HomeMy WebLinkAbout1997-09-08 City Council (31)City of Palo Alto Manager’s Report TO: .HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: ADMINISTRATIVE SERVICES AGENDA DATE: SUBJECT: SEPTEMBER 8, 1997 CMR:364:97 SUMMARY VACATION OF EASEMENTS AT 302 RAMONA STREET AND 301 EMERSON STREET This report requests Council’s approval of a Resolution ordering the summary vacation of the Public Utilities Easements at 302 Ramona Street and 301 Emerson Street, Palo Alto. RECOMMENDATIONS: Staff recommends that Council authorize the Mayor to execute the attached Resolution Ordering the Summary Vacation of the Public Utilities Easements located at 301 Emerson Street and 302 Ramona Street, Pale Alto. POLICY IMPLICATIONS: The Resolution does not represent any change to existing policies. EXECUTIVE SUMMARY: The owners of the properties at 301 Emerson Street and 302 Ramona Street have requested that the City vacate the Public Utilities Easements (POE) which run along the west side of their properties (see maps attached to Resolution). The easements were dedicated as part of the subdivision located on the former Times Tribune property in April 1995; however, the developer relocated the transformers and granted new easements elsewhere on the site, and no facilities were located within the easements to be vacated. These easements have never been utilized, and are not necessary for any present or anticipated future public use. Since there is an exchange of easements, no fee will be assessed, as per the current Municipal Fee Schedule. CMR:364:97 Page 1 of 2 FISCAL IMPACT: There is no fmancial impact associated with the vacation or exchange of easements. ENVIRONMENTAL ASSESSMENT: ’ These projects are categorically exempt from the requirements of the California Environmental Quality Act; therefore, no environmental impact assessment is necessary. RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ORDERING THE SUMMARY VACATION OF PUBLIC UTILITIES EASEMENTS AT 302 RAMONA STREET AN~ 301 EMERSON STREET WHEREAS, the public utilities easements located at 302 Ramona Street and 301 Emerson Street have never been utilized since acquisition and are not necessary for future public use; and WHEREAS, from all evidence submitted to the Council of the City of Palo Alto it is found that said public utilities easements as described herein are not necessary for present or prospective public use for public utility purposes; and WHEREAS, it is the intent of the Council of the City.of Palo Alto to vacate the public utilities easements filed for record on 4/12/95 in Book 664 of Maps at Pages 22 & 23,.in the City of Palo Alto, County of Santa Clara, State of California; and WHEREAS, the Council of the City of Palo Alto intends to vacate such public utilities easements according to the procedures set forth in the California Streets and Highways Code Division 9, Part 3, Chapter 4 (Section 8333 et seq.); NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION I. This vacation is made under the authority of California Streets and Highways Code Chapter 4 of Part 3 of Division 9, commencing at section 8330. SECTION 2. Each sixty-eight (68) foot public utilities easement located at 302 Ramona Street (Parcel A) and 301 Emerson Street (Parcel B) in Palo Alto are hereby vacated. Said easements are more particularly described in Exhibits A and shown in Exhibits B, which Exhibits are attached hereto and incorporated herein by this reference. SECTION 3. The Council finds that each sixty-eight (68) foot easement has never been utilized, has been superseded by relocation, and is not necessary for future public use. ~.. This Council finds that this project is categorically exempt from the requirements of the California Environmental Quality Act and no environmental impact assessment is necessary. ~. The City Clerk, acting through the Real Property Manager shall cause a certified copy of this resolution attested by the City Clerk under seal to be recorded in the Office of the County Recorder of Santa Clara. SECTION 6. From and after the date of~ecordation of this resolution, said easement shall be considered vacated.
