HomeMy WebLinkAbout1998-11-16 City Council (12)City of Palo Alto City Manager’s Report TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: ADMINISTRATIVE SERVICES DATE:NOVEMBER 16, 1998 CMR:435:98 SUBJECT:APPROVAL OF RESOLUTION PROCLAIMING TERMINATION OF A LOCAL EMERGENCY (EL NINO 98) THE RECOMMENDATION Staff recommends that the Council approve the attached resolution, which terminates the local emergency established on February-2, 1998. BACKGROUND On February 9, 1998, Council approved Resolution No. 7743 which ratified and confirmed the existence of a local emergency proclaimed by the City Manager on February 2, 1998. A Presidential Declaration of Emergency for Palo Alto and other Bay Area cities also occurred in February 1998. The City has filed a claim with the Federal Emergency Management Agency (FEMA) and the State Office of Emergency Services (OES) for the reimbursement of costs related to flood damage repairs and the incremental costs incurred by the City for emergency response. The City’s claim is currently being processed by FEMA and OES. DISCUSSION In emergency situations, the City Manager is authorized to expend City funds without limitation by way of amount and without the requirement for either formal bids or informal quotations (Palo Alto Municipal Code Chapter 2.30.090). Expenditures made during an CMR:435:98 Page 1 of 2 emergency must be reported to the Council, if such expenditures would otherwise have been made by the Council. The City Manager has entered into contract agreements that would normally have been made by the Council, in order to expeditiously address damage to City facilities and property (e.g., erosion of roadways) and so that the repairs would be complete within the time frame required by FEMA and OES. (The repairs must be completed within eighteen months of the Presidential Declaration of Emergency to be eligible for reimbursement from FEMA and OES.) All emergency contracting has now been completed. The final staff report regarding staff use of the City Manager’s emergency contract authority was provided to the Council on October 26, 1998 (CMR:410:98). Further, the weather conditions that led to the declaration of an emergency no longer exist. As a result, staff is recommending that the Council approve the attached resolution, which terminates the local emergency established on February 2, 1998. RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO PROCLAIMING THE TERMINATION OF A LOCAL EMERGENCY (EL NINO 98) WHEREAS, pursuant to Resolution No. 7743, adopted February 9, 1998, the City Council ratified and confirmed the proclamation of existence of a local emergency issued by the Director of Emergency Services (City Manager June Fleming) on February 2, 1998 under the authority of Chapter 2.12 of the Palo Alto Municipal Code; and WHEREAS, pursuant to Section 8630 of the California Government Code, the City Council shal! proclaim the termination of a local emergency at the earliest possible date that condigions warrant; and WHEREAS, the Director of Emergency Services has advised the Council that conditions now warrant the termination of the local emergency. NOW, THEREFORE; The Council of the City of Palo Alto does RESOLVE as follows:- SECTION i. The Council finds that the local emergency ratified by Resolution No. 7743 no longer exists and proclaims that such local-emergency is terminated.
