SUBJECT:SUMMARY VACATION OF PUBLIC UTILITIES EASEMENT
AT 160/162/164 WAVERLEY STREET
REQUEST
This report requests Council’s approval of a Resolution Ordering the Summary Vacation of
a Public Utilities Easement located at 106/162/164 Waverley Street, Palo Alto.
RECOMMENDATIONS
Staff recommends that Council authorize the May’or to sign the attached Resolution Ordering
the Summary Vacation of a Public Utilities Easement located at 160/162/164 Waverley
Street, Palo Alto.
POLICY IMPLICATIONS
The Resolution does not represent any change to existing policies.
EXECUTIVE SUMMARY
The electrical pole within the easement was replaced due to its deteriorated condition and
relocated for better accessability. As a result of this relocation, the Utilities Department no
longer needs this portion of the easement and has requested that the City vacate 55 feet of
the existing 185-foot Public Utilities Easement (PUE). There are no other City utilities
located within the portion to be vacated, and it is not necessary for any present or anticipated
future public use. The easement vacation processing fee of $1,200, as set forth in the
Municipal Fee Schedule, has been paid.

FISCAL IMPACT
There is no financial impact.
ENVIRONMENTAL ASSESSMENT
These projects are categorically exempt from the requirements of the California
Environmental Quality Act; therefore, no environmental impact assessment is necessary.

RESOLUTION NO.
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ORDERING
THE SUMMARY VACATION OF A PUBLIC UTILITIES EASEMENT
AT 160,162,164 WAVERLEY STREET
WHEREAS, fifty-five (55) foot of the one hundred eighty-five (185) foot
public utilities easement located at 160,162,164 Waverley Street in Palo Alto
is excess right-of-way and not necessary for future public use; and
WHEREAS, from all evidence submitted to the Council of the City of Palo Alto
it is found that fifty-five (55) foot of the one hundred eight-five (185)
foot long said public utilities easement as described herein is not
necessary for present or prospective public use for public utility purposes;
and
WHEREAS, it is the intent of the Council of the City of Palo Alto to vacate
fifty-five (55) foot of the one hundred eighty-five (185) foot of the public
utilities easement recorded in Book 4400, Page 552, as instrument No.
1624400, in-the County of Santa Clara, State of California; and
WHEREAS, the Council ~of the City of Palo Alto intends to vacate such excess
public utilities easement according to the procedures set forth in the
California Streets and Highways Code Division 9, Part 3, Chapter 4 (Section
8334 et seq.) ;
NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows:
SECTION I. This vacation is made under the authority of California Streets
and Highways Code Chapter 4 of Part 3 of Division 9, commencing at section
8330.
SECTION 2. The excess fifty-five (55) foot of the one hundred eighty-five
(185) foot long public utilities easement located at 160,162,164 Waverley
Street in Palo Alto is hereby vacated. Said easement is more particularly
described in Exhibit A and shown in Exhibit B, which Exhibits are attached
hereto and incorporated herein by this reference.
SECTION 3. The Council finds that said fifty-five (55) foot of one hundred
eighty-five foot long easement is excess and is not necessary for future
public use.
SECTION 4. This Council finds that this project is categorically exempt from
the requirements of the California Environmental Quality Act and no
environmental impact assessment is necessary.
SECTION 5. The City Clerk, acting through the Real Property Manager shall
cause a certified copy of this resolution attested by the City Clerk under
seal to be recorded in the Office of the County Recorder of Santa Clara.
SECTION 6. From and after the date of recordation of this resolution, said
easement shall be considered vacated.
