SUBJECT:Amendment to Chapter 22.04 of the Municipal Code Prohibiting
Consumption of Alcohol at El Palo Alto Park
REQUEST
This report requests Council adopt an ordinance amending Chapter 22.04 of the Palo Alto
Municipal Code to prohibit the consumption of alcoholic beverages in E1 Palo Alto Park.
RECOMMENDATIONS
Staff recommends Council adopt the attached ordinance amending Palo Alto Municipal Code
22.04, prohibiting alcohol consumption at E1 Palo Alto Park.
POLICY IMPLICATIONS
This ordinance is consistent with established policy prohibiting alcohol consumption at certain
designated pat’ks.
EXECUTIVE SUMMARY
At the meeting of May 5, 1997, Council adopted an ordinance prohibiting the consumption of
alcohol at Timothy Hopkins, Scott and Robles Parks. At that time, Council directed that,
because E1 Palo Alto Park was contiguous to Hopkins Park, an alcohol consumption ordinance
should be enacted for that location as well. While there have not been any alcohol-related calls
for service or complaints from. that area in the last two years, staff concurs that the close
proximity to Hopkins Park makes this action desirable as a preventive measure.
Per Council direction, Community Selvices staff has sent out letters (see attached) to other
neighborhood, associations inquiring about any concerns they might have related to alcohol
usage in parks in their specific areas.

FISCAL IMPACT
There is ,no fiscal impact associated with this ordinance.
ENVIRONMENTAL ASSESSMENT
There are no associated environmental issues.

ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
~AMENDING CHAPTER 22.04 [PARK AND RECREATION
BUILDING USE AND REGULATIONS] OF THE PALO ALTO
MUNICIPAL CODE TO PROHIBIT CONSUMPTION OF
,ALCOHOLIC BEVERAGES IN EL PALO ALTO PARK
The Council of the City of Palo Alto does ORDAIN as
follows:
SECTION i. Section 22.04.341 is hereby added to Chapter
22.04 Of the Palo Alto Municipal Code to read as follows:
22.04.341 E1 Palo Alto Park.-Consumption of
alcoholic beverages prohibited.
(a) It shall be unlawful for any person to
consume any alcoholic beverage in that park known
as E1 PaloAlto Park.
(b) Any person who violates this section is
guilty of an infraction and upon conviction
thereof shall be punished as provided in section
1.08.010 of this code. Each violation constitutes
a separate offense and may be separately punished.
SECTION 2. The City Council hereby finds that this
ordinance is not a project for purposes of the California Environ-
mental Quality Act.
SECTION 3. This ordinance shall become effective upon the
commencement of the thirty-first day after the date of its passage.

Dear Association President:
The Palo Alto City Council approved an ordinance at their May 5, 1997 meeting
prohibiting the use of alcohol at Hopkins, Scott and Robles Parks, and at a future meeting
will-add E1 Palo Alto Park. Other parks xvhere Council has banned alcoho!-include
Cogswell, Johnson, Greer, Lytton Plaza and Boulware. Alcohol is allowed at Mitchell
and Rinconada Parks with a permit.
Council directed staff to contact neighbors of other City parks in an attempt to learn if
there is an interest in prohibiting the consumption of alcohol in parks in your
neighborhood. The department of Community Services is responsible for parks in the
community and would like to hear your thoughts. Please send your comments to me at
