Street --Paving Program (Improvement Flans No. kl-2) A public hearing in accordance with Resolution of Intention 3`To. 1322.. was held by the Council at its last meeting on April - ]..tl ... -T`t a protests received :at that tin 6 were referred to Committee No. 1 for study and -report. Two petitions were received, one containing thirty- two signatures of property owners protesting against the paving of Webster ': treet from Santa -Rita Avenue to Oregon Avenue, and one containing sixty -'six - signatures of` property owners protesting - : against - the---.paviing of California 'Avenue from Alma Street to Middle- ;field Road. The Mayor explained that, although it was not the time - for a -public. -hearing, 'rofessor- Ramer- D. Fagan, 2190 Webster Street, ;had been.granted an'opportu'ity to present the -attitude of the protesting property , owners on -Webster Street and California Avenue. • Professor-yFagan Qtated-that there was a decided majority j of -property owners on' these�wo7--streets represented- by these peti- tions., Re -believed the Council _.would like' to --be• guided by the - present feeling as opposed to the pre -nationals -defense sentiment. toward- the ,-project .:., In this connection- - he Called attention to the news from Waehingtot egarding the proposed federal tax -as compared - ;with -that of the -year, ;193$. - It - was, the feeling of- the petitioners xthat since -,a large number of- the. property. owners` on Webster Street. and.: California..Avenue - would like the- paving postponed that it E seems entirely logical in •certain areas, where paving is really , necessary, that, the Paves might be done -but, in line with coopera-- ? tyon of s, municipality with_ --the federalprogram„ it seems that a - - s, non -defense - program should be kept to a - minimum. Professor ..Fagan - believed that -the City could go through a national emergency without street pav; ng.- -- Councilman Thomas, Chairman o.f.Committee-No. 1, -reported that the committee-had.met and- weresomewhat nonplused by -the late Filing of petitions; that - they had not had an opportunity to tabulate -these petitions to determine just whet the percent of --;protests-was. :The committee recognizes that these petitions _have no legal -standing,. however, the committee was not of a -single mind sa far as the: recommendation to'the Council -.regarding -.the overruling of protests. Attorney suggesting 5 .made to cover subscription that an appropriation of $2.00 be for the -current calendar -year beginning January 1, 1941, to a ]IA MUnicipal Lair Journal and Report Series arid s. 'Research and General Information :service. In his opinionliis is a very , vorth while ,:service from the standpoint of the city. The- City Attorney stated that he had been informed by the Auditor that there , was sufficient money in the Legal Division Equipment Account (118.99) to take care of the cost of this subscription and that an _additional appropriation would not be necessary. The City Attorney vas, authorized to make this sub- scription, the cost of $25.00 to be paid out of Account 118-99, Equipment Claim for Personal Injuries — A. claim vas presented by. Henry W. Binds of San Francisco for $107750.00 for injuries _:and damage to his car resulting from a collision with Miss Rilla M. Wyckoff's car on the Bayshore Highway near . Moffett Field on February 20, 1941. The City Attorney advised that there. is no liability upon the City whatsoever., because Miss Wyckoff, then Welfare Officer, was on personal business :and driving her own car at the time of the collision. He therefore advised that the claim be denied. On motion : of 'Molts and Cacbel the claim of Henry W. Hinds was denied. Adjournment rnent Upon motion of 'Thoits and Goddard, the Council adjourned to meet at 7:.30 P.M., Mousy, May 5, 1941, in the City Hall, to give further consideration to the .street paving . program and for the purpose of passtbg the :election proclamation ordinance . for the general municipal election to ..,be held on May 13th.
