HomeMy WebLinkAboutStaff Report 182-09TO: HONORABLE CITY COUNCIL ATTN: FINANCE COMMITTEE FROM: DATE: MARCH 31, 2009 SUBJECT: Adoption of a Resolution Adopting a Refuse Rate Increase and Amending Utility Rate Schedules R-1, R-2, and R-3 BUDGET FY 2010 — FY 2011 CITY MANAGER DEPARTMENT: PUBLIC WORKS RECOMMENDATION CMR: 182:09 Staff requests that the Finance Committee recommend that the City Council adopt the attached resolution to: (a) Approve a 17 percent refuse rate increase for Fiscal Year (FY) 2009-10, effective July 1, 2009; and (b) Approve the changes to the Refuse Rate Schedules, as attached. BACKGROUND The last rate increase applied across the Refuse Fund Utility Rate Schedule (R series) occurred in June 2008 (CMR:165:08). At that time, Council approved an increase to Refuse Fund rates of 10 percent or $2.5 million in revenue annually. The rate increase was needed to fund costs related to relocation of landfill facilities, Zero Waste implementation, Los Altos Treatment Plant site development and to maintain the Council -adopted Refuse Fund Reserve. DISCUSSION In the past year, the Refuse Fund has had productive and challenging events that have resulted in increased financial obligations as well as decreased revenues. Consequently, staff is proposing a 17 percent rate increase that would net $4.4 million in additional annual revenue to support the following: • A new $14.1 million waste collection and hauling agreement with GreenWaste of Palo Alto that includes the Zero Waste Operational Plan programs to begin July 1, 2009 (CMR:416:08); • The City's current utility billing system began conversion to an SAP -based billing system resulting in additional expense to the refuse fund ($400,000); • The SMaRT Station retooling project expenses increased due to delays caused from additional disposal cost, unexpected modifications to and verification of specification standards of the equipment ($219,000); and CMR:182:09 Page 1 of 5 • The method for capping the landfill after closure has changed due to changes in State regulations and the lack of available clay material resulting in higher closure and post - closure costs ($3.7 Million). Zero Waste Operation Plan One of the top ten waste prevention priorities identified in the ZWOP was to "create incentives to encourage businesses and residents to reduce the total amount of material (e.g. garbage, recycling, and landscape trimmings) placed at the curb/in their bin that needs to be managed." Also, at last year's Finance Committee meeting when refuse rates were discussed (242:08), Council asked to see ways in which the refuse rate structure might be structured to encourage waste reduction. Proposition 218 requires that revenue generated from property -related fees may not exceed the funds required to provide the property -related service. In the coming year, staff plans to prepare a cost analysis to determine whether rates are adequately recovering costs and are being set with sufficient attention to establishing zero waste incentives as identified in the Zero Waste Operational Plan approved by Council. For FY 2009-10, rates are proposed to be charged by the gallon for can service and to apply a 17 percent rate increase across the board for bin service. The standard can service is one 32 gallon can that would be charged at $31.00 monthly. Each can size above the standard would be charged at a rate of $1.00 per gallon. For those customers utilizing the mini -can (20 gallon can), a 28 percent discount off the standard rate would be applied as an incentive to generate less waste. In the commercial sector, organics (yard waste and other compostable) collection is being expanded. Currently, three carts are provided at no additional cost for compostable collection. Beginning July 1, 2009, a charge of $20 per 32 -gallon cart will be applied for collection above the current service level of three cans. Although it appears that Palo Alto's proposed rate is at the high - end of the spectrum, Palo Alto provides more service by the Refuse Fund than do other jurisdictions which makes it difficult to equally compare the service levels. Palo Alto's premium services include weekly street sweeping, optional backyard collection, monthly household hazardous waste collection, extensive recycling collection and waste diversion services and CMR:182:09 Page 2 of 5 landfill and composting operations. The following chart identifies Palo Alto's proposed rates for 2009-2010 compared with the current rates from neighboring cities. Current Single Family Rates From Surrounding Jurisdictions Current rate (FY 2008-09) for one 32 -gallon can refuse service Jurisdiction Los Altos Hills $33.76 Palo Alto $31.00 (with 17% increase) Los Altos $28.11 San Jose $26.95 Sunnyvale $25.31 Cupertino $19.89 Santa Clara $17.05 Mountain View $16.10 Average rate $24.77 Landfill Closure and Post -Closure Care State and Federal laws and regulations require the City to place a final cover on the remaining open areas of the landfill when it stops accepting waste and to perform certain maintenance and monitoring functions at the site for thirty years after closure. Closure costs of $1.6 million were reported in fiscal 1991-92, when a section of the refuse area (Phase I) was capped with a final cover and Byxbee Park was constructed on top of that section. A second section of the refuse area (Phase IIA) was capped with a final cover during fiscal year 1992-93 with closure costs of $0.9 million and a third section (Phase IIB) was capped during fiscal year 2000-01 at a cost of $1.2 million. The remaining closure and post -closure maintenance care costs are expected to be paid after the date that the landfill stops accepting waste. An updated cost estimate for the landfill closure and post -closure maintenance, based on landfill capacity, was performed during Fiscal Year 2009. Closure and post -closure costs have increased from the previous estimates due to newly -added regulatory compliance regulations and additional costs to find alternate cap material to replace clay soil which is no longer found locally. The landfill closure and post -closure maintenance costs for Fiscal Years 2008 and 2009 was $7.9 million and $11.2 million, respectively. Current capacity estimates for Fiscal Year 2009 are 98 percent used. Based on this percentage, the $11 million is expected to be recorded as future landfill closure and post -closure cost. The remaining section of the landfill to be closed (Phase IIC) is expected to be completely filled in late 2010 or early 2011. The Phase IIC cap will be constructed in 2012. Actual closure and post -closure care costs may be higher due to inflation variances, changes in technology, or changes in State or Federal regulations. The City is required by State and Federal laws and regulations to make annual funding contributions to finance closure and post -closure care. The City expects to be in compliance with these requirements for the year ended June 30, 2009 with the establishment of the fully - funded cost for this purpose. CMR:182:09 Page 3 of 5 RESOURCE IMPACT A 17 percent refuse rate increase for FY 2009-10 will increase annual revenues by $4.4 million and will generate $35.2 million to the Refuse Fund. According to the Refuse Fund 10 -year forecast, expenses could be as high as $36.2 million in FY 2009-10. Accounting practices require that the City record the full cost of 30 years of post -closure maintenance in the budget, however, no funds for post -closure funding of the landfill will be needed until 2013. There is currently $7.8 million available in the Refuse Fund Reserve (RSR) and closure costs will be approximately $6.8 million. By recording this cost now, it appears that the RSR is in a deficit of $3 million. However, approximately $4.2 million of long-term cost will occur over the 30 years after the landfill is closed. If the rate increase is not approved in FY 2009-10, the RSR will continue to show as a deficit for a number of years based on the ten-year forecast that is prepared each year. POLICY IMPLICATIONS Proposition 218 Notice The recommended refuse rate increase may be subject to the notice and protest hearing procedures of Proposition 218, and in an abundance of caution, the City is conducting the proposed refuse rate increase procedures in accordance with those requirements. Pursuant to Proposition 218, the City must provide written notice of any new or increased refuse utility fee to those subject to the proposed fee. A public hearing on the new or increased fee must be held not less than 45 days after mailing the written notice. If written protests against the proposed fee are presented by a majority of those subject to the fee, the City may not impose the fee. Public Works Department staff is currently working with Utilities Department staff on the "Notice of Utility Rate Change" that will be mailed to impacted customers and property owners in April. ENVIRONMENTAL IMPACT An increase in rates to meet financial reserve needs and operating expenses is not subject to California Environmental Quality Act (CEQA), pursuant to California Public Resources Code section 21080(b)(8) and Title 14 of the California Code of Regulations section 15273 (a) (1) and (3). Pursuant to Section 12.20.010 of the Palo Alto Municipal Code, Utility Rate Schedule R-1 (Domestic Refuse Collection) is hereby amended to read in accordance with Sheets R-1-1 and R-1-2, attached hereto and incorporated herein. The foregoing Utility Rate Schedules, as amended, shall become effective on July 1, 2009 SECTION 2. Pursuant to Section 12.20.010 of the Palo Alto Municipal Code, Utility Rate Schedule R-2 (Commercial Refuse Collection) is hereby amended to read in accordance with Sheets R-2-1 and R-2-2, attached hereto and incorporated herein.
