An example of the value of. similarly situated properties after
sewer and water services are available was given in the Project 59-1
area, being a sale of $12,'000 per acre.
Emmett Burns, at the request of Mr. Jones, verified that the
figures were accurate, and explained that the difference shown between
the $12, 000 per acre and the first portien borne by the Palo Alto School
District of $5, 900 per acre was a difference between the time when
there were no utilities and the time.after utilities were provided.
Mr. Jones t}'4n stated for the record that the material which
had been furnished to all the Council members, including the new
Councilmen, and which had been rraileci toall the property owners in
the proposed assessment district, consisting of a letter of May 10, 1963,
from the City Manager and City Engineer -- a narrative report, the
assessment roll, etc.. - was on file with the City Clerk and was a part
of the official record of the project, and was part of the record of
tonight's hearing for consideration by the Council.
The City Clerk advised that a written protest against the project,
had been filed by Dr. Russel Y. Lee, and that no other written protests
were received. In response to a sucs;ticn by the Mayor, Dr Lee
waived reading of the letter, stating that he would cover most of the
points orally.
Dr. Russel V. Lee, 630 Los Tr.:xncos Woods Road, Portoia Valley,
stated that he believed the proponents of the project should be heard
before those opposed. An order was made by Mayor Cresap that the
protestants should speak .first in regard to the matter and a motion to
appeal the ruling of the chair was made by Debs on the ground that this

the City Attorney, Mr.. Arnold agreed to withdraw his motion and dis-
cuss 'its exact format with. the City Attorney for presentation at the
adjourned nateting. on Tuesday, evening, July 9th, 1963.

The Mayor announced that the first order of business at.
this adjourried meeting was a continuation of Council consideration of
Project No. 62-8.
Councilman Arnold moved to reopen the hearing for the
purpose of hearing' additional evidence on the question of benefits,par-
ticularly to the Leeparcel and the City park, and to continue the hearing
and all'other matters in connection with the project to .August 12, 1963,
at 7:30 P.M. in the City Hall, Palo Alto, California, the time interval
being for the purpose of reviewing the testimony given at the hearing,
studying the alternative financing proposal discussed by the Assistant
City Manager,' investigating legal methods of relieving properties not
yet ready for development of the financial burden of the assessment
until they are ready and at the same time examining the feasibility
and logic'of the City pledging any future advance for this purpose, review-
ing the design arid location of the proposed sewer and water facilities
with relationship to the development standards for the area to be assessed,
in particular as to densities established in the Master Plan, and
reviewing existing and potential controls over development in hillside
areas.

After Council discussion, Arnold's :notion was seconded
by the Mayor.
Further discussion followed, Dr. Lee spoke to the Council,
and the City's legal responsibility on furnishing utilities was explained
by the City Attorney.

Councilman Flint proposed a substitute motion that the
matter of Project No.. 62-8, Foothills :\o. 3 Utilities Extension, be
held in abeyance until November 12, 1963; that a Citizens Committee,
composed of affected property owners, planners and other groups inter=
ested in the project study the problem and report back to the Council`
by November 12, 1963.; and that said committee in conjunction with the
Planning Department have a detailed plan drawn up'for the foothills
area, including all parts of the City uphill from Juniper o Serra
Boulevard to Skyline Boulevard and the surrounding planning area, said
plan to specifically cover the following areas: (1) park and recreational
potential, (2) flood control., (3). fire hazard, (4) traffic circulation and
highway engineering, (5) population densities, (6) public facilities.
and. (7) site and architectural design; that said study and planning must
be undertaken before the construction of any utilities .for the purpose
of duly assessing the true and total cost of development of the foothills
area to the City of Palo Alto as a whole and all consequences arising.
therefrom to said City and, furthermore, for the purpose of assessing
in a fair manner what portion of that cost should be borne by the affected
property owners.
The substitute motion was seconded by Comstock.
After further discussion, Woodward moved the previous
question. The motion was seconded and carried. The . substitute motion
proposed by Flint was defeated by the following roll call vote:

unanimously recommending approval of the application of Roller & Hapgood
for a change of district of property at 980 Middlefield Road from R -3-P,
R-3, and R-2 to P -C, with alternate parking layout "A" and with a 6 -foot
planter strip along the property line.
After explanation by the Planning Officer, an ordinance
entitled "Ordinance of the Council of the City of Palo Alto Amending
Section 3.02 of Ordinance. No. 1324, the Zoning Ordinance, Changing
R. -3-P, R-3 and R-2 to P -C" was introduced, and on motion made by
Byxbee, duly seconded, was accepted for first reading by a unanimous
voice vote.

A report was received from the Planning Commission
unanimously recommending approval of the application of A. Crawford
Greene, Jr. for a change of district of property at 528 Arastradero Road
and 4136 El Camino Real from R-5 to C -3-S, with a 6 -foot O -A district,
and also recommending: 'a change in the Fire Zone for this property from
Fire Zone No. 3 to Fire Zone No. 2.
The Planning Officer explained the proposed change of dis-
trict, and the following ordinances were introduced:

A report was received from the Plann,ing Commission
unanimously, recommending approval of a lot division appeal of Marjorie
Eaton, on property at 950 Old Trace Road. Portion of Lot 7, Br.iones
Partition, subject to furnishing evidence of payment of all. payable City
and County taxes.
The. Planning Officer explained the proposed lot division
and the City -Manager anager. advised the Council that if lot split applications
continue to be made in this area, it might be advisable to considerthe
establishrnent`of an assessment district for streets. He reminded them
that: the Planning Commission, in considering the application of George
Forrester some time ago, had made a r ecomm ndat ion that a road
system be established.
After discussion, a motion was made by Dias, seconded by
