Miller for Editing and Desktop Publishing Services for the Comprehensive Plan REOUEST This is a request for approval of an Amendment to the Agreement between the City and Barry J. Miller for additional contracting services related to preparation of the Comprehensive Plan. RECOMMENDATIONS Staff recommends that the Council approve the attached Amendmem in the amoum of $18,000 to the Agreemem between the City and Barry J. Miller for Comprehensive Plan editing and desktop publishing services. The Amendmem will increase the original contract from $30,000 to $48,000. POLICY IMPLICATIONS This request does not represent any change to existing policies. DISCUSSION The contract amendmem allows for these additional services: rewrite of the Imroduction; An additional edit of each Chapter and Elemem after City Council action; and An additional reformatting and priming of the entire Comprehensive Plan. During the public review and Board and Commission review of the draft Comprehensive Plan, several issues have been raised and numerous revisions requested. In particular, it has been requested that the Introduction be rewritten to provide a better sense of why a City CMR:246:97 Page 1 of 2 prepares a Comprehensive Plan and what should be included, as well as to make the Introduction fxiendlier and more readable. The additional.editing, reformatting and printing is required because of the numerous changes requested. ALTERNATIVES Should the Council choose not to increase the contract amount, permanent staff will need to assume these tasks, and the publication date will be significantly delayed. FISCAL IMPACT The $18,000 appropriation will be funded t~om cost savings in preparing the Comprehensive Plan, including $5,000 reserved for newsletter publication, $3,000 in advertising, and $10,000 in other consultant contracts. ENVIRONMENTAL ASSESSMENT Amendment to an existing contract for consulting services is not a project under CEQA. ATTACHMENTS Amendment No. 2 to Agreement Between City and Barry J. MILLER This Amendment No.2. to Agreement No. C5072062 ("Agreement") is entered into , 1997, by and between the CITY OF PALO ALTO, a chartered city and a municipal corporation of the State of California ("CITY"), and BARRY J. MILLER (Taxpayer Identification Number 044-62-8601), with offices at 817 Alvarado Road, Berkeley, CA 94705 ("CONTRACTOR"). RECITALS: WHEREAS, the Agreement was entered into between the parties for the provision of’ editing and desk-top publishing services with respect to the update of CITY’s Comprehensive Plan; and WHEREAS, the parties on October 28, 1996, amended the. Agreement.to revise the scope of work and increase the total compensation allowed under the Agreement by $5,000, to a total maximum compensation of $30,000; WHEREAS, the parties desire to further amend the Agreement to revise the scope of work and increase the total compensation allowed under the Agreement by $18,000, to a total maximum compensation of $48,000; NOW, THEREFORE, in consideration of the covenants, terms, conditions, and provisions of this Amendment, the parties agree: SECTION i. to read as follows: Section 4 of the Agreement is hereby amended "For the full performance of the services described herein by CONTRACTOR, CITY shall pay CONTRACTOR a total sum not to exceed Forty- Eight Thousand dollars ($48,000), and any progress payments will be paid within thirty (30) days of submission by CONTRACTOR of its monthly itemized billings, in triplicate, in accordance with the attached Project Budget, marked "Exhibit "B" and incorporated herein by this reference." SECTION 2. Exhibit A to the Agreement (Scope of Services) is hereby amended by revising the description of Task #13 to read as follows: "TASK #13 - Consultant team t~ work with CITY professional and clerical staff in upgrading graphics, converting document to PageMaker 6.0 format, formatting and p~ovision 970417 lac 0080491 of graphics for Implementation Chapter, placement of Figure numbers and preparation of a Table of Figures. Consultant team to perform final changes in formatting and layout as required by staff per the recommendations of reviewing bodies, and as needed to resolve unanticipated problems in formatting due to upgrade of software and operating system." SECTION 3.Exhibit A to the Agreement (Scope of Services) is hereby further amended by adding a new Task #14 to read as follows: "Consultant shall prepare a revised Chapter i, Introduction, incorporating comments received during the review process. Consultant shall perform final editing on the remaining chapters and elements of the Plan as directed by staff in order to incorporate changes made during the review process." SECTION 4. Exhibit B to Budget) is hereby amended by: the Agreement (Project i. Revising the budget for Task 13 to increase the amount allocated to work by subcontractor Juliana Pennington by an additional amount of $ii,000, and 2. Adding a budget line item for new Task 14, in the amount of $7,000 allocated to work to be performed by Barry J. Miller, and 3. Increasing the total maximum budgeted amount for labor cost by $18,000. Except as herein modified, all other provisions of the Agreement, including any exhibits and subsequent amendments thereto, shall remain in full force and effect.
