Abandonment - Portion oE Southwood Drive } This was the'time and place set for the hearing on,,the proposed abandonment of a portion of Southwood Drive. It was stated for the record that an affidavit of publication of the notice of- this hearing h'as been filed': ., The City Manager.advised that the request for abandon- ment was initiated, by a representative of an adjacent property owner; that the rnatter.,has been investigated and the ;staff sees no re,,= son. for continuing the right of way,' but that easements for utilities over a portion of the'raght of way will be retained by the City and the Telephone Company, •the hearing was declared open. There being no one present • who desired to address'the -Council, the 'aearii g was closed. Resolution No, 3400 ordering the abandonment of a portion of Southwood Drive was introduced, and on motion of Giffin and Navis, was adopted by unanimous voice vote. Project 60-8, ,California ,tkvenue District di -Street arkmg_ 14 This ,wzi s the time and place set for hearing on Resolution No. 3396 of Preliminary Determination a.rd of Intention to ,Hake Changes and Modifications.to Project 60-8, said modifications being to eliminate -certain parcels from the acquisition and improvement program and to change the boundaries of the assessment district to . exclude the property of the Wesley Methodist Church fronting on Camt6ridge arid College Avenues. The Mayor read a statement declaring the sole purpose of the hearing is for the Council to determine whether the boundaries of the district'should'be changed and whether certain parcels should' be_ eliminated from the program. He stated that in considering the matter of excluding the Church property, the Council must determine whether or not this;propertywill be benefited by the proposed acquisition and i,mprovernent; that in considering the elimination of certain„,properties from the project, the Council rust determine .vhether the entire district will be benefited by the acquisitions and improve- ments remaining after the elimination of the two parcels under consideration. .n ekpla.rat•o'ri; of the proposed Modifications was gic en •by the Assistant City Manager, who presented information relaeste.d by the Council affecting the property of the Wesley Methodist Church, He advised that if the Church had not been included in the existing p,ar,king district, it would have been required to have 39 off-street: parking spaces (cane spa<_i;! for every ten seats in the. church), Which would have involved an expenditure of around $54,90•0 based on an estimate of $1400.00 per parking, space. The Assistant. City Manager further advised that there :s other property owned by the Church which is trot it upon at pre,ent • :)ut Which is large enough to accommodate a conimer `.at hui ding of around 8000 sq. f _ - t. in :1 ni'a, and .. such a 1J ll: ll:, ;1g w' e. and were subject to parking `r.cseltzi. x:: : ._, ,r z:c:ditioriai „r spaces would be required. Mr. Jove, pointed, out that. the. solefba is for ithe request of the- Church for-excitision from the.. project was' economic hardship resulting from ,a relatively high.. assessed valuation,. but. -presented evidence indicating that the Church property r:iiould.•r:.ot 1e excluded Simi:>ly because: it has 'a • • relatively high assessed-valua.t'ic.n. He advised that in the Present: 'state..of the record, a r. nurch'exclusion in, till.: auser•cc of protest - .would be improper but tega:l;,that-a church exclusion over pzote:r:t would render the' proceedings-vu',rivrable to attack. • There -was consi•dcrable° discussion regarding the, •legal. aspects of, the project, and it was, brought out that the; Project b0_S •proct3edir;gs involve the establishment of a new parking district • whose, boundaries as' proposed coincide with the: uou:::iaric:!5 of the former district. No written com, xxiunica'tions from proponents of the proposed c,.hangeswere -received. Two letters from' opponents of the proposed change were read: One • was a letter f:.: ore. Mrs Kaar7. Mr. Bledsoe .advised that there would 'be .a heavy 1iranciai o rden on the Church if it is included in' the distri_ct. and told the C;ounc:l that there would be no benefit to. the Church from the ar+t'iitiona; parking to be provided.. by the new assessn-,ent district. Mr. I.. M. Mr. Donald :Hammond, a member of the Wesley Methodist Church, commented that the Church uses s the existing parking lot established by the former district only about 10 per cent of the time: `k`spoke of the finzinCial problem of the Church if i1 should be required to be a part of the new district. and felt that the amount they are paying on the present parking district bonds more than compensates for the use of the parking lot.
