HomeMy WebLinkAbout1997-03-24 City Council (16)City of Palo Alto City Manager’s Report TO:HONORABLE CITY COUNCIL ATTENTION: FINANCE COMMITTEE FROM:CITY MANAGER DEPARTMENT: ADMINISTRATIVE SERVICES AGENDA DATE: MARCH 24, 1997 CMR:181:97 ~CT:VACATION OF STREET RIGHTS-OF-WAY AND PUBLIC UTILITIES EASEMENT - PALO ALTO MEDICAL FOUNDA- TION URBAN LANE SITE REQUEST: This report requests that Council 1) adopt the attached Resolution ordering vacation of street fights-of-way and a public utilities easement on the Palo Alto Medical Foundation (PAMF) development site; and 2) authorize the Mayor to sign the attached deed granting property to PAMF. RECOMMENDATIONS: Staff recommends that Council: 1)Make the following findings: The project will have no significant effect on the environment, as shown in the Environmental Impact Report which the City Council approved on January 29, 1996; and The streets and public utilities easement are not necessary for present or prospective public use, in that: The proposed project includes dedication of new public rights-of-way and easements as necessary to serve the project and properties in the vicinity; and CMR:181:97 Page 1 of $ 2) ii.The Environmental Impact Report prepared for the project concludes that replacement of the existing street pattern with the proposed new public streets, including the extension of Urban Lane, would improve circulation in the vicinity of the project site, which would benefit the general public. Adopt the attached Resolution ordering the vacation of street fights-of-way and a public utilities easement on the Palo Alto Medical Foundation (PAMF) development site; and 3)Authorize the Mayor to sign the attached deed granting property to PAMF. POLICy...IMPLICATIONS: The attached resolution and deed do not represent any changes to existing City policy. EXECUTIVE SUMMARY: The PAMF is requesting City approval of a proposed new medical clinic and research facility on a 9.2 acre site located on E1 Camino Real between the Holiday Inn and the Town and Country Village Shopping Center (see Attachment A, location map.) The 9.2 acre PAMF- owned site consists of 13 separate parcels, mostly vacant, that PAMF proposes to merge into one parcel via the subdivision process. The project will result in changes in traffic circulation and relocation of existing utilities at the proposed campus site and in the immediate vicinity. Therefore, PAMF has requested that the City vacate certain street fights- of-way and a public utilities easement which currently exist on the site. The streets to be vacated are a portion of Homer Avenue west of the railroad tracks and portions of Urban Lane that connect to Homer Avenue. These streets and a public utilities easement to be vacated are shown on the attached map.(Attachment B). The City owns Urban Lane and most of the Homer Avenue right-of-way to be vacated. The City has an easement for a 10- foot ship of Homer Avenue and for the public utilities easement. PAMF is the owner of the land fights underlying the City’s easements. PAMF has requested City approval of numerous applications related to the development of its proposed new campus, including a tentative subdivision map to assemble the 13 parcels into one parcel and to establish necessary new streets and other public dedications and easements. With the exception of the tentative subdivision map, these applications were reviewed and approved by Council on January 29, 1996. The Council also adopted a Resolution of Intention (No. 7572) to vacate public street and utilities easements on the PAMF development site and set a public hearing for February 20, 1996. The February 20, 1996.public hearing date was continued, due to the withdrawal of the tentative subdivision CMR:181:97 Page 2 of $ map which was to be submitted for Council review at the same time as the easement vacation. The tentative subdivision map has now been resubmitted and is ready for review by the City Council, prior to this item on the same agenda. Due to the length of time that has passed since the continuance of the February 20, 1996 date, staff has renoticed the public hearing for the easement vacation by publication, as well as posting. PROPOSED VACATION OF STREETS AND PUBLIC UTILITIES EASEMENT In order for the City to vacate street rights-of-way and public utilities easements, the City Council must fred that they are not necessary for present or prospective public use. Streets The street rights-of-way to be vacated are no longer necessary for present or prospective use for a number of reasons. With the approval of the tentative subdivision map and subsequent recordation of a final map, the existing thirteen individual parcels will be merged and there will be no parcels requiring access from the portions of Homer Avenue and Urban Lane, which are to be vacated. In addition, the subdivision map process will establish new street rights-of-way and public access easements. Because these new easements and streets are proposed to be dedicated and constructed in conjunction with the project, the existing streets are no longer necessary. These new rights-of-way and access easements and the resulting changes in circulation were reviewed and approved by the Council on January 29, 1996. Moreover, the project Environmental Impact Report (approved by Council on January 29, 1996) indicates that the proposed Urban .Lane extension, which must be constructed as a condition of project development, will improve circulation in the vicinity of the project. Public Utilities Easement Existing utilities to be vacated consist of underground water, gas and wastewater lines. These utilities will be relocated as a result of the PAMF project and will no longer be necessary for present or prospective public use. The relocation of existing utilities and construction of any new utilities required as a result of the project will be done at PAtMF expense and to the satisfaction of the Utilities Department, as a condition of the project approval. A condition of both the development project and this easement vacation is that PAMF grant or dedicate all required new utility easements. RESOLUTION ORDERING VACATION To vacate the Homer Avenue and Urban Lane street fights-of-way and the public utilities easement, the California Streets and Highways code~ requires that, following Council adoption of a Resolution of Intent to Vacate, Council approve a Resolution Ordering Vacation after considering the evidence offered at the public hearing. Staff recommends approval of the attached Resolution Ordering the Vacation of Public Street and Utilities Easements on the PAMF Development Site at 795 E1 Camino Real, which includes the condition that PAMF grant the City the necessary ingress/egress, street and utility easements CMR:181:97 Page 3 of ~ as shown on the tentative subdivision map reviewed by the Council prior to this item on the same agenda. GRANT DEED The attached deed, by which the City would grant the City-owned portions of Homer Avenue and Urban Lane to PAMF, will be executed by the City only after PAMF has granted the City all necessary new streets and utilities easements, as shown on the tentative subdivision map approvedby the City Council for the PAMF project, and as requested by conditions of the tentative subdivision map approval. FISCAL IMPACT: None. ENVIRONMENTAL IMPACT ASSESSMENT: On January 29, 1996, Council adopted Resolution No. 7569, finding that the EIR for the project was prepared consistent with the requirements of the California Environmental Quality Act and adequately analyzes the potential impacts of the project and related mitigation measures. C.As identified in the EIR, replacement of the existing street pattern with the proposed new public streets, including extension of Urban Lane, will improve circulation in the vicinity of the Project site, resulting in benefit to the public. The City Council, under the authority of City Policy and Procedure 1-13 and California Streets and Highways Code Section 8320 et seq., hereby orders that the streets and public utilities easements, as depicted on the attached Exhibit "A," and as more particularly described in Exhibit "B" and shown on Exhibit ~C" be vacated. 8.ECTION 3. The vacation ordered under Section 2 hereof is expressly conditioned as follows: The vacation will occur only after PAMF has granted the City all necessary new streets and easements as shown on the tentative subdivision map approved by the City Council for the PAMF project, and as required by conditions of the tentative subdivision map approval.
