Approval of Amendment No. 2 of Contract with Lewis & Tibbitts,
Inc., for Electric Utility Trench and Substructure Installation.
REQUEST
This is a request for approval of an amendment to an existing construction contract (C6075675)
with Lewis & Tibbitts, Inc., of Fremont, California, to increase the contract amount by $100,000
for as-requested utility substructure installation.
RECOMMENDATIONS
Staff recommends that Council:
1)Approve and authorize the Mayor to execute the.attached amendment to contract
C6075675 with Lewis & Tibbitts, Inc., to increase the contract amount by $100,000.
POLICY IMPLICATIONS
The approval of this contract amendment is consistent with existing policies
EXECUTIVE SUMMARY
On June 17, 1996, Council approved and authorized the Mayor to execute Amendment No. 1 to
contract C6075675 with Lewis & Tibbitts, Inc., to extend the performance period of the contract
through fiscal year 1996-97 and to increase the contract amount by $307,650.
At the time the amendment was drafted, it was believed that the contract amount used for fiscal
year 1995-96 ($307,650) would be sufficient for the 1996-97 fiscal year. Through February of
1997, there is approximately $50,000 in funding remaining on the contract and it has been
determined that approximately $150,000 in electric utility trench and substructure installation

work is required for the remainder of the fiscal year.
The construction required for the fiber optic network is the primary factor which created the need
for this contract amendment. The fiber optic network had not been included in the original
contract estimate since its approval occurredafter Amendment No. 1 of Contract C6075675 had
been executed. Substructure installation work for the fiber optic network has accounted for
approximately $50,000 in charges against the contract as of December 31, 1996. It is estimated
that there is an additional. $50,000 required in substructure work for the fiber optic network for
the remainder of the fiscal year.
This amendment will increase the contract amount by $100,000.
FISCAL IMPACT
Funds for this work are included in the 1996-97 Budget for the Electric Fund CIP, Major Project
Number 8928.
ENVIRONMENTAL ASSESSMENT
This project is categorically exempt from the provisions of CEQA and no further environmental
review is necessary.

BETWEEN THE CITY OF PALO ALTO AND
LEWIS & TIBBITTS, INC.~
This Amendment No. 2 to Contract No. C6075675 ("Contract")
is entered into , 1997, by and between the CITY OF
PALO ALTO, a chartered city and a municipal corporation of the
State of California ("CITY"), and LEWIS & TIBBITTS, INC., a
California corporation, located at 42700 Boyce Road, Fremont,
California 94538 ("CONTRACTOR").
RECITALS:
WHEREAS, the Contract was entered into between the
parties for the provision of trench and substructure installation
services; and
WHEREAS, the parties wish to amend the Contract;
NOW, THEREFORE, in consideration of the covenants, terms,
conditions, and provisions of this Amendment, the parties agree:
follows:
SECTION i. Section 2 is hereby amended to read as
"Pursuant to Section 1 of Contract No.
C6075675, the Base Contract amount of FY 1996-
97 shall be $407,650 for a total contract
price of $715,300."
SECTION 2. Except as herein modified, all other
provisions of the Contract, including any exhibits and subsequent
amendments thereto, shall remain in full force and effect.
