This was the- time for the continuation of the r.earine
on the assessments . for the improvement of 14'orest Court, Ashby
:Avenue and reenwood Avenue
H report was received from Committee No. 1 re�corner:ainC
that the assessments as modified and cosrected be approves;.
The revised assessment was explained by Arthur James, deputy
engineer, who'stated that by the modification Trade in the
assessment the:',City is to bear the cost of the curb around the park
in Forest Court plus.. the ` having of two and ore -half feet of r,sv n
around. the, park thus reducing the assessment proportionately
on : the property on Forest .Court between Aoycc Avenue and Ashby
Avenue.

the original deeds to prop;e.rty owners on Forest Court` contained
clause that' the title to the park land was riven to :property owners
with, the proviso that::"the property owners keep '.be park improved
and pave all portions of the street at their own expense, tree
report further stated that the property owners have not ,complied
with these. provisions, have never paid taxes on the pare; that the
catty has kept it improved and the evidence shows that the park has
now become- a public park.. Mrs. Black referred to the fact th t
the road which previously divided. the park into two parts had ae s
closed when the street was improved. The statement was maee that
a : a jerity of the property ow hers preferred to have the two ,:rks
joined together and:did"-not wish the road to be kept open. The
Attorney stated that if it is _desired to have the road kept over
the curb could be removed, .which would not effect the assess -rent
any way, or legal procedure. could be taken to close the road.
