Zone. The Planning Commission had recommended to the Council et the last meeting; that the application to rezone this property frori First Residential to Commercial Zone be denied, but that 1::_c P o_ erty be rezoned to Third Residential Zone. Opportunity was given to members of the audience to epee!: on this matter. Mr. George T. McLachlan, owner of eroperty at the corner of Lambert and Third Streets, addressed the Council in opposition to• rezoning -this property to Commercial Zone as he felt that there is enough: property zoned for commercial purposes at the present time. He agreed with the ='eco.r.:Yendation of the Planning Commission to rezone these . lots to Third .Residential. Dr. Charles Shattinger, one of the petitioners for the c i' n,ee of zone, also addressed the Council, referring to a si:nilar petition madefour years ago which was denied. Pie was of the opinion that the zoning ordinance is unconstitutional when it lists certain businesses which may be carried on ina home but prohibits other businesses of a similar nature. -he believed that Mrs. Shaw has a right to operateher business; under the present ordinance and requested that the matter ter be, acted upon as soon as possible. The City. Attorney explained that the present orclin?rice permits certain enumerated businesses in connection with a home but that the operation of a beauty shop is not included; , that the Council has no authority to grant a permit for this business but can amend the ordinance if it wishes or change th zoning of the property. There was considerable y,, discu.ssi.on among the council members, a number of whom expressed the opinion that a proper study .,should be made of the whole question and a policy determined in the matter of signing the e'.tra ces to the city. Councilman Thomas a suggested that suggested consideration be given to a flood -lighted sign at the university :.venue intersection instead of a Neon sign, inasmuch as a sign at this intersection would have to be more elaborate than those other entrances due to competition from other signs. A resident of East Palo Alto addressed the Council and stated that the residents of East -Palo Alto feel that a new sign at the Cniversity "Avenue intersection is necessary as a safety measure. As the owner of this property is anxious to, start building operations, the Commission reco':?.:.enf:ed that an ordinance providing for this change of setback line be adopted a an emergency ordinance. Ordinance No. 763, changing the setback line as a bona recommended, was read, end on motion of Mosher and Thomas was adopted as an emergency ordinance by unanimous vote on, roll call of all _councilmen present. (Councilman Cypher was absent during the`vote on this ordinance.) A report was received from the Planning Commission recommending that the setback line on the southeasterly line o_ Lincoln Avenue, in Block 96, beginning at a point 112.5 feet southerly from the southerly line of Charming Avenue and extending southwesterly along the said southeasterly line of Lincoln Avenue for a distance of 77.65 feet, be changed from 20 feet to 18 feet. As the owner of this property ihishes to start budiding operations, the Commission recommended that an ordinance providing for this change of setback line be eeopteu as an, emergency ordinance.
