date at 7: 30 P =1u1 , pursuant to the following call issued by Mayor
Porter .
"As: Mayor of, the City of Palo Alto, T hereby call a
special: meeting of the City Council of the City of
Palo Alto to be held at the hour of 7:30 P.M. on Monday
June 6 1960,?.;in.the Council Chambers of the City. Hall,
1313 Newell Road, Palo Alto, California, for the;
purpose .of considering an allocation of funds to the
proposed San Antonio Road Grade Separation Project.
"The City Clerk is directed to send a notice of this
meeting to each member of the. City Council and to
enter this order in the minutes of said special meeting.
Vice Mayor Evans presided and roll call was as follows:
Present: Ball, Byxbee:, Davis, Evans, Giffin, Haight,
Marshall, Navis, Rodgers, Stephens, Woodward,
Zweng.
Absent: Bishop, Mitchell, Porter.
an Antonio Road Grade Scar ation Project_
The City Manager advised that since the last Council
meeting when -the proposal £or allocation of funds for the San Antonio.
Road grade rseparation ;project was brought to the Council'a attention
and he was instructed to negotiate further, the staff has reviewed
the matter and,'discussed conditions of the proposed agreement with
officials -of the City of Mountain View. The City Manager presented
and reviewed the various plans which had been considered for the
grade separation, and the' plan which has been recon-imended by the
engineers and by the City of Mountain View which provides for an, ..
overpass over the Southern' Pacific railroad and Alma Street.
Mr. ;James Meyer of De Leuw, Cather & Company,
-which prepared the plans for the project,waspresent and answered
questions regarding the plan, and: discussed with council members
the advantages of; an overpass rn this situation: instead of an underpass.
He advised that expense and time of construction were two coznsidera_ ..
tions which resulted in the decision for an overpass, which is less'
+ expensive and would take less tirne to build.
It was ;pointed out by. the. City Manager that the plans'
presented .this evening are not the detailed final plans which are yet.

;per cent of :the costtoile is; to be ;contributed by the Southern Pacific-
Company, and ,that one-half o f the balance or approximately 45 Per
,cent of the total cosh is to be financed by -State fends, that the
remaining $900,000'is propoa;ed to. be allocated as follows:
iCity of Los Altos. $15,000; City of Palo Alto, .$100, 000; Santa -Clara
:'County, $585e000; and City of Mountain View, $200,000 more or less..

It was reported, that Santa Clara County and the cities of
Los Altos and Mountain :view have taken action to approve the alloca-
tion of funds as proposed:
The City Manager and City Attorney reviewed the pro-
visions of the proposed agreement which would be entered into ,with,
the City of • MountainView, City of Los Altos and Santa Clara County.:
The agreement` provides that the plans and specifications are to be
submitted; to all parties for their approval. It would also'provide
that the contribution from the City of Palo Alto would be made in
two equal, payments of $50, 000 each, the first to be made within six
months' after authorization of State funds by the State Department.

The City ;Manager advised that the staff feels that in this situation
a relocation» of the boundary: lines is in order. He suggested that
the section of Alma Street north of San Antonio Road, now under
the jurisdiction of Santa, Clara 'County, be -taken into Palo Alto and
become the ;responsibility,of- the City. It was recommended by the
staff that. land presently within:,the city limits of Palo Alto which
has to' be acquired for=: the project; a parcel of approximately five } '
acres,: be relinquished by the City of Palo Alto and annexed to the
City of Mountain: sView 'so that the entire project would be in Mountain
View: and its Maintenance. .beunder one jurisdiction.' The City
Attorney advised that the agreement between the cities Would provide
that upon 'cornpletzon: of the ;construction Of the grade separation, such
propertywhichhad`been .acquired `for public use and which was -no,
;longer , reQuired.for the project Would be sold at a price subject to
the approval' of all parties and the proceeds'' derived from the: sale
of the;property, after -deduction of expenses, would be divided among
the parties concerned in proportion to the amounts they had
contributed.
Attention was called to the hearing, scheduled to be held
by the Public Utilities 'Commission on June 13, 1960, on the
application of the, City; of Mountain View for ,an order authorizing
the construction= of the grade separation, and the investigation' .to
determine whether such grade separation should be constructed
and if ',so, the proportions in which the expense of constructing and
mainta:ning'the project should be`divide.d among the various public
agencies. The City Attorney =advised that officials of Mountain View
had requested a'continuance of the hearing but that the PUC Examiner
had not agreed to continue the hearing but stated that if a stimulation:
is -entered: into the record by all: parties that there is a need for the.
:overpass', that the plan'zs generally acceptable,' that there io an
allocation of costs on:an agreed.basis, and that the formal agreement
will be executed ;wzthin a definite- stated period of time, then he
would adjourn the, heading to, a later date pending submission' of the
agreement.
It was moved by Marshall, seconded by Navis, that the
Council authorize the City:Attorney to so stipulate at the hearing,
and that the agreement with:the City of Mountain View, City of ,Las,
Altos: and County of .regarding the project and allocation.

Councilman Zweng asked if it would be appropriate to
' include in the agreement a:;provision. inregard to landscapingof
the ;overpass, ;The City Manager advised that the services of
Mr. Robert Royston have been retained to prepare the landscaping
plane. He pointed out that this ;will. be a part ofthe plans and
specifications for the entire project which will be submitted to the
Council laterfor approval.
Councilman Davis expressed the opinion that there could
be a more. equitable distribution of costs among the communities
which use the crossing; he thought that the contribution of L.os Altos
is sxalland noted that there is no contribution whatever from Los
Altos Hills. The City Manager advised that a determination as to
whether the cities concerned"s-hould pay a greater share would have
to be resolved Eby the Public Utilities Conunieaion, and that Los
Altos has indicated that if they are required to pay more they would
appeal such a;.deciaion; that any change in allocations of coat now
would have"to be resolved by the Public;. Utilities Conerniaeion and
would result in a delay that if the project is delayed beyond October
the State funds would no .longer be available.
The motion to authorize the stipulation to be presented
to the:. Public Utilities Corrimission on June 13, 1960 and to approve.
the proposed agreement relative to the San Antonio Road Grade
Separation Project was carried by voice vote, Haight not voting on
the motion.
The meeting was declared adjourned at 8:45 P.M.
