Roll call as follows: Present: Bertsche,; Bonn, Diveneck, Easterday, Hobart, 3or clan , e3ly, Thomas, Wood.. Absent: Cathcart, Cooled', Cottrell, lausten, Thoits, Wing.. The minutes of the meetings of August 9 and 12, 1926, were read and approved. Qoa cer nirt, "Canned neat" Mr. Behymer, Attorney of Los Angeles, counsel for the Sterno Heat Corporation, addressed. the Council, protesting- against the city ordinance which prohfoits the selling of "canned neat", quoting decisions bearing upon the matter. Councilman Granville Wood expressed. his opinion tothe effect that from "canned heat" ethyl alcohol was extracted, whichto drink was as healthy as moonshine or bootleg liquor. He stated that to sell "canned heat" made it perfectly easy for a person to purchase intoxicating liquor. The matter was referred to the City Attorney and Co~..r.ittee No. 2. Concern_' :'^ injuries• to Fir em '1 • Mr. Southwood, Secretary of the club of volunteer firemen, addressed the Council, discussing the treatment received by city firemen at the city hospital. This did not refer to injuries receved while fighting fires. This matter :ve.s referred to the City Attorney and Committee No. 2. As to 3s Servi ce The Council was addressed by Mr. . G. Shoup,; representing the Pcnirnsular. Railway Company. He stated that the year allowed by the State Railroad Commission for operating-, busses would expire on September 27, 1926. He requested that city officials join the Peninsular Railway officials in signing an application to the State Railroad Commission to extend the trial of the buy system fo:r one year, :the.railwa,r company, to nave the rignt at any time to give notice that it would. cease operating in 90 .days, this appJ.ication being a supplement application to the original application made to the State Railroad Commis s,ion. The Council by unanimous vote, decided. to accede to :xyr . Shoupt s request, and authorized the Mayor, City Attorney and City Bngineer to sign this application. Petition for -Di onal vrcr r The City Clerk reported concerning tine initiative petition for diagonal parkin that he had verified, the sirznatnres signed to the petition, and that of the. 292 signatures, 120 were .qu-alified voters.- The petition had: been critically examined by the Citg Attorney who .pronounced it to. be in due form and technically correct. The Council directed that the petition be referred to Committee No. 2. Concerning 2s-rk Commission A letter from L. S. Creriough, recommending that a Park Commission be created., was read. line Council directed that this be referred to the City Planning &omrnission,and directed tnat: the Clerk write to sir. Bucranan, addressee the Council, asking instructions as to his duties as City Purchasing Agent. He stated that in the afternoon of this day, the Board of Safety had, without referring to aim in any -way, executed a contract with the American Rubber Manufacturing Company for the purchase of fire nose, and then had requested him to- issue a purchase order. He had r_ad no opportunity to call for bids. The City Attorney explained that by the city charter a city board has fall authority to execute a contract to purchase articles for official use of the Board, provided money had been allowed for the purpose by the Council, and provided the Board had not exceeded the amount provided and on hand; that the actx.on of the Board of Safety in this case was entirely tithin its duties as prescribed by the charter, and the Board had not exceeded its authority nor neglected any requirement of the charter. Three ballots were taken, 1:r. Henry Hoyt, Lirs . Jerome Thomas and Mr. W. L. Peet receiving votes on the first two ballots, and Mr. Henry Hoyt and Mrs. Jerome B. The first item of the report recommended that a resolution be passed by the council authori zing the Mayor and City Clerk to negotiate a loan for necessary city expenses until sufficient tax receipts come in. Committee No. 4 also recommended that the Council oppose the proposed resolution of the League of California Municipalities concerning the gasoline tax, and that the Council approve Initiative i easure No. 4, which raises the state gasoline tax from two to three• cents per gallon. In regard to increases in salaries of certain employes by the Board of Works and Library Board, over the amountsstated, at the time the budget was adopted, Committee No. 4 recommended that the Board of v orks and Library Board oe requested to submit to t.ie Council a detailed statement snowing from what appropriation these increases of salaries are to be transferred. .4 On motion of +del ly and Easterday, this recommendation was approved. Mendenhall, representing the Forth End Residents Aasociat ion, spoke against the proposed extension and presented a petition from 321 residents protesting against it. Mr. W. B. Allen addressed the Council in behalf of the business men of Palo Alto and submitted apetition signed by 137 busi-ness men protesting against the extension of the busine°.s zoneon University Avenue. Others who spoke against the extension of the commercial district were Dr. J. G. Sharp Mr. Duncan. A. McLeod, Mr. E. A. BaPeire, Dr. Harry Reynolds, and Mrs. Myers. Ur. George Kingham spoke in favor of the extension of the business zone on Hamilton Avenue, and Mr. P.N. Lust also spoke in favor of extending the commercial district. A report was received from the Library Board in response to a request from the Council concernling the increase of salaries of certain employees of the library. This report stated that no transfer of funds has been made and that the amount to be paid for salaries is within the amount estimated by the Library Board in the budget. A motion was made by Thoits, seconded by Wing, that the report be accepted and placed on file with the approval of the Council. Professor West of the Library Board addressed the Council on this matter, asking when the Auditor would be authorized to honor the warrants drawn for salaries of the library employes. This matter of increasing the salaries over the amounts provided. for *hen the budget was adopted was discussed at length. Councilman Jordan made a substitute motion that the Auditor be instructed to pay the salaries of library employes during the present year in accordance with the recommendation of the Library Board. That University Avenue be widened from Waverley to Middlefield to a width of 100 feet. 2. That Hamilton Avenue be widened from Ramona to Cowper to a width. of 74 feet. 3. That Lytton Avenue be widened from Alma. to Waverley to a width of 74 feet. On motion of Jordan and bans ten , the Council decided to consider these recommendations separately. Concerning the widening of University Avenue, the City Clerk stated that 90 percent of the property owners had previouslyagreed to deed l2 -le feet of their property to the city for this pm -pose. Bertsche, the matter of widening University .venue was delayed until the next regular meeting in December.
