Variance_ (_Y_alace_.Bxown_a<n&S9na) A report was received from the Planning Commission unanimously recommending approval of the variance appeal of Vance Brown and Sons for elimination of the required 20 -foot rear setback at 333 Sherman Avenue, but recommending that the three-story height limit be maintained. A motion was made by Zweng and seconded that the recommenda- tion of the Planning Commission for approval of this variance be upheld. Avenue Area A report was received£rom the Punning Cornmis'sion that it has reviewed the zoning, in the California Avenue area in accordance with the action of the Council on October 8; 1962, and unanimously recommends that the Council request the Santa Clara County Board of Supervisors to relocate proposed County parking and other facilities from the:. Mock bounded by Birch, Sherman, Ash and Grant, and that they consider the area south of the present Courthouse between Park, Grant, Birch, and 'Sheridan, in order not to reduce the potential tax base of the California. Avenue area assessment district. The Commission recommends, additionally, that the HDA apartment district in this area should be pro- tected froxn the intrusion of other uses since it is already a small area surrounded by non-residential uses. A report was also received from the Planning Commission con- cerning the rezoning application of California Lands Investment Company for a change of zone district from R-3 -P to C-2;FGM, or some other designation to permit construction of an office building for #.he'property at 2601-2655 Birch Street and 280-296 Sheridan Avenue. The Planning Commission in October, 1962 had unanimously recommended denial of this application. It was noted the two reports are interrelated and after discussion, a motion was made by Zweng, seconded and unanimously carried to refer the recommendation on the California Avenue area zoning, to the Com- mittee of the Whole for further consideration. He advised that meetings r had been held by representatives from the Boards of Super- visors of San Mateo County and. Santa Clara County, engineering staffs of the two counties, andrepresentativesfrom Stanford University; that another meeting is scheduled for July I7th, at which time it is hoped a determination can be made of what recommendations to make to the Corps of Engineers. Newell to the Board of Hospital Directors, to replace Horace M. Blinn who had resigned. Assessment Roll The report of the City Assessor was received, submitting the Assessment Roll for the fiscal year 1963-64 for the purpose of equalization. The Mayor advised that the Council, pursuant to the provisions of the Ad- ministrative Code, is required to meet as a Board of Equalization at 7:30 p.m.. on the fourth Monday in July, and that notice of such meeting must be published. The motion was seconded by Rohrs, who mentioned he felt this program could be supported through the Chamber of Commerce despite the fact that this organization in its letter had sug- gested the Ce nm naity Council make efforts to finance the publication on a self-help basis or by obtaining financial assistance from sorne of the clubs and organizations in Palo Alto. After a considerable discussion on legal questions involved and the possible establishment of a precedent in such matters, Mr. Linn Winterbotham, secretary -manager of the Chamber of Commerce, also spoke to the Council, stating arnong other things that participating in a program of this nature would also establish a precedent for the Chamber. After; further discussion by the Council, a motion to table the motion was made by Byxbee, seconded and carried by the following roll call vote: Ayes: Arnold, Byxbee, Dias, Marshall, Rodgers, Rus. The Assistant City Manager, in response to a question by Councilman Dias, advised that the staff has been meeting with property owners in the zone of interest of the proposed downtown improvement projects and stated that in accordance with instructions, the staff would have a report prepared for submission to the Committee of the Whole prior to the, public hearing by the Council on August 12th.
