It was announced that the special order of the day
was the hearing: upon lateolution of Intention NO. 797 for the
i::lprovement of Er:zbarted sro` Road and Kellogg Avenue. The_ Clerk
reported -that ro. written` protests head been received.. It, was
explained by 'the- City .:A ;torney that the law requires `all protests
to be -made in writing. A number of, interested property owners
:.ere, present some of 4hoz desired to be heard, On motion of
Mosher and'Kelly„ 'the usual procedure was waived and- the Council
decided to rear those -who- wished to speak on the matter.
Among those who, addressed: the Council on the matter were Mr. J. R.
Slonaker, Mrs. McHale, ;fir. Thulin, 1)r•. Leonard W. Ely, and- others,
their protests'- bring .-against the formation of an assessment
district, and :al-s'o against the policy of the city, in paying for
a ten -foot stria .on <Em+barcadero Road. It was _explained by the
City Attorney and City Engineer that the assessment district
with the-exeepti-oza 'of the frontage on the streets to' be improved,
would be charged 'witr ' onIy a small part of the large street
intersettion.s, ' that the amount would be a nominal sum, probably
not more than $1;.00 ' for each 50 -foot lot.
The',hearing was — then closed and the matter dis'cusse
bye the Council. Resolution' No. 805, ordering the work, was

Appo intment s to Planning Commission
The Mayor announced his nominations for membership on
the Planning Commission, in accordance with ordinance recently
adopted providing for the reorganization of the Commission, and
the nominations were: confirmed by the Council by ballot,, as
follows

The Council then proceeded to elect' two.-ex-tfficio.
members to serve" on the Planning Commission, in addition to the
City,;Fngine:er who is . de:signated as a member by the ilanning Act.
On'.motion. of Wood and Reynolds, the Mayor was appointed -an ex -
officio member.. 0n motion'of Hobart and Johnson, Councilman
Reynolds wasralso elected an ex -officio member...
In accoraance with the Planning Act, it wasthen
necessary for .the ex -officio .members to designate their. deputies.
The City Engineer, Mr. Byxbee:, nominated Mr. Arthur James as his
deputy, Dr. ,ZReynolds nominated Mr. F. P. Nutting as his deputy,
and Mayor Christensen nominated Mr. Norwood. Smith as his deputy.
These nominations, were confirmed by the City Council
Concerning Sidewalks:
Referring to matter of sidewalks constructed. by G. W.
Cushing, a, report was received from Committee No. 1 stating that
ithad a conference with Mr. Cushing and his attorney on this
matter, that Mr. Cushing; has agreed to make certainrepairs, and
after the repairs :,are made the committee will make a final report
and recommendation to the. Council. The City Clerk reported that
Mr. Cushing:.had informed loin,; that he would be in Palo Alto this
week todo, *Pia" work'_ and would; make the repairs requested,: to the
satisfactionof the .City Engineer. The hearing on this ;matter
was :continued to the next meeting on September 30, 1929.
Petition for .<One-Wav Avenue
A petition :was .renal:=red. fror.- Richard W. -Barrett and
other ,property ownersAcn Mariposa Avenue, Southgate., asking that
Mariposa. Avenge be made:a one-way avenue, and that all southbound
traffic be prohibited on this street. This was referred: to the
.Board of Public Safety ' and. Committee No. 2.
.Decision. in Miler :-Case
The City,:Clerk reported that he had received a copy of
"California Decisions -.fin. the case of Miller et ua . et -al. v.
City of_':Palo ' Alto confirming the action of the Superior Court in
this- matter he .Dep,xty City. Attorney stated that ,a. claim for re-
hearing has been= filed with. the Supreme Court, making i necessary
for the City: Attorney to submit another brief, which would require
an. appropriation On motion of ''ooc. and Kelly,.- an appropriation
not to exceed $50.00 was allowed for the printing, of this oriel.

Concerning Spur Track
�hr.. Ralph W.. Evans addressed the Council concerning,
a previous reru.est he had made for permission to cross Clive
Avenue with a= spar to serve his storage yard. This permission
was granted by the Board of `forks, but when the matter was taken
before the .Railroad Co=ission for their approval, the Commission
stated it would :be necessary to have the co iser.t of the Council
also. The matter was referred to the City Attorney at pis.
request, who stated he.would consider the legal questions
involved and report back to;, the Council on September 30th.

approving and transmitting -a 'report from the Chief of Police on
e subject of traffic controlat the intersection. of University
Avenue and El,. Cammino. Real. • The Chief of Police explained the
method .of a sound- operated traffic signal as recommended in his
report, with a Further recom=ndatio•n that the radius of curb
curvature be shortened':on the city side of El Canino Real, and
twat curbing: zee installed on the Stanford University side, so as
to cear.ly mark the roadway andthe •pedestrian paths.

Lease with Southern Pacific
A report was received from the Board of Works
recommending that" :.a> .lease:'to the Southern Pacific Company, for 6
feet of land on the southwesterly side of Alma Street between
E barCadero Road and,•Kingsle,y Avenue for the purpose of building
a pedest:rian :subway be approved by the Council. The report of
Cormi tt'ee" No.1 was read on, :this matter, the committee also
r ecorrmendixg ."that :the 'Council grant this easement. ter. Lathrop
representative of:ethei Southern Pacific Company, was present and
stated that the "propos;ed' lease was satisfactory.

this pedestrian subway. would not in any way rc; udice the

the Southern Pacific Co.was willing to join with the City of -
Palo Alto, now or: thinany „reasonable time, in the construction
of the permanent subway.."

Plans_ for Pedestrian Subway
A report was received from the. Board of works recommend-
ing that the plans and, specifications for the construction of a
pedestrian subway onEl Camino Real for the protection of Mayfiela
School ; chi ldre vt e adopted.
Resolution No 807, approving said puns and specifica-
tions, was read, and; on motion of Mosher and 3ertsche, was passed
by unanimous : vote .on roll call.
On motion of Thomas and 3ertsche, the Board of Works
was authorized to proceed with the construction of this subway.

A report was received from Committee No I concerning
the use of the. oid .bus -s ration, recommending that.the Board of.

A .quit claim deed was presented from the Palo Alto
Land 'Company for the portion of Southwood. Drive which was recently
order ed to be closed: by theCouncil. A resolution accepting` this
deed and the and conveyed thereby ;was read, and on motion of
Thomas and 3ertsc. e.,: ,was passed by unanimous vote on roil call.
An, agreement leasing the land made by -.the closing of
Southwood Drive to•'H.arry Atwood Kee for a ter of 25, years at a
total' rental of $250.00 :for - the entire period, was considered.

Referring, to the request of ;Liss Harker to close three

Ordinance:No, 82., prohibiting U turns on University
Avenue .from Alma Street to Cowper street, was given second
read1ng and diseus;ed.' The Chairman of the Board of Safety
and the Chief .of P.oaiice explained the p d;cisions of this ordinance.
On motion :of. Lausten and Thomas , the ordinance was passed on
roll call, .all: voting Ave except Kelly and Mosher, who voted No.

in the amount of $528..21 for paving in the Bartley Tract,
covering ce.rt,ain lots taken over . by the City by tax deed. On

Franchise Tax from Peninsular R;r-.Co .
A statement was received from the Peninsular Railway
Company' enclosing; voucher for $18.52 in payment of franchise for
street .railway in Mayfield.. On motion of Bertsche and Lausten
this was accepted. under protest.
