REQUEST
This is a request that Council approve the change in boundary of the University Avenue area
and the annual assessments for the University Avenue area and California Avenue area
parking bonds.
RECOMMENDATIONS
Staff recommends that Council:

1.Hold a public hearing and adopt the attached resolution deleting territory from the
University Avenue Parking district, and
2.Hold a second public hearing and adopt the attached resolutions confirming the
Engineer’s Report and Assessment Roll for:

Approval of this action does not represent any change to existing policies.

Council action is necessary to reduce the University Avenue Parking Assessment District
area. Due to the subdivision of the former Times Tribune building (245 Lytton Avenue), the
district area is reduced by6,863 square feet, or 0.2 percent of the total district area. This
adjustment will have little impact on property owners, as normal assessment amounts can
vary approximately 5 percent per year. On May 5, 1997, Council by Ordinance No. 4415
CMR:275:97 Page 1 of 6
amended Section 13.12.050 of the Palo Alto Municipal Code to provide a procedure for
deletion of territory from the boundaries of the Parking Assessment Districts, CMR:209:97.
On May 19, 1997, Council approved a Resolution of Intention to delete territory from the
University Avenue Parking District.
Council action is also necessary to levy assessments for the five active parking projects on
an annual basis. A public hearing is required in which property owners can question the
assessments. The five projects include three surface lots and the .Ted Thompson parking
garage in the California Avenue area, as well as two surface lots~ and the Cowper-Webster
parking garage and a portion of the 250 University Avenue parking garage in the University
Avenue area. The total amount levied for the California Avenue area is $284,156, and for
the University Avenue area is $730,659. This year’s assessments do not reflect any change
in bonded indebtedness in either of the districts. For most properties, rates have remained
essentially unchanged from last year. Assessments for the new downtown parking structures
that are currently being studied by the City are not included in these assessments. If the
studies indicate that the downtown parking structures are viable, staff will return to Council
for action that will result in either the formation of a new downtown assessment district or
amending the existing district to fund the structures.
FISCAL IMPACT
The projects are funded by the assessment districts and no City General Fund monies are
involved.
ENVIRONMENTAL ASSESSMENT
Both the approval of assessments and the deletion of territory from the district are exempt
from the provisions of the California Environmental Quality Act (CEQA).

BACKGROUND
On April 22, 1997, Council approved and adopted the Parking Assessment District Ordinance
permitting a change (deletion of territory) to the boundaries of the Parking Assessment
Districts. Due to the subdivision of the former Times Tribune building (245 Lytton Avenue),
the land that would be subject to the University Avenue Parking District has been reduced by
6,863 square feet, or 0.2 percent of the total district area. The City’s Assessment District
(Section 13.12.050 of the Palo Alto Municipal Code) included provisions for the annexation
of area to an existing district, but did not provide specifically for the deletion of area from
a district. For this reason it was necessary to amend Section 13.12.050, to allow for this
boundary change. The property owners will feel no effect from this change, as normal
assessment amounts can vary approximately 5 percent per year depending upon new
construction and/or vacancies in existing buildings.
Section 13.16.150 of the Palo Alto Municipal Code, which provides the procedures for
parking bonds issued under Bond Plan "G," requires that a public hearing be held annually
(the second Monday in June) on the assessments which must be levied to pay principal and
interest on bonds issued to finance capital improvements for five active parking lots. The
purpose of the public hearing is to allow each property owner the opportunity to question the
computation of his/her assessment and the elements which comprise it, that is, the square
footage of each occupied building, the off-street parking requirements for the usage, and the

off-street parking provided. Assessments are levied on the basis of building square
footage, with a credit given for the off-street parking provided by the property owner.
The five active projects are listed and described as follows:
California Avenue District. Project 71-63; Surface Parking Lots at the corners of
Cambridge Avenue and Birch Street, and Sherman Avenue and Birch Street, and a
Feasibility Study for a parking structure on one of the lots.
2. California Avenue District, (former) Keystone Lot Parking, Project 86-01: Surface
. Parking Lot on Cambridge Avenue, construction of interim improvements, and a
Feasibility Study for a parking structure on the lot.
California Avenue District. Ted .Thompson Parking Structure, Project 92-13:
Construction of a two-level parking structure on Cambridge Avenue between Birch
Street and Nogal Lane.
University Avenue District. Project 75-63: Surface Parking Lots on Bryant Street and
at the corner of Kipling Street and Lytton Avenue, and a Feasibility Study for a
downtown parking structure.
University. Avenue District. Lot J Refunding and 250 University. Avenue Acquisition:
Refmancing of bonds for an existing seven level parking garage (Cowper-Webster) and
acquisition of one level of public parking (250 University Avenue).

POLICY IMPLICATION8
Approval of this action does .not represent any change to existing policies.
Exhibit C shows changes made to the assessment mils. The estimated assessments were
sent to property owners within the districts on May 15, 1997. The addendum modifies
assessments due to recent changes in business site conditions (square footage, vacancy,
etc.) brought to staff’s attention by property owners since the estimated assessments were
prepared.
Because the hearing itself is the legally prescribed process by which questions about the
basis of assessment and the property owners’ individual circumstances may be heard, it
may be necessary to have a second addendum available at the Council meeting which
reflects changes brought to staff’s attention over the last four days. The public hearing for
one or both of the assessment districts may need to be continued, if last minute information
brought forward by property owners cannot be verified and included in the amended roils
prior to the hearing.

Approximately $341,000 in excess construction funds remained in the California Avenue
District bond fund for the Ted Thompson parking garage, Project 92-13. These funds are
used to reduce the tax roll required to pay off the bonds sold to finance the project. To
equalize assessments, the funds are spread uniformly over the duration of the bonds (19
years) beginning with the 1996 assessments.

On December 17, 1984, Council increased parking permit fees in the California Avenue
Parking District to pay for all maintenance costs, including sweeping, landscaping, signing
and lighting. Staff has been accumulating and monitoring information about the actual cost
of maintenance for the parking lots. Based on the past few fiscal years’ experience, no
maintenance assessment will be levied for FY 1997-98.
Unlike the California Avenue area, the University Avenue area has no maintenance
assessment district. In the past, revenue collected has exceeded expenditures for the
University Avenue area and there was no need to form a maintenance assessment district
in the University Avenue area. On June 3, 1997, Finance Committee approved an increase
in the parking fees within the University Avenue Parking District to cover increasing
maintenance costs (CMR:257:97). This increase in permit fees assures that the revenues
collected will exceed the expenditures and, therefore, no maintenance assessment district
need be formed.
FISCAL IMPACT
The projects are funded by the Assessment Districts and no City General Fund monies are
involved.
ENVIRONMENTAL ASSESSMENT
Both the approval of assessments and the deletion of territory from the District are exempt
from the provisions of the California Environmental Quality Act (CEQA).
STEPS FOLLOWING APPROVAL
The assessments will be sent to the Santa Clara County Tax Collector in July and will
appear on the October property tax .bills. The resolution deleting territory from the
District requires the City Clerk and Director of Public Works to cause the official
assessment or collection rolls, maps and/or assessment diagrams to be amended and to
record any such amended documents as appropriate with the county recorder within 15
days of Council action adopting the resolution.

RESOLUTION NO.
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
DETERMINING TO DELETE TERRITORY FROM THE
UNIVERSITY AVENUE PARKING DISTRICT
The Council of the City of Palo Alto does resolve as
follows:
SECTION I. Authority. The actions contemplated by this
Resolution and all subsequent proceedings hereunder are authorized
under Title 13, Chapter 13.12, Section 13.12.050(x) of the Palo
Alto Municipal Code, to which reference is hereby made for further
particulars.
SECTION 2. Proceedings. Under the foregoing authority,
the City is empowered to delete territory.from any parking district
formed under any partof Title 13, Ordinance No~ 844 or ordinance
No. 1928 or under general law. The University Avenue Parking
District (the "District") was formed pursuant to Ordinance No. 1928
and is subject to the deletion of territory upon proceedings had
before this Council, which proceedings were commenced on May i9,
1997 by the ~adoption of Resolution of Intention No. ~7765 of this
Council evidencing its intention to consider the deletion of
certain lands from the District, all as set forth in such
Resolution of Intention. The lands subject to deletion are as
identified in such Resolution of Intention and as shown on the map
there of attached to said resolution.
SECTION 3. Hearing. Pursuant to the above authority, this
Council has duly ordered and held a public hearing on the matter of
the deletion of such ~ands from the District. The hearing was held
in the regular meeting place of this Council, City Council
Chambers, City Hall, 250 Hamilton Avenue, Palo Alto, California, on
June 9, 1997 at the hour of 7:00 p.m. and all persons interested in
the matter were heard and all those in favor and in opposition to
the matter were given the opportunity to express their views and
the hearing was duly closed.
SECTION 4. Deletion Ordered. Based upon all evidence
available, including materials presented by City staff and at the
hearing, this Council finds that the deletion of such lands will be
consistent with the purposes of and will not adversely affect the
operation of the District therefore, the lands asdescribed on the
map thereof on file with the City Clerk are hereby ordered deleted
from the District.
SECTION 5. Bond Security. This Council expressly finds
that the deletion of the lands herein ordered will not affect the
repayment of any bonds of the District as a result of such deletion
and therefore, no payment of cash or the provision of any other
securities shall be required to mitigate any possible decrease in
security for any such bonds.

SECTION 6. Documents Corrected. The City Clerk and the
Director of Public Works are hereby authorized and directed to
cause the official assessment or collection rolls, maps and/or
assessment diagrams of the District on file with the City to be
amended in accordance with the order of this Council deleting the
aforementioned territory.. Any maps or diagrams of the District
recorded with the County Recorder of the County of Santa Clara
shall be amended by appropriate recordings and filings, to be
accomplished within 15 days of the adoption of this resolution.
SECTION 7. CEQA. This Council finds that the action
hereby contemplated does not constitute a project within the
meaning of the California Environmental Quality Act.
SECTION 8. Effective Date. This resolution shall be
effective upon thedate of its adoption.

RESOLUTION NO.
A RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
CONFIRMING ENGINEER’S REPORT AND ASSESSMENT ROLL
UNIVERSITY AVENUE PARKING PROJECTS
(LOT J REFUNDING and 250 UNIVERSITY AVENUE ACQUISITION)
(For Fiscal Year 1997-98)
THE COUNCIL OF THE CITY OF PALO ALTO DOES RESOLVE as
follows:
Section i: After proceedings to that end duly had and taken
pursuant to the Palo Alto Municipal Code, a public hearing has
been duly held on the Engineer’s Report and assessment roll
prepared for the above fiscal year to pay the principal and
interest on bonds issued pursuant to Resolution of Intention No.
6768, adopted by the Council of the City of Palo Alto on April 20,
1989;
Section 2: This Council has heard all persons having an
interest in any real property within the parking assessment
district; has heard all objections, protests, or other written
communications from any persons interested in the real property
within the district; has taken and received oral and documentary
evidence pertaining to the matters contained in the report; has
remedied and corrected any errors or informalities in the report
and revised and corrected any of the acts or determinations of the
various City officials as contained therein, and is fully informed
in the premises;
SeCtion 3 The Engineer’s Report and assessment roll, and
each of the assessments therein as fully revised and corrected, is
hereby approved and confirmed.
Section 4: The report together with the certificate of the
City Clerk as to the fact and date of approval by this Council,
shall forthwith be delivered to the County of Santa Clara, and the
proper County officer shall cause to be posted to the tax rolls,
in the column provided therefor the amount of each of the
assessments proposed to be levied and collected for the fiscal
year as set forth in the report as confirmed.
