TRANSPORTATION DEVELOPMENT ACT (TDA) FUNDS
FOR BICYCLE AND PEDESTRIAN IMPROVEMENT
PROJECTS
REPORT IN BRIEF
Annually in January, the Metropolitan Transportation Colmnission (MTC) accepts
grant applications for Transportation Development Act (TDA) Article 3 funds for
bicycle and pedestrian improvement projects for the upcoming fiscal year.
Palo Alto is eligible to claim the City’s pro rata share ($20,435) of the TDA funds
allocated directly to local agencies and to compete for approximately $523,237 in
countywide discretionary fimds that are available for projects of special merit.
This year, staff is recommending that the City submit TDA applications for four
projects, including three new grant proposals totaling $80,435, and reallocation of an
existing TDA grant that will expire at the end of the fiscal year: (1) the Bicycle Plan
and New Bicycle Routes Map ($20,345); (2) San Mateo Drive/Sand Hill and
Willow/Waverley bicycle bridge replacement projects ($20,000); (3) construction
phase of the Arastradero Road Bike Lane hnprovements project ($40,000); and (4)
rescission/reallocation of an existing TDA grant for the Embarcadero Bridge and Bike
Path Extension Project ($95,510) to preserve funding beyond the expiration date of
June 1998.
Applications must be submitted by January 16 concurrently to the Santa Clara Valley
Transportation Authority (VTA) mad the Metropolitan Transportation Commission. At
the County level, tlie project proposals will be reviewed by the County Bicycle
Advisory Committee and VTA staff. A priority list of projects will be developed for
review and approval of the VTA Board of Directors. The countywide priority list will
be forward to the MTC for approval.

RECOMMENDATION
It is recommended that Council authorize staff tO submit TDA grant application
documents for the 1998-99 fiscal year for the following projects:~

BACKGROUND
All cities in the County have the opportunity to apply for State TDA Article 3 funds for
bicycle and pedestrian projects in January for funds that are allocated in the upcoming
fiscal year. Applications must be submitted by January 16 concurrently to the Santa
Clara Valley Transportation Authority (VTA) and the Metropolitan Transportation
Commission. At the County level, the project proposals will be reviewed by the
County Bicycle Advisory Committee and VTA staff. A priority list of projects will be
developed for review and approval of the VTA Board of Directors, whose
recommendations will be forward to the MTC for approval.
MTC staff’s prelhninary 1998/99 TDA funding estianate for Santa Clara County, based
on California Department of Finance projections, is $1,590,600. Under the priority
setting guidelines for the TDA project proposals adopted by the VTA, 70 percent of
the available funds ($1,067,273) will be assigned to the "Guarantee Fund," to be
distributed to local jurisdictions on a population-based apportioimaent formula. Palo
Alto’s guaranteed amount is $40,345 based on the City’s 3.62 percent of the County
population. The remaining 30 percent of the funds ($523,327) will be reserved in the
"Discretionary Fund" to be allocated on a countywide competitive basis according to
project merit. The VTA review criteria will continue to emphasize projects that
enhance safety, are multi-purpose, fill in missing links, and/or mitigate safety problems.
Projects that stress these criteria will be positioned better to compete for discretional3r
funds.

DISCUSSION
This year staff is recommending that the City submit TDA applications for four ¯
projects: two applications to fully clafln guarantee funds ($20,345 in TDA guaranteed
funds for the Bicycle Plan mad New Bicycle Routes Map mad $20,000 in TDA
guarantee funds for San Mateo Drive/Sand Hill and Willow/Waverley bicycle bridge
replacement, projects); one application for discretionary funds ($40,000 in .discretionary
funds for the construction phase of the Arastradero .Road Bike Lane Improvements
project); and one request for rescission!reallocation of an existing grant project to
preserve funding beyond the expiration date of June 1998 ($95,510 for the
Embarcadero Bridge and Bike Path Extension Project).
Bicycle Plan and New Bicycle Route Map
The Metropolitan Transportation Commission requires that cities applying for TDA
funds have a detailed bicycle circulation element or plan in their general plan or adopt
a comprehensive bicycle plan in conformance with the requirements of the Streets and
Highways Code.
In 1996-97, a TDA application for funding of this project at a level of $40,000 was
submitted to the MTC and County as the second of three priority projects. However,
during the Cotmty review process, the City’s two other projects scored higher and were
fially funded, and this project received only partial funding of $22,423. Staff
recommends applying for approximately half of the City’s .guaranteed monies, or
$20,345, to restore the funding level needed to the level required to prepare a
comprehensive and complete plan and map.
This project has been delayed pending the review and adoption of the 1996-2010
Comprehensive Plan, in order to have the transportation and bicycle goals, policies and
programs in place before initiating this study. Transportation Program T-16 of the
Draft 1996-22010 Comprehensive Plan requires that Palo Alto "develop and
periodically update a comprehensive bicycle plan."
A bicycle plan is typically a separate document which is consistent with the
Transportation Element of the Comprehensive Plan, but describes in greater detail the.
existing bicycling enviromnent and conditions; city programs, services and policies to
promote bicycling; a bikeway master plan map; mad a complete set of action elements
recommended to improve the conditions to ensure that bicycling can continue to be a
viable, and safe transportation mode. The project will also result in the development
of a new, more detailed, educational mad informative multi-color bicycle routes map of
the existing bike routes in Palo Alto, and connections to routes in neighboring
jurisdictions. Several other local jurisdictions, including Santa Clara, Sunnyvale and

Milpitas, have recently developed and adopted bicycle plans and produced new high
quality bicycle route maps.
Arastradero Road Bike,,Lanes (CIP 19803)
This project involves the replacement of the existh~g sidewalk bike paths with on-street
bike lanes on Arastradero Road from just east of Gulm High School to Foothill
Expressway to improve bicycle cormnuting to Guma High School and to the Stanford
Research Park. The project will require widening of the roadway for approximately
300 feet in advance of the Arastradero/Miranda intersection, to accommodate the
installation of a westbotmd bike lane mad relocation of the right turn lane, landscaped
strip and sidewalk.
This project was included in the 1996-98 CIP budget, with funding of the design phase
programmed in 1997/98 and construction in 1998/99 subject to funding availability.
Palo Alto submitted and received TDA funds in 1997/98 for the full cost of the design
phase ($35,000). The estimated construction cost is estimated to be $150,000. The
Public Works Department anticipates construction will not occur until Summer 1999.
This would allow the City to request TDA funds over the next two years to apply
toward the total construction cost. Staff believes this project is a candidate for funding
with the discretionary fimds, since it will complete a missing link in the local bike lane
system, provide direct linkage to the longer bike lane network on the County
expressway, and enlaance safety for co~mnuter bicyclists.
Staff, therefore, recolmnends that the City submit an application for $40,000 in
discretionary TDA ftmds tlfis year, to be banked and added to another grant application
of $40,000 or more in 1999/2000.~ At minimum, the City would be entitled to
1999/2000 guaranteed funds and could seek additional discretionary funding for the
project to cover a larger proportion of the construction budget.
Replacement of sand Hill/San Mateo Drive and WiliowFWaverley Bicycle Bridges
This project involves the replacement of the Sand Hill/San Mateo Drive ,and Willow/
Waverley bicycle bridges over San Francisquito Creek between Palo Alto and Menlo
Park. The existingstructures, which were built in the mid-1970s, are in need of
significant rehabilitation. Menlo Park’s Engineering Department, which has primary
responsibility for maintenance of these structures, has determined that it would be more
cost-effective to replace the bridges rather than rehabilitate the existing structures, to
meet operational needs and reduce long term maintenance costs. Each of these bridges
attracts over 700-800 users per day.

The existing glulmn structures will be replaced with pre-fabricated steel structures
similar to the new Ahna Street bicycle bridge. The project will also include new bridge
lighting and improved approach paths. The projects will be undertaken by the City of
Menlo Park as lead agency. Menlo Park has obtained $160,000 in TDA grant funds
from San Mateo County for. the Sand Hill/San Mateo Drive bike bridge and has
submitted a 1998/99 TDA application for $180,000 the Willow/Waverley bike bridge.
A local match is needed for design and engineering costs, which would be funded
equally by Menlo Park and Palo Alto. This TDA application will fund Palo Alto’s
estimated $20,000 share of the local match requirement.
Embarcadero Bridge and Bike Path Extension
A TDA grant of $95,510 was awarded to Palo Alto FY 1995-96 for the construction
of this project. This grant, which is valid for tlu’ee years, will expire in June 1998.
The design of this project was completed in SpN~g 1996; however, the bidding process
resulted in bids that were over 50 percent higher than the engineer’s estimate and the
available .funding. Consequently, in August 1996, Council rejected the bids, and
directed staff to separate the path from the bridge project, and to pursue the path and
to seek alternative funding sources for the proposed bridge.
Recently, new issues related to the use of the railroad right-of-way have been raised by
the railroad engineers union, and are currently being reviewed and discussed with the
Caltrain Joint Powers Board (JPB) and Public Utilities Commission staff. Since this
project is on hold pending resolution of these matters, the City will not be in a position
to use the existing TDA grant funds by June 30, 1998 for construction of the project.
A complete report on the status of this project will be provided to Council at a later
date. At the present time, however, due to the pending TDA filing deadline, it is
necessary to take appropriate steps to preserve funding for the project. Staff
recorn_mends that the City make a formal request to have the existing grant reauthorized
for another three year period, through the process of rescinding the current grant and
having the ftmds reallocated to the stone project in 1998/99. This action must be taken
prior to the ftmding expiration date or the monies will revert to unallocated status with
the local transportation fund.
Palo Alto Bicycle Advisory_ Committee Review
As required by the MTC grant application policies, the TDA project proposals were
reviewed by the Palo Alto Bicycle Advisory Committee (PABAC) earlier this month.

The colrnnittee voted tmanhnous approval of the project priorities recolmnended in this
report. A memorm~dmn fi’om PABAC is included in the packet with the same agenda
number as this report.
RESOURCE IMPACT
Since TDA funds are disbursed on a reimbursement basis, if these grants are applied
for and secured, City funds would need to be appropriated for the project expenditures
and then reimbursed by TDA funds.
If discretionary funding is not approved for the Arastradero Road bike lanes project this
year, staff would propose to resubmit a funding request in 1999/2000.
POLICY IMPLICATIONS
The recormnended actions in this report are consistent with existing Comprehensive
Plan Transportation Policy 12: promote bicycle use; and TransportationProgram 33:
complete the Bikeway Master Plan.
TIMELINE
The TDA grant applications submitted by all of the jurisdictions in Santa Clara County
will be reviewed mad prioritized by the VTA staff and County Bicycle Advisory
Committee and referred to the VTA Board h~ the Spring. Their reco~mnendations will
be forwarded to the Metropolitan Transportation Comlnission for approval in June.
ENVIRONMENTAL REVIEW
This request for funds is not considered a project under the California Environmental
Quality Act; therefore, no enviromnental assessment is needed.at this time. However,
an enviromnental assessment has been prepared for the Arastradero Road Bike Lane
project pursuant to the provisions of CEQA with a Mitigated Negative Declaration
finding that the proposed project would not result in any significant environmental
impact. An environmental assessment was prepared for the Embarcadero Bridge and
Bike Path extension project with a Negative Declaration finding that the project would
not have any significant environmental impact. The City of Menlo Park, as lead
agency for the Sand Hill/San Mateo Drive bike bridge project, has determined that the
project is categorically exempt under Section 15302 of CEQA, in that the project
consists of replacement of an existing structure and will have substantially the same
purpose and capacity as the structure replaced.

RESOLUTION OF THE COUNCIL OF THECITY OF PALO ALTO
AUTHORIZING THE FILING OF A CLAIM WITH THE
METROPOLITAN TRANSPORTATION COMMISSION FOR
ALLOCATION OF TRANSPORTATION DEVELOPMENT ACT FUNDS
FOR FISCAL YEAR 1998-99
WHEREAS, the Transportation Development Act ("TDA"), as
amended (Public Utilities Code section 99200 et seq.), provides for
the disbursement of funds from the Local Transportation Fund of the
County of Santa Clara for use by eligible claimants for the purpose
of providing pedestrian and bicycle facilities; and
WHEREAS, pursuant to the provisions of the TDA, as amended,
and pursuant to the applicable rules and regulations thereunder (21
Cal. Code of Regulations section 6600 et seq.), a prospective
claimant wishing to receive an allocation from the Local
Transportation Fund shall file its claim ~with the Metropolitan
Transportation Commission; and
WHEREAS, the City of Palo Alto is an eligible claimant for
TDA funds pursuant to Public Utilities Code section 99234, as
expressed in the City of Palo Alto’s opinion of counsel, dated
January 7, 1998; and
WHEREAS, TDA funds from the Local Transportation Fund of
Santa Clara County will be required in fiscal year 1998-99 for the
purpose of improving pedestrian and bicycle facilities in Palo
Alto; and
WHEREAS, this claim is in accordance with the policy in the
Palo Alto Comprehensive Plan to promote bicycle use;
NOW, THEREFORE, the Council of the City of Palo Alto does
hereby RESOLVE as follows:
SECTION i. The Council hereby approves and authorizes the
City,Manager to execute and file an appropriate claim, together
with all necessary supporting documents, with the Metropolitan
Transportation Commission for an allocation of One Hundred Seventy
Five Thousand Eight Hundred Fifty-Five Dollars ($175,855) in TDA
funds in fiscal year 1998-99 for the purpose of providing the
.following pedestrian and bicycle projects in Palo Alto:

SUBJECT:Call for Projects, TDA Article 3’FY 1998/99 Program
TDA Article 3 Funds Available
MTC has issued the initial TDA Article 3 Fund estimate for Santa Clara County. A chart
detailing each member agency’s "Guarantee" share, based on 1997 California Department
of Finance (DOF) population projections is attached. Seventy percent (70%) of this
),ear’s projected allocation is guaranteed to jurisdictions based on population. The
attached worksheet details each jurisdiction’s guarantee amount and any adjustments that
have been made to date.
The figure in the Adjusted Guarantee Amount column is ),our jurisdiction’s guarantee
amount for FY 1998/1999. Any future adjustments to the county’s overall projected fund
estimate may result in changes to the amount of funds available for discretionary projects.
However, based on adopted VTA policy, the guarantee amounts will remain constant.
Approximately $523,327 will be available to fund discretionary projects this year.
Project EligibiliD’ and Scoring Criteria
The VTA Board of Directors approved local criteria for establishing project priorities for
the TDA Article 3 Bicycle and Pedestrian Program at its August 7, 1997 meeting. These
criteria are attached.
When preparing project applications, please remember:
TDA funding guidelines require that cities and counties establish bicycle advisory
committees (BAC) and adopt comprehensive bicycle plans to be eligible for funds
for bicycle projects. This requirement does not apply to pedestrian only projects.
There are several jurisdictions that are in various stages of preparing bicycle
plans. MTC may waive the plan requirement if a jurisdiction can demonstrat~
progress toward completion of a plan for this year’s cycle. If you have recently
completed a plan or wish to demonstrate progress and have the requirement

waived, please let me know by January 16, 1998. Please mail a copy of your
current bike plan to me.
Project submittals should include any rescind/reallocation requests for projects
allocated in FY 1994/95 and expiring on June 30, 1998, or projects that have a
change in workscope. It is the responsibility of applicants to monitor project
expiration deadlines and to apply for rescind/reallocation of funds in a timely
manner. Failure to do so may result in losing these funds.
Claimants who have received disbursements or obligated Article 3 funds during
FY 1996/97 must submit a certified fiscal audit to MTC and the State Controller
by December 31, 1997. Claimants who did not receive or obligate Article 3 funds
during FY 1996/97 are required to submit a letter to MTC stating that no expenses
were incurred. These documents must be received by MTC prior to the allocation
of FY 1998/99 TDA funds.
Additional information on the TDA Article 3 procedures and criteria can be found
in the MTC Fund Application Manual or in Attachment A of MTC Resolution .

Copies of MTC’s Procedures and Project Evaluation Criteria and Bicycle Plan
Requirements are attached for your information. Also attached is the most recent status
of city and County compliance prepared by the VTA Planning and Development office.
If this information should be updated, please notify me as soon as possible.
Evaluation Process
Guarantee project applications will be reviewed by CMP staff for eligibility,
completeness, and compliance. Discretionary projects wilt be evaluated and ranked by a
Scoring Taskforce which has been selected by the Technical Advisory Committee (TAC).
The resulting Discretionary project priorities will be reviewed by the Capital
Improvement Subcommittee (C!P), the Bicycle Advisory Committee (BAC), the ,
Citizen’s Advisory Committee (CAC), the Technical Advisory Committee (TAC), the
Policy Advisory Committee (CAC) and adopted by the VTA Board of Directors in their
April 1998 meeting. Adopted .project priorities will be forwarded to MTC in April, 1998.

One copy of each completed project application should be submitted to VTA/CMP by

The following policies were adopted by the VTA Board of Directors on August 7, 1997.
The TDA Article 3 Bicycle and Pedestrian Program shall emphasize projects that enhance
safety, are multi-purpose, provide a missing link, implement the Countywide Bicycle
System and!or City General Plans and/or City Bicycle Plans and. mitigate traffic problems.
2.The annual allocation of TDA Article 3 funds shall be as follows:
¯Seventy percent of the annual allocation shall be guaranteed to Member Agencies based
on population.
¯Thirty percent of the funds shall be allocated to projects in competitive process based on
program policies.
3.Inter-jurisdictional projects wilt be encouraged.
A Member Agency is assured no more and no less than its Guarantee amount in a single
fiscal year. If a Member Agency submits a request for more than that Guarantee amount,
the project will compete for additional Discretionary Funds on the merits of the entire
project. If the project is unsuccessful in obtaining Discretionary Funds, the project sponsor
may "bank" Guarantee Funds for future project implementation.
St Local Guarantee Fund targets will be published at the time of the official call for projects.
Guarantee Fund targets are projections, there are sometimes gaps between the projected and
actual fund amount available to Member Agencies. Should the "actual" amount be lower
than the "projected amount", the first call on Discretionary Funds will be to cover the
funding gap. Conversely, should the "actual" amount be more than the "projected" amount,
the overage shall go to the Discretionary Fund and be available for competitive projects.
Guarantee Funds may be transferred between cooperating Member Agencies.
Member Agencies may bank Guarantee Funds for Up to 3 years for large projects that meet
program policies. However, a Member Agency must identify a project and a project budget
to justify the banking of funds after denial of Discretionary funding, but prior to submission
of the prioritized list to the Metropolitan Transportation Commissiolx
Large projects that meet program policies and have a phasing plan may be funded in phases
or segments in order to accommodate construction over several funding years. Projects will
compete for Discretionary funding in each phase based on the merits of the entire project..
However, the award of Discretionary Funds in one.cycle does not guarantee award of
Discretionary Funds in the next.

A project sponsor may make minor changes in project scope that does not impact the intent
or delivery schedule of the project.
The RescindFReallocate process shall be:
(A)A Member Agency may rescind a Guarantee Fund project and reallocate these funds to
any eligible project(s).
(B)Unless reallocated to the same project, unused Discretionary Funds will revert to the
Discretionary Fund for reallocation on a competitive basis in the next cycle.
