Staff recommends that Council: Approve and authorize the Mayor to execute the proposed Amendment No. 7, to Agreement No. 2876, attached to this report, on behalf of the City, POLICY IMPLICATIONS The approval of this contract is consistent with existing policies. EXEC~ SUMMARY The City of Palo Alto has a longstanding agreement to transport and treat sewage for the town of Los Altos Hills. Agreement No. 2876 established the area within Los Alto Hills CMR:128:97 Page 1 of 3 to be served by the Palo Alto sewer system and granted to Los Altos Hills the right to connect to the Palo Alto system at certain specified points. No other connections to Palo Alto trunk sewer lines are permitted except by written amendment to the agreement. Six Agreement Amendments providing for additional connection points have been approved to date. PROPOSED AMENDMENT NO, 7 Proposed Amendment No. 7 authorizes an additional point of connection into the Page Mill Road trunk sewer at Story Hill Lane. This connection will serve an area of 2.27 acres subdivided into 2 proposed residential lots with an ultimate possible 18 residential lots. The area covered by this amendment is within the service area of the original agreement and the Palo Alto system was designed with capacity to accommodate the potential flow. The addition of sewer connections for eighteen residential lots to Palo Alto’s Sanitary Sewer System will.not have a significant impact on Palo Alto’s collection system. Palo Alto is obligated to provide Los Altos Hills with sewer service by agreement. The area to be served by the proposed sewer connection is within the service area ofPalo Alto’s original agreement with Los Altos Hills. Los Altos Hills is now below its allocated share of the treatment capacity of the Palo Alto System, which was. designed with capacity to accommodate the potential flow of Los Altos Hills. Los Altos Hills capacity rights are now 0.6 million gallons per day (mgd). Currently, the actual flow for Los Altos Hills is 0.2 mgd. The connections from two additional single family, and possibly eighteen lots, will not have significant impact on the capacity of the existing system and will result only in the minor disruption of soil during installation, which can be repaired. ENVIRONMENTAL ASSESSMENT The Town of Los Altos Hills is the lead agency for the project and, consistent with CEQA Guidelines, has prepared a Mitigated Negative Declaration for the project (copy attached, Exhibit C). The mitigations include hand digging of the trench near oak trees, additional planting to be determined and fencing of significant trees during construction. City staff has reviewed the environmental documentation and finds it acceptable. City Council should consider the Mitigated Negative Declaration in making its decision on the project. WITNESETH: WHEREAS, Palo Alto and Los Altos Hills entered into a Joint Use Agreement on March 18, 1968, covering the transportation, treatment and disposal by Palo Alto of sewage emanating within a portion of the territorial limits of Los Altos Hills; and, WHEREAS, Palo Alto andLos Altos Hills wish to supplement this Agreement to authorize connection of and service of the Lands of Shideler at 27994 Via Ventana. Way in Los Altos Hills and to authorize connection to the Palo Alto Sewer line at the most westerly sanitary sewer manhole located on theproperty at 28138 Storyhill Lane in Los Altos Hills and construction of a main in said location. NOW, THEREFORE, in consideration of their mutual covenants, the parties hereto agree as follows: 1.SCOPE OF AMENDMENT. Pursuant to Section 1 of Agreement No. 2876 dated March 18, 1968, the Agreement between the parties hereto is hereby amended as follows: a.Los Altos Hills is hereby authorized to connect to Palo Alto’s trunk sewer line at the point indicated on F, ddlihil_K, which Exhibit is attached hereto and incorporated herein by this reference, for the purpose of serving the Lands of Shideler. b.Los Altos Hills is hereby authorized to connect to the Palo Alto Sewer in said location to serve the properties shown as the Shideler property on Exhibit K and other such properties within Los Altos Hills shown as the adjacent service area on i~lhihiI_K. Any lines constructed shall be the property of Los Altos Hills, and an encroachment permit therefor, pursuant to Chapter 12.12 of the Palo Alto Municipal Code, shall be obtained by Los Altos Hills. All costs of construction shall be paid by Los Altos Hills or the developer of property served thereby. 2.Except as herein modified, all other provisions of said Agreement No. 2876 shall remain in full force and effect. Williams, Plmming Director TOWN OF LOS ALTOS HILLS Date INITIAL STUDY EXHIBIT C LANDS O1= SHIDELER l=ile #13-95-ZP-SD-GD 27994 Via Ventana Los Altos Hills, California 94022 PRO~CT DES~ON The applicant proposes to construct a sewer main extension from a City of Palo Alto line to serve a property in the Town of Los Altos Hills that win have a new residence constructed on it. Wiih this expansion, there .will be potential for other single family residential properties to connec~ to the sewer main in the future. An adjacent lot at 27886 Via Ventana will cormec~ at the same time the applicant’s property is connected. PRO~CT LOCATION The applicant’s property is a 2.27 acre parcel (Assessor’s Parcel Number 18242-047) located on the south side of Via Ventana at Page Mill Road. The project site is bounded on all sides by properties intended for single family residential use. ~.NVIRONIVfENTAL SETTING The. subject property is presently undeveloped. A site development permit has been approved for a new 5,412 square foot single family residence, a three car attached garage and a single car detached garage. The site is accessed by a private ingress egress easement which intersects with Via Ventana near Page Mill Road,~ and again on upper Via Ventana. The site is wooded and contains a large number of oak trees. The hillside lot has an average slope of 28To. The property where the sewer main will originate is 28140 Story Hill Lane, which is already developed with a single family residence. An easement for the sewer line has alre~idy been secured. The area where the sewer line will be constructed goes through a detention basin and then a conservation easement (between the detention basin and Page Mill Road). Vegetation within the conservation easement consists of native grasses and scattered bushes and trees. POTENTIAL SIGNIFICANT EFFECTS This initial Study has been prepared in accordance with the California Environmental Quality Ac%. Information and conclusions in the Initial Study are based upon staf~ research and review of the application for site development permit to the Town of Los Altos Hills, which includes the sewer plan prepared by Civil £ngineers, Giuliani & Kull, Inc., dated July 29, 1996; and the Town’s General Plan and Municipal Code. Construction of the sewer main will disrupt site soils and topography. However, the topography will remain essentially the same since the line will be placed underground, and if necessary, planting will be done for erosion control in the area of construction. Water. Will the proposal result in: b.Changes in absorption rates, drainage patterns, or the rate and amount of surface runoff? . Construction of the sewer main may disrupt existing ground cover currently absorbs surface runoff. Planting will be done in any area where the native soil and ground cover are disturbed to minimize any change in the rate of absorption. Public Services. Will the proposal have an effect Upon or result in a need for new or altered governmental services in any of the £ollowing areas: "~ e. Maintenance of public facilities, including roads?¯ Utilities. Will the proposa_l result in a need for new systems, or substantial alterations to utilities? The new sewer main would require maintenance by the City of Palo Alto, and by the Town of Los Altos Hills within the Page Mill Road right-of-way. The new sewer main has the .potential to serve 18 single family residences, most of which are existing. Additional .landscaping may be required, depending on the disturbance that takes place wi~in the conservation easement.
