HomeMy WebLinkAbout1998-09-22 City Council (15)City of Palo Alto C ty Manager’s Repor TO: FROM: HONORABLE CITY COUNCIL CITY MANAGER DEPARTMENT: PLANNING AND COMMUNITY ENVIRONMENT DATE:SEPTEMBER 22, 1998 CMR:370:98 SUBJECT:425-435 SHERIDAN AVENUE, 440-460 PAGE MILL ROAD: APPLICATION BY BK LTD, PALO ALTO, LLC FOR CITY COUNCIL APPROVAL OF A FINAL SUBDIVISION MAP TO MERGE AND RESUBDIVIDE A 1.06-ACRE PARCEL INTO 35 AIR SPACE CONDOMINIUMS, 97-SUB-I, 97’EIA-10 RECOMMENDATION Staff recommends that the City Council approve the attached final subdivision map. PROJECT DESCRIPTION The applicant has submitted an application for a final map to merge underlying lots and subdivide the resultant 1.06-acre parcel into 35 air space condominiums. The condominiums would be accessed from a main entry on Sheridan Avenue and a second entry on Page Mill Road. BACKGROUND On January 20, 1998, the City Council approved the application for a tentative map for the project. On August 17, 1998, the current final map application was submitted by the applicant for merger of the underlying four lots and subdivision of the subject site into 35 air space condominiums. The final map has been reviewed and determined to be complete by City staff. SUMMARY OF SIGNIFICANT ISSUES The .tentative map was approved with 21 conditions, which in summary include the preparation of a final map, design and installation of public improvements, and dedication often feet of right of way for a future right turn lane along Page Mill Road. The applicant was also required to enter into a subdivision agreement with the City of Palo Alto, agreeing that all improvements required for the subdivision will be installed and posting a bond to guarantee that agreement. The subdivision agreement also includes reservation of three CMR:370:98 Page 1 of 3 Below Market Rate (BMR) housing units and sets forth the terms of the BMR program as it applies to these units. All of the conditions imposed on the tentative subdivision map have been met. Both the State Subdivision Map Act and the Palo Alto Subdivision Ordinance require that a final subdivision map be approved prior to recordation of the subdivision. Staff recommends that the City Council approve the applicant’s request for a final subdivision map. RESOURCE IMPACT None. POLICY IMPLICATIONS Policy implications of this project were addressed at the tentative Subdivision map stage of this project. ALTERNATIVES 1. Find that the final map does not conform to the approved tentative map or the Palo Alto subdivision ordinance and deny the final map; or 2.Continue the matter for not more than one regular meeting. TIMELINE Following Council approval of the final map, the map will be recorded. recordation, the applicant then may apply for building permits.. Following ENVIRONMENTAL REVIEW A Mitigated Negative Declaration was approved by City Council in conjunction with the approval of the tentative map.
