special meeting of the Council of the City of Palo
Alto, to convene at the council chamber in. the City
Hall at Palo Alto, at the hour of ` 7:3C p.m., Monday,
rebruary; 26, 1934, for the purpose of considering
'Memorandum of Agreement' with. the Division ion of Highways,
providing for expenditure of the City's share of the
one -quarter cent gas tax fund; and for the consideration
or such other matters as may come before. the Council."

The agreement: was read and explained in detail by the

Protests on Trucking _Ordinance
A letter was received from the nW end orf United
�ar;eries, `Inc., asking tn:tt the ordinance recently passed by the
-o,4cil prohibiting heavy
trucking on certain treets be revised
�o as to permit entrance into -Palo alto by way of the Dayshore
-, --w-y, with the -information that they use. 14 -tom trucks,
Lity .Attorney stated that the present ordinance prohibits
tr::cks of 2 -ton capa; ity. or over, and therefore the Langendorf.

The question ;.was raised as to whether or not city
trucks and. garbage trucks are affected by the ordinance, ` and it
was ,pointed out by the City attorney that such public service
trucks should not be affected by the ordinance; that it was the
intent of the. committee that such trucks operating as part of
the city:'s:. service would be made an exception. Coancilm an.
Judson stated that the telephone company's trucks might be
classed :in the same may, and suggested that :the matter be :wain
referred to' vommittee' No. 2 for further consideration.
At this po'i,nt a : letter was read from thegutter Pack-
ing Company ,.asking:. that the present ordinapnce, be repealed or
revised so thattheir truck, might have free access to t eir
plant. fir. Alan : ut er, President of the flutter Peeking
Company,was present, and addressed the Council on this matter,
calling attO tion to the extra expense involved if their
trucks brir.g<n roa.uce from Alameda County are .required to
go sever.al miles °tit of the way in order to obey the prov:isionF
of the . ordinance. He asked that they be permitted to use
Oregon Avenue, which is row closed to "heavy trucks.
This matter was discussed at length. .: i . was pointed'

This whole subject of heavy trucking was then refer'ee
to Committee No. 2 for further observation and ntuoy.

Transfer of Funds
report was received from the Board of 6 cfety
recommending that 5O0.CG be transferred from the Police Lepart--
ment operating account to the Capital Account, to eover the.cost
of poles and equipment for the police radio. This vas referred
to Committee No. 4.
'he Chairman of Committee No. 4 later *reported that
the committee approved of this transfer and so recommended.

concerning the construction of four tennis courts in r;irconada
.ork and College Terrace, stating that C.W.A. labor is now
ava fable if the Council can appropriate the son of ;„:1445.00 for
materials in order to complete the courts. On motion of
W:itchell and Mosher, his matter was referred to Committee Igo. .

Change of Setback Line

recommending that the setback lire on Middlefield
Block 33, Seale. Addition, on, be changed from 24,:feet
a distance of 75 feet southeasterly from Tennyson
16 feet for the remaining 75 feet of the lot.

widening Cambridge Avenue
Referring to .the matter of widening Cambridge :;venue,
the Planning. Commission recommended that the . building on the
easterly corner of El -Camino Real and Cambridge -Avenue, commonly
known- as the fisher property, be moved so as to provide for e
60 -foot street instead of a 72 --foot , street as contemplated by
the present. procedure, and that this procedure be abandoned.
This was referred to Committee No. 1.

a report 'asreceived from the Planning Commission
concerning the offer of Peter `aber to sell to the City 25 acres
of land :adjacent to the muni.cipal airport, which had been aced
for borrow pit purposes, the Commission recommending that this
offer. he not accepted and the lard be not purchased. A n3ot.ion
was made by Mosher:, .seconded by Judson, to approve this repot.
It was pointed out that the matter rid also been referred by the
Council to the Board ofryorks ana eommattee No. 4, and it ova
suggested that; n.o action be taken these reports are

Relief for 4500.00 for relief of men, of which .300.00 has
already been appropriated by the Council, the committee now
recommending that the remaining w20u.CU be appropriated for this
purpose. On motion of Thoits and Judson this recommendationwas approved and the appropriation authorized from the
unappropriated balance, this by.. unanimous vote on roll call.

an appropriation be made to the Board of Safety of .450.00 for
expenses of the shelter for the month of February, this to be.
taken from the Oontingent ,Fund. This was discussed, and on
motion of i'hoi is and Johnson, thisreport was approved and the
appropriation allowed, by unanimous vote or roll call.
r cquisi tion of land in Butler Tract
The City Attorney reportedthat the appraisers who
recently appointed to appraise the land in the Butler Tract:
to be acquired for the sewer project :had made their :appraisal,
of this property. He further reported that Mr. , bhaw and the
owners of a portion of the. property ,were._willl g to sell the
land necessary to be acquired from them, but that Mrs. Luel_la.
butler refused to sell the land although*she is willing to grant
an easement. The :attorney suggested that the Council ;authorize.
the board of Works . to purchase. the necessary amount of lama; from
r. 6h«vr and his associates, and acquire an easement from Mrs
butler for sewer and road purposes,, the cost of this lane: and
easement totalling approximately wl2U0'.00.
On motion of Mitchell and Bonham, the Boerd of ;'corks
was authorized to proceed along the lines suggested by the City
:attorney, ali voting Aye on roll call, except Councilman Thoits
wno aid not vote on this motion.
