Bidder Western Roads Company Peninsula Paving Co T. A. Hanrahan date with Mayor Christensen presiding. Roll caii as follows were Present: Cathcart, Christensen, Hobart, Johnson, :Belly, Lausten,.Mosher,. Thoits, lh.isler, Wood. Absent: Miss 9°ertsche, heynolds, Thomas, Mrs. Thomas The minutes of the meeting of August 12, 1929, approved. ,417 al and Alma Street The following bids were opened, read Total Amount of. Bid $18,670.80 17,957.40 19,408.00 These bids were referred to the City Engineer`: for tabulation and report. HearinE on opening Alley .'his was thetime set for a hearing on the. protest. of Mrs. Lucy'I-tight-body' against the opening of an alley in Block 50, College Terrace. The written protest of Mrs. Lightbody was read. The Clerk reported 'that, the protestant had been notified of the time of tb.is' hearing, but she was not present. On motion of Cathcart. and Mosher., the hearing was continued until the next regular meeting. on September' 10th, and it was directed that Mrs. Lightbody be notified of the continuance of this hearing. Loncerriin ,: Sidewalks Another special order of the day was the hearing, contIr edt-"from Atigust "12th, .on the protests against the acceptance of sidewalks' and assessments for: same, recently constructed by 0. W. Cushing,, contractor, ;this Matter having been referred to the Board ofd Works, and "C;ommittee - Ne. 1 for investigation. A report, was received from the Board of Works on this matter, stating. that; members of the Board and Committee No. 1 had inspected the sidewalks ',and considered the protests.. The 5os.r3 submitted a' report .fro,m the Street Superintendent on this matter, which it approved, and forwarded to the Council. The City Clerk reported that Committee No. 1 at its meeting just previous to this Council.. meeting had considered the report of the. Street Superintendent, but. did :not have time to complete their study of the matter, 'and therefore wszenot ready to make a report at this time. On motion 'of` Cathcart :and Mosher, the hearing was continued until the next Meet ng,of the Council on September 10, 1929.. -Mr.- A. C. Adams, p erty owner on Alma Street, addressed the, Council,. .Stating:. that ; the sidewalk laid in front of his property , was broken and in., a dangerous condition -,and he wished to knowwho was responsible in case of an accident caused v from` the bad condition of the sidewalk. This matter was referred to the StmtSuperintendent. Assessment for Third Street Lt This was also the time for a hearing on the assessment roll for the improvement of Third Street, Margarita Avenue, Matadero Avenue and- Wilton `venue, under Resolution of Intention No. 683, the work having been done by the Peninsula Paving Company. No written protests were filed .and there was no one present who wished to be heard on the matter. Resolution No 794, approving assessments for this work, was read, and on motion of Wood and Kelly,was adopted by unanimous vote on roll call. Hearing on Commissioners' Report This was the time for a hearing on ,the report of the commissioners in the matterof widening Cowper '>treet between University and Hamilton Avenues. A written protest was received from Grace Z.! Store, ',am. R. Camp, Sadie M. Stephenson, I M. Calderwood, Florence and Annabel Morse, *ryes Sumner Eddy:, F. . Gowe ll , W. J. e heldan and Katherine taxer. written protest was also received from J. M. Blackburn.,;: These protests apon the report of the Commission- ers were referred to Committee No. 1 and Committee No. 4, to report back to. the Council on September 10th. The matter was also -referred; back to the Commissioners, in accordance with suggestion o=f theCity Attorney, and the hearing was continued until the next- meeting on September 10, 1929. Letter from Mayor A coxnrimication was received from. the Mayor with reference to: recent accidents at railroad crossings in and near the City, recommending: that the Council consider immediately the matter ofgrade. separation at the Eznbarcadero ;ros`sing and the . type off' s a:bwey to be built, and also asking ,consideration of his suggestion that"the City of Palo Alto take the ine ti-ati e:> =to " the end that a conference be called to: be attended by representatives of San ±''d sncisco County, San Mateo County and ,Santa £"late County, and also to have representatives from the .different peninsular cities between San• Francisco and San Jose, to 11:oi.n in a movement, the purpose of which will be to abolish all ,gradia crossings o: the peninsula, the cost of which will be ?brn jointly by the State of California, thesethree counties, the_ peninsular cities and the railroad, by a .fair and equ.itable, proportion." A` motion was made by Thoits, seconded by Johnson, that the Board". of `orks. and City Engineer be requested to cotnsider. the plan of the Embarcadero subway, with view to bringing :it,, again. before the Railroad Comaiission for possible modification.. This "Matter was discussed at length, and the supgestio ' was made that some means for safeguarding the crossing, other than a subway, might be considered, ; such as the installation of gates. Petition of Tennis Club r,. report was received from the Board of liorks concerning a petition from, the . Palo Alto Tennis Club for the instatlation. of tennis courts in Rinconada Park, the Board recommending that this be granted by the Council. This was referred to the City Attorney for en opinion. Paving of Alma St. Referring to a letter from the South Palo Alto ryesident liaociation to the paving of the easterly side of ,Alma Street at the corner of Embarcadero Road, the Board of Works reported, that ,it wouldput in: oil macadam pavement at this place for temporary use, future pavement with concrete depending upon ‘vhether or ;not. the Embareadero .subway will be built.. Embarcadero Road and Emerson : Street, was read, and on motion of Wood and Molts, was passedby. unanimous vote on roll call. The City Clerk was directed to pablish the notice as required by ,,law,setting time for a hearing on this report. As to, V ^sting Dead End: of`. ;Southwood Drive. A- report was received from Committee No. 1 recommending that the Council grant the request of Hare, Brewer and Clark to vacate the dead :end, o.f Southwood Drive from the turning circle to the end, of the street at San Francisquito Creek, with the following requirOent "That an agreement be entered into between the owner of the property and the City to the effect that the owner„ and his successors in title waive all rights to compensation if after a period of 25 years:, the City Council passes a resolution that the Council desires -;this land for public use, and also provided that the cite retain :an ;easement for existing telephone and: power lines'. The committee,further recommended that the City Attorney be instructed... to draw up a proper resolution tovacate this dead end of,Southwood Drive and to embody in the resolution the above mentioned conditions. This matter was discussed, and reference was made to the record of the Planning Commission on the question, the Commissi having failed to adoptamismAlamendation. similar to the one of the committee mentioried;,.above, owing to a tie vote. Professor Clark, chairman of the ,Planning _.Commission, addressed the Council on this matter, and a letter was read from Mr. Norwood Smith, ember of the Commission, on : the same subject. On motion of Wood and Whisler, the matter was continued to the' next meting and it was directed that the. parties interested in having the dead end of Southwood Drive vacated be asked to appear before the Council to explain their request. Plans for Openin5 Alleys A.report was received from Committee No. 1 recomaending'.that the .plans. and specifications for opening alleys. in Blocks 46 and 47, College Terrace, and Blocks 1 and 2,. 7eisshaar Addition,.be..adopted. Resolution No. .798,.approving these plans, was read, And. on. motion of Thoits and Johnson, was adopted by unanimous vote `on roll call..
