The Council of the City of Palo Alto met in regular session
on this date at 7:30 p.m, with Mayor Ball presiding. Roll call as
follows
Present Ball, Bishop, Byxbe:., Davis, Evans, Giffin, Haight,
Marshall,: Mitchell, \avis, Porter, Rodgers, Stephens,
Woodward.
Absent:' Gweng.''
The ,minutes of the meeting of May 8, 1961, were
approved as; distributed.
Abandonment - Portion oE Southwood Drive
}
This was the'time and place set for the hearing on,,the
proposed abandonment of a portion of Southwood Drive. It was
stated for the record that an affidavit of publication of the notice of-
this hearing h'as been filed': .,
The City Manager.advised that the request for abandon-
ment was initiated, by a representative of an adjacent property owner;
that the rnatter.,has been investigated and the ;staff sees no re,,= son.
for continuing the right of way,' but that easements for utilities over
a portion of the'raght of way will be retained by the City and the
Telephone Company,
•the hearing was declared open. There being no one present
• who desired to address'the -Council, the 'aearii g was closed.
Resolution No, 3400 ordering the abandonment of a
portion of Southwood Drive was introduced, and on motion of Giffin
and Navis, was adopted by unanimous voice vote.

This ,wzi s the time and place set for hearing on Resolution
No. 3396 of Preliminary Determination a.rd of Intention to ,Hake
Changes and Modifications.to Project 60-8, said modifications being
to eliminate -certain parcels from the acquisition and improvement
program and to change the boundaries of the assessment district to .
exclude the property of the Wesley Methodist Church fronting on
Camt6ridge arid College Avenues.
The Mayor read a statement declaring the sole purpose
of the hearing is for the Council to determine whether the boundaries
of the district'should'be changed and whether certain parcels should'
be_ eliminated from the program. He stated that in considering the
matter of excluding the Church property, the Council must determine
whether or not this;propertywill be benefited by the proposed
acquisition and i,mprovernent; that in considering the elimination of
certain„,properties from the project, the Council rust determine .vhether
the entire district will be benefited by the acquisitions and improve-
ments remaining after the elimination of the two parcels under
consideration.

$54,90•0 based on an estimate of $1400.00 per parking, space.

modification, wa.s submitted by 'Kenneth I. Jones, of the firm of.

these proceedings. He advised that in holding this hearing, the -

Two letters from' opponents of the proposed change
were read: One • was a letter f:.: ore. Max and Mary Landau, owners
of a a portion of Lot I1., Paul Survey, Assessment Numbers 6759C;.:.,
67591 arid' ' 6759E, with an asdesscd valuation of S12, 940 00.
They 'Objected to;;the .ex":clusion of the Wesley Methodist. Church from;
the di'S„rict, stating they' felt the Church has more need for parkihg.

Mr. Spencer Mated that his organization believe that their property

Mrs Kaar7. Bledsoe, attorney. representing, the Vvestey Methodist,
Church, addressed the Cou,r_c;i.l, stressing the point that Project
60-8 'provides for the :estal,,lishr~ent of ;, new district for additional
off-street parking, and c rgirat the Coui:c; 1 to fix the boundaries
of'the district so that the Church will not be inc'.uded. Mr. Bledsoe
.advised that there would 'be .a heavy 1iranciai o rden on the Church
if it is included in' the distri_ct. and told the C;ounc:l that there
would be no benefit to. the Church from the ar+t'iitiona; parking to
be provided.. by the new assessn-,ent district.
Mr. I.. M. Guslani', a property owner in the area,
told the Council he is sympathetic with the problem of the, Church,
but there are a large ru."nber'of;'property owners who do not want
to jeopardize the project and Who are desirous that it proceed ; s
proosed.
Mr. Donald :Hammond, a member of the Wesley
Methodist Church, commented that the Church uses s the existing
parking lot established by the former district only about 10 per cent
of the time: `k`spoke of the finzinCial problem of the Church if i1
should be required to be a part of the new district. and felt that
the amount they are paying on the present parking district bonds
more than compensates for the use of the parking lot.

It was moved by Mitchell and seconded that the matter be
referred to Committee No. 3 for consideration.
Councilman Haight suggested the City Attorney make a
brief presentation at this time relative to his opinion for the purpose
of elarifyin,g statements, which have been made.
Other councilmeribers agreed there should be an ex-
planation by the. City Attorney and discussion of the whole matter,
but felt this could be:done in committee. The motion to refer the
question to Committee'No. 3 was carried.
Hospital i3udietfor 1961-62
The p.ropci:ed budget of the Palo Alto -Stanford Hospital
Cen er for 1961-62 was.. officiallypresented to the Council at this
time, and at was announcedthat the budget is before, Committee No..
for consideration.

A report was made by the City Manager on thee bids
received on:viay 19, 1961 on. Project 60-5, California Avenue
Beautification, and on Project 60-7, California Avenue Street
Lighting..
The City Manager advisedthat the low bid of $67,735.00
from Gravelle and McConnell, Inca of Palo Alto on Project 60-5
exceeds the Engineer's Estimate by 12.6 per cent. He reported
that the low bid.on Project 60-7 for street lighting improvements 'and
for the electric :.l facilities for the California Avenue Area,
Beautification, Project 60-5, was submitted by Howard Electric
Company of`San'.Jose in the total amount on Items A and 3 of
$31::, 700.00
,:'The . Attorney advised that it will be necessary to hold
a further hearing on modi£icati�3n of the' project (Project 60-5) in
view Of the tact that the bidswere in excess of the Engineer's
Estimate. Resolution No. 3406 of IntYntiun to make changes' and.,
n'odifica ions; Project 60-5, setting hearing on the proposed
modification for Jule 12, 1961, was introduced, and on motion of
Porter, duly seconded, was passed by unanimous voice vote.
Action on the bids on both projects was deferred to the
r.4xt regular meeting on June 12e' 1961.

The City'' Manager• reported that the 1961 Street Deficiency
Report has been prepared by the City Engineer and filed in conformance
with the requirements of State Law, and is a revision and updating of
the .report filed last year. Copies of the report will be forwarded to
the State Division of Highways. The report contains an inventory and

description of the entire existing city street system as of June 1,
1961, inwentory`of critical primary arterial deficiencies, inventory
ofcritical, secondary arterial deficiencies, inventory of critical
secondary bridge and culvert deficiencies, all as of June 1, 1961,

Amendment to $ec r 17.2342 re Storage Tanks
The City Manager presented.a proposed ordinance
amending Subsection' b of Section 17.2342 of Codified Ordinance
No. 5 relative to underground storage tanks. He advised that
the relocation of service station facilities will be required in
connection with the- improvement of E1 Cairxino Real, and it is
advisable to amend the ;provisions of the ordinance to allow', storage.
tanks of greater capacity than permitted in the present ordinance.

Ordinance No. 202.7, changing the zoning of the property

bonds to, be issued to fiance the project shall be increased from
$71,673.32 4o $79,000.00, the increase being necessary because
of bids received on the project.
An explanation of the changes was made by the Assistant
City Mar. gee. ' It was reported that no written protests or
communications have been received. The hearing was declared open.

The City Manager reported that the plans for the Oregon
Expressway are being designed by Santa Clara County, and will
probably be presented' to the City Council at one of the July meetings;
that the Co;mty•has not yet submitted the ordinance or any plans to
the City.

A`letter 'was received from R. W. Madison, 3312 'averley,
Street, concerning the nuisance of barking dogs, and suggesting
consideration be given to, amending existing ordinances to provide

Proposal of The White House to Sub -lease Property
'A coMrnunication was received from Reginald H. Biggs,
President of The _White House of San Francisco, requesting that the
Council discuss with representatives of The White House the possi-
bility of the sub -leasing the property, known as El Camino Pa: -k,
located on El Camino Real across from the Stanford Shopping Center,
which the City of Palo 'Alto now leases £ro-r Stanford University,
as the site for a branch of their department store.
It was moved by Zweng, seconded and carried that the
staff be instructed to ,conduct negotiations with the White House and
report to Committee N'o. 3 at the earliest possible. date.

Notices of the proposed annexation of areas designated

The contract is for a ten-year, period commencing July 1, 1961.
Copies, of the proposed contract with specifications for
r fuse collection service and proposed‘rate schedules had been
sent to all courcil'members prior to the meeting, the documents
having - been amended to conform, to the recommendations made by
Committee No. '1.; Comparative information of th provisions in
the present contract and the proposed new contract was also
submitted.
Cpunciiman, Byxbee called attention to the proposed rate,
schedules; whichprovide for an increase in the basic residential,
rate for one, collection,per Week of two cans from $1.35 to $1.60,,
and for increases:.n.other service classifications and multiple.
collection charges He objectedto the rate increase and expressed
his opinion that the -C.t. could take over the garbage collection
service and do'the work at' about the same rate as now in effect.
Councilman Zweng d: agreeand asked for a statement as to the
argurnents':against 'the -City- entering into the garbage business.
The•As'sistant City .Manager advised that consideration
had beer givez-to'a Municipal operation and if the City had taken
it. over, a rate . of:'$1 50 h;. d been -suggested. He noted that the, staff'
had made a report some :thee ago to council members and Committee
No..1on'a reportlternative method's of =garbage and refuse collection,
and called attention to Personnel and other problems which would
arise from a'rnunicipal operation and to the fact that a capital
investment of.appreximately $300', 000 would be required.
In reply to a question from Councilman Haight,, informa
tion •on comparative rates in other cities was furnished, indicating
that the proposed�,rates compare favorably with those of other cities_
in this community for the same service.
The City Manager pointed out that this whole matter has
been discussed with the Council and committee for ::zany months;
that the present,c_ortract expires 3uly 1, 1961, and that the staff
feels a satisfactory -agreement has been worked out,. He advised that
the Council has never"'expressed any interest in having the City go''.
into the garbage collection business, and that the committee some
time ago had authorized the staff to negotiate a new contract with
the present contradtor. Iz reference to a suggestion from Councilman
Stephens that a"different rate, be considered for a one -can pickup,
the City Manager advised that the present system has been in effect
for many years; that minimum rates have been established for all
utilities, and that'it waS advisable to. continue the minimum rate for "
once -a-week collection of a maximum of two cans.
After discussion, it was .moved by Haight, seconded by
Marshall, and carried by majority voice vote that the contract as
submitted by Committee No. 1 be approved and that the Mayor be
authorized' to sign the contract in behalf of the City.

tion supervisor now, whose duty it would be to see that the contract
is enforced. He advised.. that the filling of this position would give
the City more control over the situation, and that the salary of this

Mrs. Towle. Chairman of the Planning Commission,
stated that the Commissior_n feels that the Council members should
receiveinformation and materials from he planners and should
£eel free to come to :arty of the work sessions with the planning
consultants.
Councilman Byxbee advised that it is his understanding
from talking with members of the. Planning Commission and other
members of the. Council that perhaps there has been some breakdown:
in the lines of corznmtinication between the City and the consultants;,
that it seemed to him that in the future it should be the resporsibiaty
of the Planning Commissionto sponsor all of the meetings relating
to the planning': studies, and that there should be control over the
sponsorship of meetings.
It was moved by Byxbee, seconded by Haight, and carried
that the consultants work through the Planning Commission.
The Mayor pointed out that all council members are
invited to attend any and all meetings of the consultants.
Amendment to Sec; 17.2342 re Storage Tanks
'Ordinance No. 2030 amending Subsection b. of Section
17.2342 of Codified Ordinance No. 5 relative to ur_dergroun d storage
tanks, was given second reading, and on motion of Haight and
Marshall, was adopted by unanimous voice vote.

A report was received from the City Attorney relative
to the claim of Beverly Shields in the sum of $75,000 for asserted
damages due to a sidewali. fall at the intersection of El Caznino. Real
and California. Avenue; The City Attorney advised that he had
investigated this c'_aii'ani finds that the Pacific Telephone Company,
not the City, was doing work in the area at the time and that the
location in question was within. the State Highway over which the
Cit', has no control. He recommended that the claim he denied in
its entirety.
On motion of Mitchell and Haight, the report of the City
Attorney was accepted and the claim was denied.

claim filed by.Lucille :G. Long in the sum of $26,500.00 for asserted
damages due to a sid.ewalk fall at Alina Street and Lytton Avenue.;
The City Attorney advised that he had investigated this claim throia:gh
the Police Department and had determined that there is no liability
on the part of the City:. He recommended that the claim be denied
in its entirety.
