The minutes of the meetings of June 27 .and : July 1, 1940, were 'approve:. Closing :Streets in Suhn side Addition .'his wa;s. the. time set for a 'hearing on the proposed closing of ;,;portions of 'Rose Avenue, Portage Avenue and Second Street :n : a,cco'rdance with Resolution of Intention No. 1286. The . affidavit; of blication of the resolution of intention and the affidavit of posting notices of public improvement were received' and placed on file. No: written protests against the proposed work were relelved: and there was no one present who wished to address the Cb enci.l; in; regard to this . matter. The hearing was declared closed;, Resolution No. 1287 ordering the closing of portions of Rose' Avenue,- Portage Avenue and Second Street was read, and on =motion of` Bentrott and Reed, was adopted lay unanimous vote on roll call. A. grant of easement along Portage Avenue for utility and storm sewer purposes was presented from the . Sutter Packing • Cons**. On motion of . Wood and lioy, a' resolution accepting this grant of easement was adopted by unanimous vote on roll call. Harold,: Anderson, Deputy City Engineer, informing the Council that the Union Paving Company, tae . successful bidder on the -first portion of the work in connection with the El Camino Real -University Avenue grade separation, `project, :have requested permission to haul find: material. over :Embarcadero_ Road from El. Camino Real to the Esyshore Highway,. as outlined ;by the,: Division of °Highways Specifications, which provides' that : the excavated material shall be disposed . of on the-Bayshore Highway south of E absrcadero Road. Attention. was directed , to the present city ordinance which does not permit trucking over that portion of Embarcadero Road between Newell Road and, Fulton Street. It was suggested by the Deputy City ngineer that the Council temporarily rescind the portion of the ;trucking ordinance applying to Embarcadero Road. Re pointed :out" 'that -,this " matter' is brought before, the " Council as an emergency matter and;' has not had consideration, by beards or comittees. After discussion, it vas< movedby Mrs. Merner, and seconded. by Ray, , that an emergency ordinance be adopted repealing the present trucking ordinance in curd to Rnibarcadero Road, such ordinance to be effective for the time :necessary to take 'care' :'of- this ,situation. Ordinance No. .827, amending Section 2336 of Codified ;Ordinance No. 4 ' by .repealing Paragraph 6 .thereof, which designated Rmbarcadera . Road between Newell Road and.. Fulton Street at3 a rest:rictedtraffic street, was adopted as 8.11 emergency ordinance by the. unantious vote of a11councilmen: present at thee: time of the roll call. Service Stations in Consnercial District The proposed ordinance, previously, recommended by the Planning Commission, amending Paragraph . 8 of Section 1005 of the Zoning Ordinance to provide that garages and service stations in the commercialdistri.ct shall be permitted only southwesterly from a line midway :between Ramona and Ea Zerson Streets, was presented for second reading. A motion was made by Mrs. Merner, seconded by Reed, that the. ;ordinance be adopted. Councilman Thomas expressed opposition to the ordinance on the grounds <that it is discriminatory inatory and is intended to give one property owner permission to utilize his property for a service :station. Councilman Cypher, chairman of the Planning Commission,, pointed: out that: the Planning Commission was divided in its views on this question, It was his opinion that if the Emerson Street line is . not :justified then the restrictions in the entire < commercial district should be eliminated, but if the _ present , ordinance is , sound it should be adhered to. - Mrs. Merner expressed. the view; that the present restrictions are unreasonable and that the proposed ordinance is a step in the right direction. Mr.: Tho ts objected to the ordinance on the grounds that it involves spot zoning.
