8989)
REQUEST
This report requests City Council consideration of a five-lot final subdivision map (Tract
8989) located at 4277 Miranda Avenue, submitted by Mark Migdal.
RECOMMENDATION
Staff recommends approval oft he final subdivision map for Tract 8989.
POLICY IMPLICATIONS
Policy implications of the final subdivision map wer~ddressed at the tentative subdivision
map stage of this project.
EXECUTIVE SUMMARY
On February 18, 1997, theCity Council approved a five-lot tentative subdivision on this 1.-5
acre site, with the lots ranging in size from 9,015 to 9;979 square feet each. The tentative
tract map was approved with 11 conditions, which require the preparation of a final map,
design and installation of public improvements (roads, utilities, street lights, street trees,
underground utilities and related improvements); completion of geotechnical irestigations;
obtaining necessary permits from SantaClara County Valley Water District; and preparati~
of a creek bank stabilization plan for Adobe Creek, which forms the northerly boundary of
the subdivision. The applicantwas also required to enter into a subdivision agreement with
the City of Palo Alto, guaranteeing that all improvements required for the tract will be
installed through posting of a bond by the subdivider. The subdivision agreement also
includes payment by the subdivider of a Below Market Rate (BMR) housing fee, per City

All of the conditions imposed on the tentative subdivision map have been met. Both the State
Subdivision Map Act and Palo Alto Subdivision Ordinance require that a fmal subdivision
map be approved prior to recordation of the tract. Staff recommends that the City Council
approve the applicant’s request for fmal subdivision map.

ENVIRONMENTAL ASSESSMENT
A Negative Declaration was approved by City Council in conjunction with the approval of
the tentative map.
