,500, represents the balance of funds owed to the artist to complete the sculpture. In tui’n, the Public Art Commission has informed the Architectural Review Board that the public art condition has been satisfied. It is the applicant’s expressed intention that Body of Urban Myth, as designed by Brian Goggin and approved by the Public Art Commission, be installed in the fountain at 200 Sheridan Avenue in accordance with the application approved by the Architectural Review Board. If for any reason the artist is unable to complete the sculpture, the applicant will allow the Public Art Commission to use the contributed funds in another manner that supports the City’s Art in Public Places program. The Public Art Commission at its meeting of August 27, 1997, approved acceptance of the contribution. CMR:387:97 Page 1 of 2 FISCAL IMPACT -. There is no fiscal impact. Funds would be placed in the Art in Public Places CIP (18617) to augment the Art in Public Places program. To expend thege funds appropriately, an adjustment of $23,550 needs to be. made to the Art in Public Places CIP budget. ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET FOR THE FISCAL YEAR 1997-98 TO PROVIDE AN ADDITIONAL APPROPRIATION FOR CAPITAL IMPROVEMENT PROJECT 18617,ART IN PUBLIC PLACES WHEREAS, pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 24, 1996 did adopt a budget for fiscal year 1997-98; and WHEREAS, the Community Services Department has received a contribution of $23,550 from the developer of 200 Sheridan Avenue to the City’s Art in Public Places program; and WHEREAS, the contribution represents the balance of funds owed to the artist, Brian Goggin, for the completion of the sculpture ~Body of Urban Myth", that will be installed in the plaza fountain at 200 Sheridan Avenue; and WHEREAS, the budget must be amended in order to appropriate funds for expenditure; and WHEREAS, City Council authorization is needed to amend the 1997-98 budget as hereinafter set forth. NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as follows: SECTION i. The sum of Twenty Three Thousand Five Hundred And Fifty Dollars ($23,550) in revenue is added to the General Fund, and is correspondingly transferred to the Capital Improvement Fund, and CIP 18617,Art in Public Places Program is correspondingly increased. SECTION 2. This transaction will have no impact on reserves. SECTION 3. As specified in Section 2.28.080(a) of the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTION 4. The Council of the City of Palo Alto hereby finds that this is not a project under the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary. SECTION 5. As provided in Section 2.04.350 of the Palo Alto Municipal Code, this ordinance shall become effective upon adoption.
