The Council of the City of Palo Alto rnet in regular
session on this date at 7:30 p.m., with Mayor Haight presiding.

The minutes of the meeting of July 10, 1961 were
approved as distributed.
Oregon -Page Mill :Expres,.s,way
The Mayor announced that the special order of the day was
the presentation by County officials of the proposed program and plans
for the Oregon -Page Mill Expressway.
He acknowledged receipt of
a certified copy :of,aresolution :passed by the Santa Clara County
Board of Supervisors declaring Oregon Avenue and a portion of Page
Mill Road to 'oe a County Highway, and also receipt of a proposed
expressway agreement between the County of Santa, Clara and City
of Palo Alto.
Before opening the presentation and discussion of the
project, the Mayor reviewedbriefly the historical background of
Oregon Avenue which has been designated as a major thoroughfare
for many years; He quoted excerpts from the 1955 Interim General
Plan in regard to Oregon Avenue as the logical thoroughfare for
cross-town traffic. The Mayor called attention to the formulation
of a county -wide road systesri by the Santa Cla., a County Trafficways
Committee, the construction of the Oregon -Page Mill grade separa-
tion, and the approval by the voters in March, 1961 of a bond issue'
for an expressways program, with the Oregon -Page Mill expressway
being given top priority in the program. Reference was also, made
to plans of the State Division of Highways for an interchange at
Oregon Avenue and 13arshore Freeway and to the study now being
made by the State for an interchange at Page Iv;ill Road and El Camino
Real.
The Mayor acknowledged receipt of many letters and cards
from citizens both for arxd against the project, advising that all
conz:nunications'will,oe made available to all members of the Council.
He also acknowledgedj, receipt of a letter and suggested alternate plan
frorn the California Avenue Area Development Association, and a
petition from residents along Waverley Street favoring the closing of
Waverley to cross traffic as, provided in the County plan.
The Mayor suggestea that the Council proceed in the
following manner: 1) allow the representative;; of Santa Clara County to
make a full presentation of their proposal; 2) have the City staff
report on alternatives, as directed; and 3) hear from residents
interested in the project. He also suggested that council inembers
withhold any questions or statements while the presentations are
being made.
Mr. Howard; Campen, County Executive, made some
remarks before introducing; speakers to make the presentation for
the County. He stated that the County staff and the Board of Super-
visors have no intention of forcing any project on the people of
Palo Alto.;; He explained the County's position in the overallprogram;
pointing out that the Oregon -Page': Mill Expressway was included in
the program at the request of the. Trafficways Committee and the
City Council of Palo Alto, arid that the project achieved No. 1
priority in the $70.000,000 bond issue. Mr. Campen then referred
to the County Expressway .Policy Resolution as recommended by. the
Trafficways Committee and adopted by the Board of Supervisors in
December, 1960. He sur marized the provisions of the resolution;
and advised thatit would be the intention of the Board of Supervisors
to adhere to the policy as defined in the resolution.
With regard to the question of speed limits which has
been raised, Mr. Campen stated that while Oregon Avenue would
become a County highway for purposes of construction and
maintenance, the City of Palo Alto would determine the speed limits
andit would be the responsibility of the Palo Alto Police Department
to enforce the speed limit;; on the expressway. Mr. Campen
pointed out that Oregon Avenue would not become a County highway
until so designated by the City Council by an appropriate resolution
and that the County's jurisdiction would not start until the City
Council approves the project He advised that the County is
desirous of resolving the problems so that the overall program can
proceed; that any delay increases the acquisition and construction
costs, and that he hoped the Council will make a decision within a
reasonable time in favor of the project.
Mr. Campen 'called on Councilman George Starbird of
San Jose to make some remarks. Mr. Starbird is Chairman of the
Santa Clara County Trafficways Committee which is composed of
representatives of, all cities, in the County. He discussed briefly.
the trafficways program to be financed by bond funds and the need
for early action so that the program may go forward.
Mr. Camper. then introduced Mr. James Pott, Assistant
Director of Public Works for', Santa Clara County, who made the
presentation of the project report and the expressway plans which
had been on display in the council chambers this afternoon for
inspection by the public. Mr. Pott emphasized that this is a stage
project, proposed to eliminate the existing traffic condition between
El Camino Real, and the Bayshore Preeway. He outlined briefly the
program as follows:' The expressway would have limited access to
Alma, Middlefield, Lours, Bayshore and El Camino; there would
be signals at Middlefield and at Louis with provision for turning
movements; there would be two-way frontage roads with parking
on the north side of Oregon, except for a small portion which would
have a one-way frontage road; the only new lighting would be at
certain intersections for the safety of pedestrians; an interim
connection is propo'ed at Bayshore Highway with the knowledge that
the State is making a study of interchange facilities at Oregon and
Bayshore; that if the plan is approved, the State Highway Cornnaission
would be urged to construct an interchange at El Camino and Page
Mill Road, which would probably be a joint local -state project;
chain link fencingis proposed along Oregon because the County feels
it is required for the protection 'of adjacent property owners; they
feel the fence need not be a psychological barrier, only a safety
barrier; there would be a pedestrian walkway between Greer Road

Mr. Kirke W. Comstock, 2470 Greer Road, coordinating
spokesman for several citizens' associations, addressed the Council
as' the first one of several speakers for various organizations who
oppose the expressway. He stated that they feel Oregon Avenue is
sai:isfactory as it is at present, but complained that the speed laws:
are not being enforced. He objected to any increase in speed limits,
if an expressway is built, and to mercury vapor lighting,

Avenue, ,ead a statement and presented a petition which he said
contained 802 signatures of residents who oppose the proposed
cxp;-essway for the following reasons: 1) it will be difficult for
people living south of Oregon Avenue tovisit the public library,
Community Centex, Rinconada Park and other public facilities north
of Oregon; 2) hundreds of families would be prevented from easily
visiting their neighborhood retail facilities, the Midtown Shopping -
Center on Middlefield Roaci a.nd the Emb Lrcadero Shopping Centex;;
3) many adults and children on either side of Oregon will be cut off
from, ready access to local churches, parks and other community
fac.li,ties; and 4) the expressway would split the community in two
and dOwntown Palo Alto would be almost inaccessible to people living
south of "Oregon Avenue. Mr. Florant urged that the Council eject
the proposal of the County for the expressway.
Mr. Leo•Kirby, 944 Dennis Drive, told the Council that
the expressway would result in more traffic on Middlefield and Louis
Roads,',, and this would be a hazard to school children attending the
schools on these streets. He urged the Council to make a policy
decision, on the matter.
Mr. J. Henry Moore, a resident of Green Acres No. 2,
spoke as', representative of the Greer: Acres Homeowners Association,
advising .that their board had voted to go on record in opposition to
the Oregon Expr,ssw.ay; that they felt the expressway should go
around the city,,;and%.not through it, and urged the Co,tYicil toconsider
Willow Road and San A±sto::ir,- Road. Mr. Moore stated that the
Green Acres group feel that the improvement to Oregon Avenue
should be isimilar; to the ^xi;sting Charleston Road.
Mr. Dave Davidson, •2424 Burnham Way, spoke of the
5000 post cards distributed to resident- by opponents of the express-
way. project. He urged. the Council to plan for 'the development of
the city as -a residential community and to reject the expressway -plan,
Mr. Jaz:nes H. tone, 365 Lincoln Avenue, summarized •
the remark. of the foregoing. speakers and stated that an expressway
is incompatible with the goals of the citizens and further alternatives
should be considered in that light.
IN r. John F. Porter, 547 Hilbar Lane, told the Council.
that -recently, citizens in th.e area north of Oregon Avenue formed an. -
organization called the Northern Palo Alto Citizens Committee:
that they are opposed to:,the expressway project for the reason that
they feel it will cut •the city in two and will destroy the residential
character:of the .City.• 'He Urged the Council to reject the project in
its entirety.
Mi-. Charles Conley, 932 El Cajon Way, also spoke in
opposition.
Mr. Aaron Sargent. 606 Santa Rita Avenue, suggested
that the proposed plasm be .rejected or the matter be given fttrther
study. He thought,tha'. Oregon should not be any wider than
Embarcadero Road and that there shouldbe enough discussion of
the matter to find the right solution.
;Mr, Richard Pante11, 450 Lonna Verde Avenue, also
spoke in opposition and ,advised that he is not in favor of any
compromise plan.
The last .speaker for the opposition was Mr. Hideo
Furukawa, 2705 'Birch Street, a member of the Japanese Methodist
Church. at Page Mill and Birch„ who stated that if the church property
is acquired for ai expressv"ray he hoped the Council would assist
the church in finding anoth.E;r location.
Opportunitywas now given to people in favor of the
project to speak. Mr. John C. Beckett, 200 Coleridge Avenue,
Chairman of the County -Cities Highway Bond Committee for Palo
Alto, was the first speaker in favor of the proposed expressway
plan. He:. read a written statement which he filed, in behalf of the
Cornmittee,concer"ning their review of the factors involved in the
Oregon Expressway, project and the major points of consideration,
with .the following recommendations: 1) Oregon Avenue between
Alma and Bayshore'should be improved to provide for the recommended
four lanes of traffic which will be unimpeded by either left turns or
private driveway access. 2) Page Mill Road between the underpass
and El Camino should be similarly unproved, 3) The interchange
at Alma Street and Oregon Avenue should be unproved at this time
to the extent financially feasible. 4) The plans for development
should provide for parkway type landscaping consistent with city
policy.
Several other me_Mbc>rs of the County -Cities Highway Bonds
Committee spoke in favor of the project. Mr. Joseph Lawry,_ 535
N. California Avenue, told the Council that the final plans need not
be determined at this ti.ziie but urged that the policy to develop Oregon,
as an expressway be decided now so that the county and city staffs
could work cl the detailed plans. He called attention to the need
for an east-' est expressway to handle traffic generated from the
future development in the foothills. Mr. Lawry also noted that
property owners on the south side of Oregon Avenue, whose homes
will be taken when property is acquired for the expressway, are
anxious for the Council, to make a decision.
The next speaker was Prof. Clark H. Oglesby of
Stanford, a res.ider:t at 755 Cha,nnirig Avenue, who commented on.
standards for p,lann {g'.:nighways, and advised that the alternative
plants suggested will not be a solution to the problem; that the mere
widening of streets to carry heavy volume of traffic is no longer
used
Mr. William Foulis, 960 Matadero Avenue, assistant
to the president of the Automotive Safety Foundation, spoke in favor
of developing the Oregon Expressway, and said there should be
fencing or sorne protection for children if the expressway is built.
Mr. Foulis advised that the Citizens' Advisory Committee on
Traffic, of which he .was a member, included the Oregon expressway
in t,ieir recommendations.

A report was made by the City Manager relative to surplus
city property adjacent:. to the property of Mr. Don S. Sevy, with
frontage on parkBoulevard. The City Manager advised that the
staff recommends the offer of Mr. Sevy of $4,500.00 for this
property be not accepted, and °chit the staff be authorized to
negotiate with the abutting property owners for the sale of this
parcel of surplus property and report back to the Council at a later
date on, the results of such negotiations.
On moti-on of Woodward and Marshall, the recon xnendations
of the staff were adopted.

There was presented to the .Council a grant of easements
to tre. City by Stanford University for utilities to serve the foothills
area: An agreement in, connection with said easements was
submitted, and on notion of Woodward, duly seconded, the Mayor was
authorized to sign the agreement in behalf of the City.

A report was received from the City Attorney on the
claim filed by Royce Questois Holland in the amount of $75,000 for
asserteddamages for persoral injuries sustained when claimant
was arrested on 1viarch 24, ;1961. The City Attorney advised that
he had investigated the claim and finds that there is no liability on
the part of the City. J4e'therefore . recommended that the claim be
denied in its entirety.
On /notion of Byxbee and Marshall, the City Attorney's
report was accepted and the claim was denied in its entirety.

A xrquest was received from the Controller for approval
of an inter -fund loanfrom. the Capital Improvement Fund to the
Ca.liforr;ia Avenue District inprovemcr,t projects pending sale of
special district bonds: $25, 000 to Project 60-5 and $35, 000 to Project
60-8 On motion. of Porter, duly seconded, this inter -fungi loan was
authorized by unanimous voice vote.

The financial report of the Controller for June 1961 and
the fiscal year 1960.61 (before closing) was received and filed.
Councilman Rohrs reported that he had attended the last
Santa Clara County Water Comini;ssion meeting, as the Council's.
representative, when the subject for discussion was a 25 -cent water
tax proposed by the County;' Board of Supervisors to raise an
emergency water importation fund. Councilman Rohrs asked for
instructions from the Council as to how he should vote on this
quettion at the n.ext'meeting of the Water Commission.
It was moved by Byxbee, seconded and carried that the
Council recommend that the 2,5 -Cent water tax be rejected and that
the Council's represertati.•e On the Water Commission be instructed
to vote against such, tax'.
