HomeMy WebLinkAbout1997-06-02 City Council (22)City of Palo Alto City Manager’s Report TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: ADMINISTRATIVE SERVICES AGENDA DATE: JUNE 2, 1997 CMR:230:97 SUBJECT:PARK DEDICATION OF THE WILLIAMS PROPERTY, 351 HOMER AVENUE REOUEST This report requests that Council adopt the attached ordinance dedicating the Williams property, located at 351 Homer Avenue, as parkland. RECOMMENDATIONS Staff recommends that Council authorize the Mayor to execute the attached ordinance dedicating the Williams property, at 351 Homer Avenue, as parkland. POLICY IMPLICATIONS This park dedication does not represent any changes to existing City. policy. EXECUTIVE SUMMARY In April 1995, the Santa Clara County Board of Supervisors approved a $40,000 grant for the Williams property restoration project, subject to the condition that the Council dedicate the Williams property as parkland. On June 10, 1996, Council adopted Resolution 7594, a resolution declaring its intention to dedicate the Williams property located at 351 Homer Avenue as parkland, upon execution of a lease with the Museum of American Heritage (CMR:292:96). In accordance with the resolution, both the lease for the Williams property by and between the City of Palo Alto and the Museum of American Heritage and the Historical Project Agreement between the County, the City and the Museum of American Heritage have been executed. The attached ordinance provides for the parkland dedication, CMR:230:97 Page 1 of 2 and as required in the terms of the Will ofRhona Williams,that the property be named the "Dr. Thomas M. Williams and Dora Moody Williams Park." FISCAL IMPACT There are no fiscal impacts to the City related to this park dedication ordinance. ENVIRONMENTAL ASSESSMENT An environmental impact assessment was prepared for the project, which determined that the project would have a less than significant impact on the environment and that a Negative Declaration should be prepared. ORDINANCE OF THE COUNCIL OF THE CITYOF PALO ~LTO AMENDING CHAPTER 22.08 OF TITLE 22 OF THE PALO ALTO MUNICIPAL CODE BY ADDING SECTION22.08.380 TO DEDICATE 351 HOMER AVENUE, PALO ALTO, COMMONLY KNOWN AS THE WILLIAMS PROPERTY, AS A PARK AND RESERVING THE WILLIAMS PROPERTY FOR PARK, PLAYGROUND, RECREATION OR CONSERVATION PURPOSES WHEREAS, Article VIII of the Charter of the City of Palo Alto and Section 22.08.004 of the Palo Alto Municipal Code require that if any site, parcel or area of land owned by the City of Palo Alto intended to be used for park purposes shall be reserved for park, playground, recreation or conservation, the Council shall first cause to be prepared an ordinance dedicating such site, parcel or area of land for such purposes; and WHEREAS, on June I0, 1996, the City Council adopted Resolution No. 7594, declaring its intention to dedicate the property commonly referred to as the Rhona Williams Property ("Property") as parkland upon the execution of a lease with the Museum of American Heritage; and WHEREAS, the Board of Supervisors of the County of Santa Clara approved a $40,000 grant to the Property for restoration work purposes, provided that the Property is dedicated to and intended to be used for park; , NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as follows: SECTION I. The Council hereby declares that the real property and improvements located at 351 Homer Avenue, Palo Alto are hereby reserved for park, playground, recreation or conservation purposes, and the foregoing real property and improvements are hereby dedicated as a city park and named the."Dr. Thomas M. and Dora Moody Williams Park." SECTION 2. Section 22.08.380 of Chapter 22.08 of Title 22 of the Palo Alto Municipal Code is hereby added to read as follows: "22.08.380 Dr. Thomas M. and Dora Moody Williams Park. That certain parcel of land known as the "Dr. Thomas M. and Dora Moody Williams Park" delineated and described in Exhibit A-25, attached hereto and incorporated herein by reference, is hereby reserved for park, playground, recreation or conservation purposes. 970416 syn 0071181 1 SECTION 3. The City Council hereby finds that this project will have less than a significant impact on the environment, and the negative declaration prepared for such project is hereby approved. SECTION 4. This ordinance shall become effective upon the commencement of the thirty-first day after the day of its adoption.
