July 22, 1963
The Council of the City of Palo Alto met in regular session on
this date. at 7.:40 p.m. , immediately after the Board of Equalization
meeting.; with Mayor.: Cresap presiding.
Present;.
Absent:
Arnold, Beahrs., Byxbee, Comstock, Cooley,
Cresap, Debs, Dias, Flint, Rodgers, Rohrs,
Rus, Woodward, Zweng. (Councilman Porter
,arrived at 7:50 p.m, and was counted as present.)
None:
The minutes of,'the .meeting of July 8, 1963 were approved as
distributed.
A recommendation was received from the Committee ofthe
Whole that the Citybudget for the, fiscal year 1963-64 be submitted to
the. Council.
A motion was made by Byxbee, seconded by Woodward, that the
budget be adopted as- _submitted.
Discussion of several items in the budget followed, and an
amendment to the motion was made by Comstock, seconded by Debs, that
the item of $2, 500 Included in the amount budgeted for the Charnber of
Commerce for convention expense be, deleted.
John C. Beckett, 200 Coleridge Avenue, a director of the: Palo:; ,
Alto Chamber of. Commerce, explained to the Counc.t what the proposed.`
budget item represented and urged that it be allowed.
The amendment to the motion was defeated by the following roll
call vote:

Noes: Arnold, Byxbee, Cooley, Cresap, Dias, Porter,
Rodgers, Rohrs, Rus, Woodward, Zweng.
A. motion made by Debs to strike from the budget the item of
$202,000 for extension: of electrical utilities into the foothills with the
idea that it be added to an assessment district died for lack of a
second;
A motion by Debs, seconded by Flint, to refer the budget to the
Committee of the Whole was lost by a voice vote.
The motion to adopt the budget as submitted was carried': by
the following, roll call vote:

On motion by, Debs, duly seconded, Ordinance No. 2154
entitled "Ordinance of the Council of the City of Palo Alto Amending
the 'Official Fire Zone Map of the City of Palo Alto, California
(Section 1601 of the Uniform. Building Code) by Changing the Property
Known as 528 Arastradero Road and 4186 El Camino Real from; Fire
Zone No. 3 to Fire Zone No: 2" was introduced for second reading
and was adopted by a unanimous vote.
.Setback Ordinance (Sherman Avlenue )
On motion by Debs, duly seconded. Ordinance No. 2155
entitled "Ordinance of the Council of the City of Palo Alto Amending
Ordinance No 1896, the Setback Ordinance, by Amending Setbacks on
Sherxnan Avenue" was introduced for second reading , and waeadopted
by a unanimous vote.
Zonix :Cardnanze Aznend,ment
On motion by Zweng, seconded by Rohrs, Ordinance No. 2156
entitled. "Ordinance: of the Council of the City of Palo Alto Amending
Ordinance No. 1324, the Zoning Ordinance, by Amending Article 9A..10,
MinimumLot Requirements in Administrative -Research Districts'' was
introduced for second reading, and after discussion was adopted by a
majority vote, ' Debs and Flint voting against the adoption.
Zone a.a. e 2450 West Ba shore Road}
On motion made and; seconded, an ordinance entitled "Ordinance
of the Council of the City of Palo Alto Amending Section 3.02 of
Ordinance No. 1-324 the Zoning Ordinance, Changing the Zoning of
Certain Property Known as 2450 'West Bayshore Road from R-1 to
rt-3-G' was introduced for second reading.
A motion was made by Cooley and seconded that the matter of
rezoning of 2450 West Bayshore Road be referred to the staff and the
Planning Commission for further study.
In response to a question. by Planning Commission Chairman
Towle, the Mayor advised that it would be a. decision of the Planning
Commission as to whether or not another public hearing should be
iritia.t.ed on this matter.
Mr. Delano H. Large, 851 Southampton Drive, one of the
owners of the property, urged that there be no further delay on the
rezoning and requested that the Council take action.
,After further discussion of the matter, the motion to refer it
to the Planning' -Com'znission and staff was carried by the following roll
call vote

Flint, Porter, Woodward, Zweng.
Noes: Arnold, Cresap, Rodgers, Rohrs, Rus.
San Antonio Overpass
The City Manager advised that Mr. Bill Kelley of Hare; Brewer
& Kelley was present at the meeting to speak in behalf of his
firm's-
requestfor...signalizationof a proposed intersection on San Antonio Road •
justeastof theoverpass: Copies of the proposal had been distributed
to:each councilman. The requested signalized intersection',Aras.propose.d
to servea new shopping center.

Alto deny the previous request fo.. de -annexation and reaffirm its ,7uris-
diction over the property under discussion.
After a discussion on zoning, the Cite Manager advised that the
question of de -annexing the property to Mountain View was still under
negotiation and the main question for Council consideration at this time.,.
would be whether or not left turn moverr'ents and installation of a traffic
light would be authorized as requested. He also pointed out that: even.
though: the' property was de -annexed, the traffic signals would still be in
Palo Alto.
Traffic Engineer Parker explained possible effects of installation
of a traffic :signal, and after further discussion a motion was'rnade
by Zweng, seconded ;by. Woodward, to table the motion on the floor
regarding de -annexation until the traffic proposal made by Mr. Kelley
had been acted upon.
A motion was made by Plebs, duly seconded, to refer the traffic
proposal to the Corranittee of the Whole The znotion was lost by the
following roll call vote:

Oregon Avenue Expressway Plans
The Cit-y Manager advised that 'a copy of the expressway plans
for the Oregon :Avenue project had been forwarded by the Engineering'
Office of Santa Clara County, and were on file and available for
inspection in the City Clerk's office
lames '"..?>Pott, Assistant Director of the Department o' Public
Works for Santa Clara County, explained the expressway plans as pre-
pared by the County. He referred to a letter dated June 27, 1963 from
the County .Depar tznesnt of Public Works to City Engineer Witbeck, in
which twelve "deviations" from the Expressway Agreement between
the County and the City were explained.
Mr.. Pott:advised` that the County had prepared a proposed
modification for attachment as an exhibit to the original Expressway
Agreement; which' incorporated the proposed construction changes,`, and
requested that the Council approve the plans as modified, after a thorough
study. He mentioned that several of the changes in the plan were made
at the request of interested property owners in the area.
The proposed modifications to the plan, signalization and
other matters in connection with the expressway were discussed in
detail by the Council.
Mr. Douglas, Baylis, the landscape architect engaged by the
City to work with a citizens' group on plans for landscaping Oregon Ave-
nue, then made a pres entation to the Council of preliminary landscaping_
plans. He mentioned that the Chairman of the citizens' committee, Mrs.
Norton 11„ Thornton, had advised Mayor Cresap that the committee
unanimously recommended approval of the plans,
;After discussion, a motion was made by Woodward., seconded.
by Rodgers, to refer the County :expressway plans and the preliminary
landscaping plans to the. Committee of the Whole; that at the meeting or,
meetings of the Committee of the Whole, the City staff and thepublic be
given an opportunity to present comments, criticisms and suggestions;
that a copy of the prospectus mailed to the voters at the time of the
election` or :the Oregon Avenue; project be furnished to the Council by the
staff; and that nali'scale drawing, comparable in size to the ore
furnished to the Council on the landscaping plans, oe prepared by the
staff to show the proposed County plans. An amendment to tne motion,
proposed by Zweig, to'designa.te the Committer: -7f the Whole mee't'ing
as one it which public testimony will be heard, was accepted by
Woodviard.
Councilrnan'De'os moved to amend the motion to include a :re-
quest'that the County Department of Public Works, on or before the date
of hearing; by'the'Committee of the Whole, provide a plan drawn to
scale, :listing: alt the "deviations" and showing traffic signalization at
Greer, Brvart and Cowper_ The motion for amendment died for lack
of a, second.
The motion made by Woodward, as amended by Zweng, was
then carried by a, majority voice vote.

the Mayor was authorized and directed to execute a modification to the
-.. greeme;nt' with Pacific Telephone relative to an undivided interest in
60, replacement poles. It was noted this provision had been inadvert-
ently omitted 'from the'agreement.
Southern PacificEasement (Hansen 1,Vav)
Onrnotion made by Woodward, seconded and unanimously carried,
the Mayor was authorized and directed to execute an agreement for grant
of easement by Southern Pacific Company tinder the railroad spur line
adjacent to Hansen Nay: for the installation of street lighting conduit.

The Mayor announced that there are presently three activecitizens'.

Gordon Smith,." President of Palo Alto -Stanford Pospit7J Center,
w'elcorted the siggestion.of a citizens' committee on the hospital center
and suggested t:hat`the .cortnxnittee be charged with the fundamental pur-
pose of,re-examining the City's basic role andresponsibility as a
participating., partner:. in the center and make whatever recommendations
are deemed necessary regarding the basic role and responsibility. He
a:1.o suggested that one or more members of the Hospital Board be included
on the committee in order to facilitate the work and also to provide com-
munication and information. Mr. Smith assured the Mayor that he would
regaest the Hospital Board to provide staff help for the committee.
Councilman. Rohrs moved that the Ma,yoz• be authorized to appoint
a citizens advisory committee to re-evaluate the City's basic role,
participation and responsibility as a :partner in the Palo Alto -Stanford
Hospital Center. The motion was seconded by Byxbee and unanimously
carried.

Mr. Arnold. -added, that the working of his motion was developed as. a result
of conferences with Mrs. Towle and Mr. Arbuckle of the Planning Corn -
,mission and with the•Mayor. He stated that the plan line ordinance

referred.to would provide for proposed roadways.
The motion was:.seconded by Woodward, and after a discussion
. by the Council,• was -unanirn:ously carried.
Truck Ordinance
Councilman Rus announced that the sub -committee recently
appointed by Vice Mayor Woodward would hold a meeting in the Confer-
ence Room at the City Hall on Friday, July 26th at 30:30. He advised
thatthe meeting is not intended as a public hearing but that it is an open
meeting and anyone may attend who is interested in the truck ordinance.

A.`report was received from the City Attorney on a clairr, filed
on June 14, 1963 by John R. '. Williams, 71.1 Moreno Avenue, in the sun
of $20,50 asserting damage to_ a sewer line by tree roots. The City:,

How Board` Meetings.
Councilman Byxbee moved that the Council request the. City
representatives on the Hospital Board to include as a part of the agenda.

The motion was seconded by Debs and after discussion was
carried.
Committee of Wthe Whole System,
Councilman 7weng :roved that the Council continue the present'
system of Committee of the Whole until the first meeting in January,
1964: The motion was seconded by Arnold.
vice Mayor Woodward made a substitute motion that the
meetings of the. Committee of the Whole be continued and that the standing
committees ttees also be 'eactivateel, with the provision :than only members of
the standing committee be allowed, to vote at their meetings.
After .d,;scussion, the substitute motion was defeated by the
lowing roll 'call vote:

The original motion to continue the present Committee of the

Letters from the Branch tine Commuters Association of S.a:nta
Clara County, concerning Southern Pacific train schedule, and from
Virginia and Ann Huber regarding Projects No, 63-2 and No. 63-3 were
acknowledg:ed'`and ordered filed.
Encroachment Permit.
On. u otiori made. by, Debs, seconded by .,Byxbee, and unanimously
carried, a request from Murray M. Halwer for an encroachment per-
mit on a public utility easement, under Section 33.50 of the; Palo Alto
Municipal Code, and for abandonment of 5 feet of the said easement by
the City, was .referred to the City Engineer.

Notices of proposed annexations of territory to the City of
Mountain View known as Rock No. 6, Colony No, a 1, Avenida No.
2, Sierra Vi;xta No. 5 and Dana No. 1, were acknowledged and ordered
filed. It was noted that none of the annexations involve property con-
tiguous to Palo Alto.
There being no further business, the meeting adjourned at
