The Council of the, City o f.: Palo Alto met on this date
at 8 P. M., pursuant toa.djourriment of July 18, 1927, with. Mayor
Hobart presiding. Roil call as follows:
Present: 4$ertsche, Cathcart, Christensen, Cottrell, Hobart,
Hoge, Kelly, Lausten, Thoits, Whisler.
Absent: Bozo, Jordan, Thomas, Vying, Wood.
It was reported, that copies of the minutes of the
meeting of July 18, 1927, had: been , sent to each member. On motion
of Lausten and Whisler the minutes of said meeting were approved.
Concerning Widening' Fore s t- Ave.
It was announced that the special order of the day
7ras the report of Committee No. 1 on the recommendation of the
City Planning Commission to widen Forest Avenue.
A report from Committee No. 1 was received, this report
recommending' that, .whereas the property owners in Block 7 on the
southeasterly side of r'orest Avenue. 'between Iiigh and Alma Streets
have offered to dedicate a strip of land 7 feet in width, the city
accept deeds' for this strip, : and that the Board of Works be
=e.cl tested to furnish a; report on the immediate widening of Forest
Avenue fronting this property. The committee also recommended
that in future proceedings for the wici.ening of Forest Avenue
these property ownersbe given credit for this land so deeded.
It was further recommended by Committee No 1 that an appropriation
of $500.00 be made to cover the' cost of paving the seven -foot strip
on the southeasterly side of Forest Avenue in the southwesterly
one-half of Block 7 between Alma .and: High Streets provided this
strip is dedicated by the :property owners.

A report was received from the Board of Works submitt-
ing a plan of the City Engineer for the widening of the south-
easterly side of Forest Avenue by 7 feet between Alma and High
Streets, and recommending,same to the Council for adoption.
Resolution No. 553, approving the plan entitled, "Plan
of the Widening, and improving of the Southeasterly Sine of Forest
Avenue between Alma ;and "::High: Streets, -Palo Alto, California", was

recommending that the Board of Works be requested to prepare
plans *for the widening .of Forest Avenue between Alma and Waverley
streets -: to.' a uniform width ,of
74 ;feet by the acquisition of 7
feet on each side, in accordance with the recommendation of July
18, 1927, of the City- Planning Comrnis.sion. On motion of
Cottrell and Hoge, this, ..report was approved.

An opinion of the City Attorney on easement :vs
aequisition of laid .for streets was read and discussed;. This
opinion 'also made reference to the Statute of 1927 providing- for
a mew City;:Planning Commission and the adoption of a •"Master.
Plan" providing, in part, for the widening, opening ` or . eftend1ng.
of existing streets.
r.:'•R.:B.a:Hackley addressed the Council on .this
matter and ,stated that in his judgment this act wat unconstitu-
tional In diferent respects, the title was faulty and the
general effect in short.would :not:be advantageous. The City
Attorney stated that in his judgment the act was constitutional
and theta' however, its ` constitut9.onality was not a question for
the City Council of. Palo' Alto•, and if the title was fau:lty,:
.i.t..w.as .so only in a small degree which would not in any way
affect the act itself.
Ordinance on
Reorganization
An ,ordinance -providing for the reorganization of the
City Planning. Commission of the City of Palo Alto was given
first reading. A report was received from the Planning
Commission recommending: the adoption of this ordinance.
A motion was'.made by Cottrell and Hogeto adopt the
ordinance, but. this motion was later withdrawn. A motion was
made by Whisler to refer the,ordinance to Committee No. 1 and
any other.persons.the:Mayor:de$ires to appoint as a committee
to.: consider this matter; : .There was no second to this motion.
Afterfurther discu.ssion, on motion of Cathcart and Bertsche,
the :ordinance 'was referred to a special committee to be appointed
by the .Mayer, to be • composed ' of such members as he deems,

Petition to Close Nevada Ave.
A .petition was received from N. P. Nelander and five
other .property owners .requesting.t.hat Nevada Avenue be closed
between Bryant and Emerson Streets. On motion of -Cottrell 'sad
Hoge, this petition was referred to the Planning Commission-.
On motion of Thoits and hoge, the City Attorney was
regle sted:to prepare'.a report on the question as to wham the
property reverts if:-. the.` -street is closed.
Letter from ' S. . I . Marston
A letter from S. I Marston concerning the sidewalk
grade .a.t his ;' propperty.. at 126 Coleridge Avenue was read and
referred. to the Board of Works.

Commission recommending that the' setback line on Palo Alto Avenue
along` the northerly line of property of R. M. Sullivan in' Block
51 be established at 11 feet, that the setback" line at the
northeast corner of waver.iey and Addison on property oft R. M.
''u11ivan in Block 62 be established in accordance with the
standard setback : method, staggering setbacks, asused by the City
Engineer; and that the'setback. lines in Block 90 be established Attest:
at 25. feet on Melvile Avenue: and 40 feet on Cowper Street.

the City Clerk to publish to . the Palo Alto Times in the manner

Council at its regular meeting on August 8, 1927, at 8 P. M.
on the above recommendations of the Planning Commission for
changes in setback lines.
Report of Auditors Received
The report of Robinson, Nowell & Company, Special
Auditors, for the year ending June 30, 1927, was presented to
the Council by Committee No. 5. 0n motion of Cottrell and
Molts., this was- referred`` to. Committee No. 5, office Manager,
Auditor and. Purchasing Agent' to arrange for publication of certain
parts of the report..

certain marsh land of the Morgan Oyster Company before the
lease with said; company is Signed.
