City Hal, Palo !Vito, California' April 23, 1963 The Council of the City of Palo Alto met in regular session on this date at 7:30 p.m., Mayor Cresap presiding. Present: Arnold, Bishop, Cresap, Dabs, Dias, Marshall, Rodgers, Roars, Ras, Stephens. Absent: Byxbee; Porter, Woodward, Zvieng. Councilman. Dias .stated that the minutes of April 8, 1963 should be corrected to show that both she and Councilman Zweng were praesent,at'the meeting and voted on the first motion (Debs' motion to amend the minutes of March 25, 1963). Overtire Parkin The City Manager reviewed a request from Downtown Palo Alto, Inc. which`lia.d been referred by the Council to the staff for study, concerning an a.dd&tion of Section 19.179 on prolonged p, ohibited' or- overtime parking to the Municipal Code. He advised that the addition of this section would basically incorporate into the traffic ordinance a provision for multiple citations on overtime parking; that as a result: of the study, the staff did not believe such a provision would be jf stified at the present time. A request was acknowledged from Edward A. Mendell for re- hearing and reconsideration of his request for a moratorium. on use of a non -conforming, free-standing sign on Middlefield Road. Paul McCloskey, 800 Welch Road, an attorney, spoke to the Count i in behalf of Mr. Mendell and stated, among other things, that he beL.eved, denial of the moratorium presented a hardship case for his client; that his client leased the sign in the belief that, although it probably wasnon-coni'orming, it would be subject to the five-year moratorium provision of'the -Sign Ordinance; that it was true the letter-- ing on the sign in question had been changed, but the size had not been, and it seemed to hina that this would be an appropriate case to grant the moratorium. A /notion was made by Woodward and seconded by Marshall to deny the request for rehearing and reconsideration. A discussion between Mr. McCloskey and Assistant City Attorney Norton followed. The Assistant City Attorney pointed out that in his judgment the rzorato urn did not apply to Mr. Mendell; that the request, in effect, was to amend the ordinance only for Mr. Mendell. Further discussion ensued among the Council members and Woodward withdrew his motion. A motion was then made by Rohr;;, seconded by Stephens, 'to grant permission to Mr. Mendell to use the sign for the rzoratoriun- period. Councilman Rodgers stated he understood from the discussion the previous week that there is no authorization under the Sign Ordinance to. grant a moratorium' in tl:is case:; that it this is true and since theCouncil did pass the Ordinance, it was necessary to abide by it regardless of the hardship` claimed by this particular. 'person, The Mayor advised he would like to 'rear from City Attorney Michalski since he had been involved in the previous discussions. Councilman Rohrs withdrew his motion to grant permission, and moved' to defer action until the Council could hear from Mr. Michalski in regard' to it. The City Manger stated he would instruct the City Engineer to, withhold further action relative to destruction of the sign until after the, Council acts on Mr ivMendell's request. The notion.tc defer action was seconded and carried. Mayor Cresap requested the Council to meet in a closed personnel session immediately after adj nmert. 9:4S .p. m.
