The Couxctl 'of the City of Palo Alto met in regular
session on this ..date at 8 P. M., with Mayor Hobart' presiding.
Present: Bertsche Bonn? Cathcart, Christensen,, Cottrell,
hobar s hoge, Jordan, Kelly, Lausten, Thoi ts,
Thomas, .titi'hisler, fling.
Absent:
Wood.
It was -reported that copies of the minutes of the
meeting of : Jul y 25 y 1927 , had been sent to each member. On
mot.Ion of.Cottrell and Bertsche, the minutes of said meeting
were approved.
Nearing" on. -Change in Setback Lines
It:was announced that tds was the time for a
• hearing on the recommendation of the City Planning Commission to
change the setback line on the northerly line of the property
of R. M. Sullivan on. Palo Alto Avenue in Block 51 to 11 feet,
to change the setback ' line on the northeast corner of Waverley
6treet and Addison Avenue in Block 62, the setback line to be
staggered in accordance with the method of the .City ;7:ngireer,
and to change the setback line in Block 90 to 40 feet on Cowper
Street and 25 'feet on Melville Avenue.
A prot;est was received from Raymond M. Stager
against change of setback line on the corner of Addison. Avenue
and WaverleynStreet in ,Block 62. On motion of Cottrell.. and
Berta.che,, this mats er "was referred back to the Planning
Commission fbr cans:iderat,on and report upon this protest.
No p t�t,es>ts :were received against changing the
setback lines in Block 51 and Block 90 as above recommended.
Ordinance No.; 393, changing said setback lines=, vas read, and on
motion of Wng� and Jordan, was adopted by unanimous' vote on roll
-call.
Concerning ..Widea.in Hamilton Avenue
It was :stated` that this was the tine set for a
continuation. of -the hearing on protests in connection with the
aideni ' of Es* i ton Avenue.
A report was received from Corxnittee No.. 2 recommend -
in; that the '' hearing' on these protests be continued and request-
ing further .time: to °'report on the proposed ord inance, repealing
Ordinance No."388 for widening Hamilton Avenue.

having been removed before July 1, 3.927 .

Mr. E. S. Erwin, Auditor of Stanford University,
addressed the Council with reference to a request foe refund
taxes on certain property owned by Stanford University in the
Mayfield District. On .motion of Cottrell and Lausten, this
matter was referred to Committee No. 4.
Re ort on Newell Road Widenigg
Supervisor C. P . Cooley made an oral report to the.
Council on the action of the Board of Supervisors with reference
to the widening of Newell Road, stating that the Board would
consider. providing a sum ' in its budget for the paving of a ten_
foot strip 4000 feotlong,

a conference with Supervisor Cooley and property owners on the

Letter from Mr. Hubbell
A letter was received from Carl L. Hubbell, Attorney,,
of Redwood City,, offering his services as a collector of delin-
qtent city accounts, and on motion of Cottrell and Kelly, was
placed on file.

letter from:Glen Behyuer, Attorney for the Sterno
Corporation, was . -received, this letter requesting: that the
natter: of the canned heat ordinance be considered and inVes-tigated
since the new product manufactured by the Sterno Corporation
is claimed ' to be unfit for beverage use.

Tax- Refund Granted:
A. report was,received from the City Assessor recommend-
ing a re:ftliba off`' $14.7Q :.to Mr. R. R. Agnew who was incorrectly
assessed`, for - improverient:s on his property in Block 8, Hawxhurst
A•'ddition. On:motion of Kelly and. Bertsche, this refund was
allowed by unanimous vote on roll call.

A report- was ,received from the Board of Works
recommending 'that tine ;paving on university Avenue between Seneca
and Marlowe Streets,,- on Seneca Street between Forest. and Boyce
Avenues, and on yaverley Street between Tennyson and Seale
"i venues,, bey put '°in- undcx: the, Street Improvement Act of `i911, that
ten year bonds,;, be' issaedj and that the Board of Works become: a
bidder for this- `pork under the provisions of the Freeholders'
Charter of the'.ci.ty.
The City Engineer explained that this recommendation
as made because of the fact that certain property 'owners on
these ,streets were unable to pay for the street work in advance
an& preferred tomakke the payments over a period'`,of ten years.
On motion of Wing and Hoge, the recommendation of
/.the- Board. of v orks r,,as :adopted, and the City Attorney was
instructed to ;prepare- the necessary procedure so that the city
may be 'able to bid on this work, and the City Engineer was
directed to prepare -the Plans and specifications..
On..motion of wing and Bertsche, it was' directed that
when the; Council adjourn, it adjourn to meet next -Monday,
August. -1;5, ,1927, at 7:3G' F. M. to pass the resolution of inten-

A report: was received from the Board of Works
ecommending. that the recommendation. of the Board of Safety to
open an alley in tae: southwesterly half of lock 20 running frcm
Brant :to Florence Sstreet's' be disapproved.
It was explained by the City Engineer that the
reason for -;this recommendatio i was the great expense.' involved,
the estimated cost of this proposed alley being about $20,600.00.
A motion; was made by Bertsche and Lausten to approve
. the recommendation .of the Board of �iorks. Thoits made a

Report on. Estimates for. Parks
A report, was received from the Board of Works approving
and forwarding, .to the :Council a report of the City Engineer
containing estimates ;of cost for the construction of the
University Avenue Plaza, improvement of Ea Camino Park, Pinconada
'ark, Peers Park, Co lege, i`errace ,Gazdens'and the ac4uisition
of Blocks 1 and 61. and southeasterly half of Block 60, South Palo
Alto,,, at a total estimated cost of 4,150,166.35 and a total
estimated cost for yearly ' maintenance of $25,062.49. On motion
of Cottrell and Whisier this report was referred to Committees No.
1 and 1v o . 4.
Appropriat.ionn f'orGutter
A request vas received from the Board of Works for:'
an appropriation of 4p200.00 ,for .the: construction of a gutter
on Waverley Streetalong the frontage of the A. E. Werry Electric
Shop. On motion of Wing and liege, this appropriation was made
from the contingent fund,: bar unanimous vote on roll call-.
Concerning.Mailing41,2s,
On motion of Jordan and Hoge, the report of the Board
of Works disapproving of the .proposition of mailing bills to
consumers of utilities immediately after monthly meter readings
v. as approved.
Mr. 0. G. Saunders, representing the local carpenter's
organization, addressed -the Council asking when the report of the
City Engineer in answer to Mr. Troy=s letter concerning the city
power plant would be made. -. The City Engineer replied that his
report is nearly- completed' and would be referred to the Board of
works at its next meeting.
Report of Gozmnitt N .o 1
A report was received -from Committee No. . 1 recoMmend1ng
that the Board of Works bey authorized to negotiate with the
Pacific Gas and Electric ;Company. with a view to purchasing their
gas, light and power, distributing systems in Mayfield. On motion
of Wing and Bertsche, the Board of Works was so authorized.

A report:was received from Committee No. 5 asking for

for city employees:, ana reporting.;<with reference to matter of
requiring city-,empoy.,ees using. their own cars for city business
to carry. liability :insurance ;protecting the city that it has,
requested the, City At.to,rney to Consult insurance agents with regard
to issuing blanket policies.

considered together with group insurance. On motion of Jordan and
N.:rs Thomas, ' this recommendation was approved.

Concerninsr Stephen Miller ller Case
The Deputy City Attorney reported that the case of
Stephen Miller et al vs. the City of Palo Alto has begin ordered
before tie : emeCourt for hearing and that the city will soon
be called; upon "ta present briefs. On motion of Wing and ' Hoge,
.the..City Attorney'wtas directed to prepare the necessary briefs
and an'appropriation not to exceed $100.00 for printing, was
authorized =from the incidental fund, by unanimous vote on roll

establishing an airport. for Palo Alto, with estimatesof cost
and 'estimates of possible revenue.

appointment` was confirmed.

Mrs.. Thomas requested that a report be made from
the Bospital COm mittee in, Septeriber. Mr. Erwin, Auditor of
.tanford University, stated that Ur. Broderiek:is preparing a
report on this matter but did not think it would be ready in
September, as he is :busy with several other reports also.

1927, and the annual report of the Advisory Board on Commercial
