Project 59-10, Sanitary Sewers 'aothalls Annexation No. 2 Thiswas the time set for hearing on Resolution No. 3230 ' of Preliminary Determination and of Intention, adopted June 27, 1960, for the construction of -sanitary sewer' mains in portions of Foothills No. 2 area. The City Manager stated that the Engineer- ing. Department has had many requests for sewers in that area, . and the best way to find out the interest of the property owners was to begin : a project. He noted that the County Health Department had advised the City.. Engineer that they consider septic tanks as temporary, and that eventually they would require that all the. north County area be severed. He advised that part of the area involved is developed and part; is' undeveloped; that it is appropriate for the Councilto determine; . after the hearing, whether it is in the best interests of the community and the people in the area to require the installation of sewers. he Mayor read a statement advising that the purposeof the heartngas alto determi ne whether the public convenience and necessity_in general.require the proposed sewer project; and b) to"fully: hear any and. all -protests. or endorsements of the project from property owners directly concerned, aar d from the protests and' endorsements •and from "the testimony of the city adrnindstzative staff, to determine whether the properties within the assessment district will be benefited'by the proposed, improvements and whether the assessments ::have been spread in accordance with such benefits. Testimony; and a report were submitted by the City _Engineer, with information on- the; three assessment areas, the basis of assessment' and the estimated costs. A naa}nshowing the three areas involved was displayed. The parcels whose owners' had filed protests by this; afternoon were marked on the map. Additional written proteets :tiled. just before this meeting started. had 'not been marked. It was stated for the record that letters favoring .the project have been received from the following property owners: Ralph W. Franks, 4243 Manuela Avenue; Mrs. Norma. Hansen, 4169 Oak 'Hill Drive; and Miss.Nelle Barney, Miss Lorene Barney, Mr and 'Mrs L. Parr and Mrs.;.; Rose Madden, 4166 Oak Hill Drive. A petition of protest filed this morning by Mrs..;. Helen M. Gualtieri,` 4284 Manuela Avenue, contained; 56 names representing ownerahip of 28 parcels, in Area No. 3. There had also been received a:letter of ;protest from Catherine H. Walsh and Ne1h Walsh of San Francisco, :owners of one acre on Manuela Avenue. Another petition":filed this evening by John Donegan, attorney, contained 24 signaturesof owners of 12 parcelsof property in Area NO. 2. The hearing was declared, open. Mr. Calvin. Gunn, attorney, 333 Hamilton Avenue,; Palo Alto:, addressed the .Council stating that he represented 58 home owners in Area No. 3 who are apposed to the project; that theyfeel the cost is exorbitant and disproportionate .to any possible benefit to the property. He pointed. out that some of the people have installed septic tanks less than a year ago,.. and feel that their present system is adequate. Mr. Jahn- Donegan, attorney, "531 Cowper Street, Palo. Alto, saidherepresented' about_ .25 home owners in Area .No. 2 which' has the highest proposed assessment, $.2790.00 per acre. He spoke in protest to:the project and asked that Area No. 2 be deleted. Mr. Donegan noted that most.: of the land in that area -is already developed, and -pointed out that the proposed expressway, might encroach or. the sewer line. Others who spoke in protest to, the project were : Mrs. Mary -Abrahamson, 450 Los Altos Avenue, Los Altos, owner of property in Area No 2; Chester Krebs, 4331 Miranda • Avenue, Area No. 2; Mrs. Gertrude Owler, Area No. 3, 4153, Oak Hill;' Drive; John Weakland, 4195 Oak. Hill Drive, Area No. 3; and Allan Reid, 880- Miranda Green, Area No. 2. All felt that thee. cost is too -high and thattheirpresent system is adequate.. Several property owners spoke in favor of the project, including. John J. Prusnaack, Miranda; Avenue;. Edward Chamberlain, 877 Moana Court; Joseph Neff; 851 Moana, Court; Ernest Mayer, 850 Moana.,Court; all in Area No:. 2; and Ralph Franks, owner of property on Manuela Avenue an: Area No. 3y. " These property owner 8, some of; whom-sish: to develop their properties. urged that the sewers be constructed as they felt sewer service is essential and they are willing to pay the necessary costs. Some "were owners of new -homes and wished to connect with city sewers. Street Underground Electric Utilities This was the time for hearing on Resolution No. 3237 of Preliminary Determination and of Intention, adopted July 11, 1960, for the construction ofunderground electric utilities to serve The Palo Alto apartment project at -'101 Alma Street. A written petition was received from. Jacobsen & Knapp, owners of the property affected, requesting that the improvements be undertaken at the earliest possible time, and advising that in. • order to expedite the project the following are waived: a) the taking of proceedings under Division 4 of the Streets and Highways Code in in regard thereto; b) Any right which they may have that the work be let to the lowest responsible bidder, and the undersigned„ hereby consents to the performance of the work by the City without calling, for bids; and c) Any and all irregularities which may arise during the course of conduct of said proceedings or issuance of said bonds.
