FROM THE UNIVERSITY AVENUE PARKING
ASSESSMENT DISTRICT.
REQUEST
This report requests that Council approve and adopt the resolution of
territory from the University Avenue Parking Assessment District.

RECOMMENDATIONS
Staff recommends that Council adopt the attached resolution announcing the intention to
delete 6,863 square feet from the University Avenue Parking Assessment District.
POLICY IMPLICATIONS
Approval of this action does not represent any change to existing policies.
EXECUTIVE SUMMARY
On May 5, 1997 Council by Ordinance No. 4415 amended Section 13.12.050 of the Palo
Alto Municipal Code to provide a procedure for deleting of territory from the boundaries of
the Parking Assessment Districts, CMR:209:97.
Council action, in the form of a Resolution of Intention, is necessary to announce the
intention to delete territory from the University Avenue Parking Assessment District. Due
to the subdivision of the former Times Tribune building (245 Lytton Avenue), the district
area has been reduced by 6,863 square feet, or 0.2 percent of the total district area. The
parcel was subdivided into commercial and residential zones. Since residential zones are not
assessed, the residential portion, 6,863 square feet, of the parcel is proposed to be deleted
from the assessment district. Staff recommends that Council adopt the attached resolution to
commence the proceedings to delete this small territory from the district.
FISCAL IMPACT
There are no City funds involved in the ordinance change.

ENVIRONMENTAL ASSESSMENT
The ordinance change will have no environmental impact.
STEPS FOLLOWING APPROVAL
Notice of the Council’s intent to delete territory will be published twice. On June 9, 1997,
a resolution determining to delete territory from the University Avenue Parking
Assessment District will be presented for approval and adoption along with the annual
Assessmems for University Avenue Area and California Avenue Area Parking Bonds -
Plan G: FY 1997-98.

RESOLUTION NO.
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ~LTO
OF INTENTION TO DELETE TERRITORY FROM THE
UNIVERSITY AVENUE PARKING DISTRICT
The Council of the City of Palo Alto does resolve as
follows:
SECTION i. Authority. The actions contemplated by this
Resolution and all subsequent proceedings hereunder are authorized
under Title 13, Chapter 13.12, Section 13.12.050(x) of the Palo
Alto Municipal Code, to which reference is hereby made for further
particulars.
SECTION 2. Parking District.Under the foregoing
authority, the City. is empowered to delete territory from any
parking district formed under any part of Title 13, Ordinance No.
844 or ordinance No. 1928 or under general law. The University
Avenue Parking District (the "District") was formed pursuant to
Ordinance No. 1928 and is subject to the deletion of territory upon
proceedings had before this Council.
SECTION 3. Intention. It is the intention of this Council
to consider the deletion of certain lands from the District, which
lands are as shown on the map labeled Attachment "A", attached
hereto ’and incorporated herein by this reference. Based upon
information provided by City staff, this Council preliminarily~
finds that the deletion of such lands will not affect the repayment
of any bonds of the District as a result of such deletion and that
no payment or provision of additional securities to mitigate such
deletion of land from the District shall be required.
SECTION 4. Map of lands. Reference is hereby made to the
map labeled Attachment "A", for further particulars and a
description of the lands subject to deletion from the District and
such map shall govern for purposes of theseproceedings, except to
the extent modified by order of this Council.
SECTION 5. Hearing. Pursuant to the above authority, this
Council hereby orders that a public hearing be held before this
Council on the matter of the deletion of such lands from the
District. The hearing shall be held in the regular meeting place
of this Council, City Council Chambers, City Hall, 250 Hamilton
Avenue, Palo Alto, California, on June 9, 1997 at the hour of 7:00
p.m., or as soon thereafter as is practical for the matter to be
heard. At such place, date and hour, all persons interested in the
matter will be heard and all those in favor and in opposition to
the matter will be afforded the opportunity to express their views.
SECTION 6. Notice. The City Clerk is hereby authorized
and directed to give notice of the public hearing by publication of
a copy of this resolution twice in the Palo Alto Weekly, a
newspaper circulated within the City, the first of which

publications shall.occur not less than ten (i0) days before the
date appointed above for the hearing.
SECTION 7. CEQA. This Council finds that the action
hereby contemplated does not constitute~ a project within the
meaning of the California Environmental Quality Act.
SECTION 8. Effective Date. This resolution shall be
effective upon the date of its adoption.
