RESOLUTION AUTHORIZING AMENDMENT TO
AUTOMATED FINGERPRINT SYSTEM AGREEMENT FOR
CAL-ID
REOUEST
This report requests that Council approve the Police Department’s continued participation
in the CAL-ID automated f’mgerprint system.
RECOMMENDATIONS
Staff recommends that Council adopt the attached resolution authorizing the Mayor to
execute the ninth amendment to the agreement providing for Palo Alto Police Department’s
continued participation in the CAL-ID automated fingerprint system for 1997-98.
POLICY IMPLICATIONS
This report does not represent any change to existing City policies.
EXECUTIVE SUMMARY
On January 1, 1986, Senate Bill 190 provided for implementation of a Statewide automated
fingerprint system that could be accessed by local law enforcement agencies. This bill
appropriated $7,000,000 to the Department of Justice for the purchase of equipment and
services to create this Statewide system. The bill also provided procedures for local
government to receive equipment, based upon a sharing of costs with the State. The State
paid 70 percent of the cost of the purchase of the equipment. All other costs for
implementing local systems are the responsibility of local government.
To be eligible to participate in this Statewide program and to receive the 70 percent matching
grant from the State, each County was required to form a local policy board. The Santa
Clara County CAL-ID Local Policy Board was formed in 1988 andis currently composed
of Supervisor Pete McHugh, from the Board of Supervisors; Mayor Henry Manayan, City

of Milpitas; District Attorney George Kennedy; Sheriff Charles Gillingham; Chief Louis
Cobarruviaz, San Jose Police Department, representing the largest police department; Ms.
Dianne Gershuny, City Manager of Los Altos; and Chief Chris Durkin, Chairman and
representative for the Police Chiefs’ Association of Santa Clara County. A staff committee
subsequently developed the Santa Clara County Program.
Each year, in order to continue participating in the program, participating agencies are
required to amend the agreement for providing automated fingerprint system services.
FISCAL IMPACT
The City of Palo Alto’s share for 1997-98 is $38,817.
Police Department’s proposed 1997-98 budget.
Funds have been included in the
ENVIRONMENTAL ASSESSMENT
This program is not a project requiring environmental assessment.

RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
AUTHORIZING THE MAYOR TO EXECUTE THE NINTH
AMENDMENT TO AGREEMENT TO PROVIDE LOCAL LAW
ENFORCEMENT ACCESS TO THE CALIFORNIA
IDENTIFICATION SYSTEM
WHEREAS, the County and the Incorporated Cities entered
into an agreement dated April 26, 1988, entitled "AGREEMENT TO
PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA
IDENTIFICATION SYSTEM" (hereinafter "Original Agreement"), in order
to fund, implement and operate a local automated fingerprint
identification system (hereinafter "Local ID System"), which will
provide local law enforcement agencies with direct access to the
California Identification System (hereinafter "CAL-ID System")
through the use of local remote access network equipment
(hereinafter "Local RAN Equipment"); and
WHEREAS, the County and the Incorporated Cities desire to
continue the Original Agreement and to modify its terms with
respect to the financial contributions which the County and the
Incorporated Cities will each make to the City of San Jose in order
to implement and operate the Local ID System and to extend the term
of the Agreement for another year.
NOW, THEREFORE, the Council of the City of Palo Alto does
hereby RESOLVE as follows:
SECTION i. The Mayor is authorized to execute an amendment
to said Original Agreement to continue for another year
implementation and operation of the Local ID System entitled "Ninth
Amendment to Agreement to Provide Local Law Enforcement Agency
Access to the California Identification System."
SECTION 2. The City Manager is authorized to send to the
City of San Jose’s Finance Department the City of Palo Alto’s check
in the amount of Thirty-Eight Thousand Eight Hundred Seventeen
Dollars ($38,817.00) for the Local ID System, which is the City of
Palo Alto’s financial ~contribution to the operating budget for
fiscal year 1997-98 for the Local ID System.

SECTION 3. The Council finds that this is not a project
under the California Environmental Quality Act and, therefore, no
environmental impact assessment is necessary.

NINTH AMENDMENT TO AGREEMENT TO
PROVIDE LOCAL LAW ENFORCEMENT
AGENCY ACCESS TO THE CALIFORNIA
IDENTIFICATION SYSTEM
THIS NINTH AMENDMENT is made and entered into this ~ day of
,1997,by and between the COUNTY OF SANTA CLARA, a county of
the State of California (hereinafter "County"), the CITY OF CAMPBELL, a municipal
corporation, the CITY OF CUPERTINO, a municipal corporation, the CITY OF GILROY,
a municipal corporation, the CITYOF LOS ALTOS, a municipal corporation, the TOWN
OF LOS ALTos HILLS, a municipal corporation, the TOWN OF LOS GATOS, a
municipal corporation, the CITY OF MILPITAS, a municipal corporation, the CITY OF
MONTE SERENO, a municipal corporation, the CITY OF MORGAN HILL, a municipal
corporation, the CITY OF MOUNTAIN VIEW, a municipal corporation, the CITY OF
PALO ALTO, a municipal corporation, the CITY OF SAN JOSE, a municipal
corporation, the CITY OF SANTA CLARA, a municipal corporation, the CITY OF
SARATOGA, a municipal corporation, and the CITY OF SUNNYVALE, a municipal
corporation (hereinafter collectively referred to as "Incorporated Cities").
RECITALS
WHEREAS, on April 26, 1988, the County and the Incorporated Cities entered
into an agreement entitled "Agreement to Provide Local Law Enforcement Agency.
Access to the California Identification System" ("AGREEMENT"); and
WHEREAS, since the date of the AGREEMENT, the County and the
Incorporated Cities have entered into eight amendments to the AGREEMENT to modify
various terms and extend the term of the amended AGREEMENT through June 30,
1997; and
WHEREAS, the County and the Incorporated Cities desire to extend the term of.
the amended AGREEMENT for another year;

NOW, THEREFORE, in consideration of mutual promises and benefits, the
County and Incorporated Cities agree that the amended AGREEMENT be furthei
amended as follows:
SECTION 1. Section 3 of the AGREEMENT, entitled "TERM" is amended in full to read
as follows:
"The term of this AGREEMENT shall commence upon the date of
execution of this AGREEMENT by all parties and shall terminate on June
30, 1998, unless terminated earlier as provided herein. It is anticipated
that the parties will renew this AGREEMENT beyond June 30, 1998, by
an express written amendment."
SECTION 2. As required under Section 6.c.3. of the AGREEMENT, a list setting out the
operating budget for fiscal year 1997-98 and reflecting the financial contributions of
each party to the AGREEMENT for fiscal year 1997-98 operating costs of the Local ID
System is attached and incorporated into this Ninth Amendment as Exhibit A.
SECTION 3. This Ninth Amendment may be executed in one or more counterparts
each of which shall be an original, but all of which together shall constitute one and the
same document.
SECTION 4. AI’. other terms and conditions of the amended AGREEMENT shall remain
in full force and e ~fect.

Personnel holiday pay/overtime is not an increase over last year’s budget, it is merely
broken out for ease of tracking and accounting purposes.
Maintenance increased $2,480 or. 1602 for FY 1997-98 for coverage of LIT, Fax, and
Crimcon. It reflects coverage on all three (3) faxes (2 were left offin FY 1996-97) and
increases quoted for FY 1997-98.
Training of $6,000 is a new budget item. It was felt that with all the changes in the
forensic field due to the recent high profile cases such as the OJ Cage, Polly Klass
kidnaping/homicide case, FBI Crime Lab, and the New York Latent Examiners problems
that CIU would be remiss in not providing continuing educational training to the personnel
assigned to CIU.
Due to numerous high profile court cases, all a~pects of the forensic sciences have fallen
under closer examination.
As the individual latent examiners covered by CAL-ID budget become certified, it is
required that they have continuing education in ordei" to maintain their expertise and
certification.
Previously, these latent examiners have had to pay their own expenses to the majority of
the training sessions that they have attended.
These latent examiners are called upon for court testimony as "experts’~ in the field of
fingerprint identification and must be qualified by the court to render opinion testimony.
Equipment - replacement of printer for $2,000. The current laser printer is approximately
five (5) years old. This printer is utilized for CIU reports, CIU statistic reports, etc. The
printer is starting to malfunction and it appears that it will have to be replaced within the
FY 1997-98.
