March 4, 1929.
The council of the. City of Palo Alto met onthis date
at 7:30 p. '., pursuant to adjournment of February 27,: 1929. In
.he absence of tie Mayoz', the: meeting was called to order ,by the
City Clerk. On motion -of Jordan and 3ertsche, Councilman
;:nisler was elected ayor aroi--tem and took the chair. ,Roll- call
was as follows: - .
Present:.3ertsche, Cathcart, Christensen, Cottrell, Hobart,
Johnson, J ordan, Kelly, Lausten, T"P o{ ts, Thomas,:,
Whisler•
T.h;e., City' Clerk: reported that the necessary certificates
concerning the annexation of the South Oregon Avenue Tract had been
obtained from the Secretary -of State and that one copy had been
`'sled it him, :on March 1, 1929, and another copy filed with the
Board 0±' St.pervisors of Santa: C :ara County on March 2, I929
Closing, of: ?�eaoia Avenue
It was announced that the special order of the day
was the consideration. of the ,matter of closing Acacia avenue
between First 'and Third Streets, as requested by the Sutter
Packing. Company. The questions involved in connectionwith this
Matter were discussed at length by the Council, and maps were
examined.
As previo xs1y stated, the Sutter Packin 4ompany is
desirous that the street be closed in order that the rgove the
spur track to a location zzorth of the center of the present street
and erect platforms on. the land made by the closing of the street.
The packing company ins: wil'ling:. to purchase Lots 1 to 8, ' Block 5,
to which the city has a; tax :title, but as these lots ,are in
litigation, being claimed; ',4So by i' cColgan and the Cooperative Land
Co:rpany, it is'im:vossible .;for the City to give a clear title at
the present time,- Mr.. R. McColgan and his attorney, Mr. George D.
Collins, Jr.', were present and Mr. Collins addressed the.Council
on this matter.
Letters gore read from Louis Sanders, owner of Lot 9,=
Block 6, and from T. -D. Reed, attorney representing the Estate of
7o in °Tri-gg, `o'ner, of Lot 10,, Block 6, these lots being affected by
the closing .of this street
Mr. Cutler, ,representing the Sutter Packing Company,
addressed the Counctl and resented appraisal books of the
property' in question, staging, that, al.thou h his company does not
reed the proxer ty, ` they are willing to purchase Lots 9 and 10, Bloch
6, and Lots L to 9, I3Aock'5, at the rate., as given on his appraisal
books, being :.04373.:per - s,q. ft. This would place a price of
Ni261.93 on Lot 10, 1291427 27 on> Lo t 9, Block 6, and $458.02 on
-ots 1 to Block 5. 1st was the opinion of some rf the council
members that this"price was too low for this property. It was
also noted that Mr.. Cutler's: figures did not include the 30 -foot
strip made- by, the closing ' of 'the street which would revert to
Lots 1 to 9, B3ock> 5.
The suggestion - was : made that the Sutter Packing Company
put upa bond o±' certified check for double the amount of
appraised value, in order to protect the city.,
After further discussion, on motion of Cottrell, and
Hobart s it was direo .e:d `t;aat a Board of Appraisers be appointed
immediately to appraise the land in question; the Attorney and
Manager of the: Sutter P.ackitg Company to meet as soon. as the
a.p-raiza1' is made and 'draw up a resolution to present to the
Councile-at the next.: meetings Mayor pro tem b+hisier announced
, that ,he would appoint 'the following as members o.f , t-hia Board of
.r Appraisers - 11'.: R. Bartley, Alec Clam,, and Alfred Engle.
On notion of,' Thoits` and''Cottrell, these appointments were
confirmed.
(Caunci1man Bertsche was excused at 8:05 p.m. and
:,gas aosent during the rest of the meeting.)
-Purchase; of Land
The matter. Of the purchase of four acres '04- land
on Em,barcadero Road adjacent to city property -on thebay shore
from Wong vwo San at the price of $300.00 per:acre,."was considered.
Resolution No. 729, authorizing the purchase of this" land', was
read,. and on motion of :Molts and Cottrell, was passed by,
unanimous vote on roll call.
On- motion of Thoits and Cottrell, the Auditor was
authorized to" draw the necessary amount for the purchase of this
eland fro::: the contingent fund, by unanimous vote on roll call.
04, moti` on of Cathcart and. Christensen, Committee No.
4 was asked to`, -negotiate with Mr. G. Laurreister for the purchase
of a tract` of hand: which he owns on the bay front, which is now
er'ti:re? ysurrounded 'by city owned land.
Agreement- ' w th peter Faber
.An agreement of lease with Peter Faber with option to
purchase approximately 71.:5:3 acres of land adjacent to city owned
property -on the "bay.shore,."at approximately $250.00 per acre, was
presented. motion' was made by Thoits and Christensen that

-adopted by the .:Counci]. This matter was discussed and. It was
pointed out .tha;t-the".:.:price of this land was considerably hi trier
than that` paid for property -previously purchased on' the bay front.
The z~iot' on ; to adopt the resolution was withdrawn, and on motion
-o.f , Cathcart and Mrs Thomas:, the matter was referred to Corrimittee
No.; :.
Petition for. Annexation
Referring, to the:petition for annexationof uninhabited
t.erri"tory known as MEiibarcadero Oaks" presented on February; 27th,
'an.agreement was "presented signed by R. 0. Bolman, Zackson II.. -
Ralston, and the Ward Investment Company, owners of the tract
proposed 'to' be-; annexed,_ concern;ng the taxati.cn of -this. territory
to :ps.y for the "outstanding .bonded indebtedness of the. City. On
motion ,.of Kelly <and Laustenee this agreement was referred' to the
.City Attorney.
