The Count -it of the City of Pilo Alto met in regular session on
this date at .7:30 P.m., Mayor Hight presiding.
Present: Arrko1d, Bishop, Byxbee, Cresap, Plebs, Dias, Haight,
Marshall, Porter, Rodgers, Rohrs, Rt:.s, Stephens,
Woodward, Zweng .
The: minutesf the meeting of January 14, 1963 were approved as
distributed.
Mayor Haight addressed the Cour:e:il ar_d tendered his resignation
as Mayor, ,stating that it had been a great honor to serve ar.d represent the
City rs :Mayor acid thanking the Council members for their support and con-
fidence:during his'!'tenure: Ile stated he had been asked by the President
of Church. of Jesus C'tirist. of Latter Day Saints to accept a call in Europe
to preside `over -one ; of the missions; that he and his wife had accepted the
call. He believed it would be well to reorganize the Council at this time
in regard to'the office, of :Mayor, although he did not intend to resign from
the Council at this meeting. Tr: addition, he

have g ven their time; talent, and devotion: for the citizens of

The.' Vice :Mayor then; took' over the meeting and stated that a
motion would-be in -order to accept with regret the resignation of Mayor
Haight. A motion was Made by Arnold, ;,ec:on.ded by Zweng, and unanimously
carried, that':.the Council accepted with regret 'Mayo_- Haight's resignation.
The Vice Mayor reviewed briefly the population, growth of the City
andthe°number aria coniiplexity of City problems in connection with such
growth.` He felt attribute should be paid to Mayor Haight, who came on
the scene when the problems became so numerous: that the solution of
many problems was to, a,great :extent dug, to Mayor Haight's leadership.
(The members then joined in a round of applause.)
The Vice Mayor stated that the next order of business wa.s the
election o1. a new Mayor,' to se,rve for the balance of the term, until
July 1, 1963.
Counciim.en.Byxbee and Haight acted as ballot clerks,
and the first 'ballot :was as follows:

A report was received from the, Committee of the Whole
recommending to the 'Council .that .four-way stops be installed. on Louis
Road at :the `'intersections of Loma. Verde Avenue*, East Meadow Drive,
California Avenue and Colorado A e..ue.
On motion made by Haight, seconded by D4 bs, the following
' resolution was introduced:
A''resolution: entitled "Resolution No. 3605 of the Council of
the City of Palo' Alto Amending Resolution 271 :Making the
Intersections. of Louis Road and California. Avenue, Colorado
Avenue, Lorna Verde Avenue and Meadow Drive Stop Inter-
sections."
.A discussion followed in regard to the cost of installation of
traffic lights which could replace four-way stop signs as warrants
developed. The City Engineer. and, the Traffic Engineer advised that
the cost of installation Of foul stop lights at the intersections would
b€ in the neighborhood of'.$20, 000.00.
At the conclusion of the disci:.ssion, the resolution, as intro-

A report was received: from the C;ornmittee of the Whole
recommending ghat the Council adopt a resolution urging the state'to

complete construction of the Oregon-Bayshore grade separation and
initi:.te studies of extension of the frontage road into the San Antonio-
Bayshore interchange with direct connection to 8ayshore Freeway,
Tile City Manager advised that the staff had reviewed the
committee's recommendation hut the matter was not entire he requested the. Council to cl.a if the rep e lye do add

A motion was made by Haight, duly seconded and unanimously
carried, that the staff write a letter to the State Division of Highways,
urging them to tie the Frontage Road into T3a• shore at Oregon
and requesting them to initiate studies to see if the Frontage Road could
be continued south: into the Safi. Antonin area through the Philco parking
re a, including :econ;struction of the interchange there to allow traffic
from that -.rea onto the."Bayshore Freeway.

A report was received from the Committee of the Whole recom-
mending to the Council that the staff be authorized to explore additional
studies with the State relative to grade separations at Embarcactero_
El C-,.mino Real, Arastradero-El Camino Real, and Atma-Ernbarcadero.
The City Manager, was advised that the intent of the recommen A-
t C,n was to ask the staff to requerqt the Division of Highways to make a`
study of these grade' separations.
It was moved, seconded and carried by a majority voice vote
that the staff request the. State Division of Highways to make such a.
study.
Citv_Electioxa' Procedures.
A`report was received from. the Committee of the; Whole recom-
mending' to the'. Council that the City's election procedures be brought,
into conformity with 'the State :Elections Code, except that any amend-
ments .would not go into effect until June 1, 1963.
The City Attorney presented a proposed ordinance which would
make some changes in the present administrative Code in connection
with :e lectio'n,procedure;., the principal changes being to establish the
last fling .date for candidates for 54 days prior to the election rather
than: the present 25 days, and eliminating the right of candidates to.

Aircraft Landing Peguiatior_s Municipal Code
The_ City Attorney: presented. a.. proposed ordinance entitled
"Ordinance of the.Council :of the,City:of Palo Alto Adding Section
7.13 to the Palo Alto ''Mun_icipa1 Code Regulating the Landing of Air-
craft:', L.nd explained' that it would prohibit landing any aircraft within
the City (except in case of emexgency or, for rescue: missions) except
upon an aia•port.aircraft landing field, heliport or helistop approved
by the City �o.uncil.
The Mayor, stated that any persons present who wished to address
the Council in regard to the proposed ordinance were welcome to do so
at this time.
John Strzwleel, Director of Public Relation, for Hiller Aircraft
Corporation, spoke in protest against passage of the proposed ordinance
:and requested that representatives from Hiller and from citizens'
associations have an opportunity to meet with the: staff, to make ,1 careful
study of any ordinance.:: Mrs.. Mildred i,igd-.i, Page Mill Road, .also
addressed the Council supporting. Mr. Straubel's suggestion for a
further study, and Robert. Lewis stated he believed the matter of
helicopter landings gs and usage should be referred to the Traffic Engineer,
After further diScussion and questioning of Mr. Straubel, a
notion was rriade by Zwez g, seconded and carried by a majority voice
vote: to'refer..to the. staff .the 'Matter of an ordinance regulating the use
of aircraft for further study .and re,cornmencl ktions, the staff to report
to the Committee of the,Whole when they have decided on a 1..roposecl
ordinance.
Municipal Code Amendment re Penthouses
An ordinance entitled "Ordinance of the Go zr;„il of the City of
Palo A:lto.:;Adding Item '33a to Section. 34 1.02 of the Palo Alto Municipal
Code Amending;;Sectior'.3601 of the Uniform Building Code With Respect
to Penthouses was sintroduced.
The City > Attorney explained that Borne problems had been
encountered, on, interpretation of the language in the section of the
Municipal Code pertaining to pehtho+ases, and that this ordinance is
merely to clarify,that section of the original ordinance.
After eliscuss'on, it was moved by Byxbee, seconded by
Stephens.' and tarrie:d, that the ordinance be accepted for fir3t
reading.

Mayor Haight. lad appointed a citizens' committee to review the Building
Code and. Sign Ordinance of the'. City. He stated that the corn:nittee had
made their recommendations .:and a ,proposed ordinarce was now ready
for Council action. ,He advised that Mr. Birge Clark, Chairman of
the Mayor's committee., was present and would answer any questions
on the recornrnendations of :this committee.

Clark stated that he •' had sent a copy of the revised draft
of the sign ordinance; which had been originally submitted to the Council
on July 9, 196'2, to eac,h. Council member, together with a letter ex-
plaining he principal changes in the ordinance. He .mentioned that the
sign; committee ha.dwonted long and faithfully for two years on the
ordinance.
A'question and answer period followed and at its conclusion
Ex -Mayor Ha:ght stated he :felt the Council owed a debt of gratitude
to Birge Clark :and hi.s committee for the many months they had spent
on the sign. problcxr.: 2vlayor,,Cresap also expressed the Council's
thanks to Mr. Clark and. the Committee.
The proposed ordinance_: entitled "An Ordiriancc of the Council
of the City of Palo Alto Amending Division 4 of Chapter 34, Building
Regulations, of "the :Palo Alto Munieipsal Code Regulating Signs" was
-intro.duced, .and on.,rnotion of ,Haight. seconded by Byxbee, was accepted'`

An ordinance entitled "Ordi;nance of the Council. of the City of
ai,o' Alto 'Designating' a Street near Ernbarcadero Road off East Bayshore
'Road as 'Watson Court"' was .introduced, and on :motion made, seconded
.end unanimously caried, was accepted for first reading,
The City Manager aridAssistant City Manager reported on a
previous study >which . had been made of placing utilities underground on
Sherman Avenue;, in which :it had been determined that the cost of this
installation would exceed the cost of the street improvements, and that
it was questionable whether any support would be received from the
property owners.
A motion, was made by Byxbee, duly seconded and unanimously
carried, to place utility poles along the street line in this; improverr.ent
project as was originally done, since it is not feasible to locate the
facilities' utiderg round.
The City -Manager then advised that seven bids had been received.
The highest bid was $37,876.80 and the lowest bid, submitted by Bahr
& Ledoyen, was -$24,,,629.41, which was $523.49 above the City Engineer'
estimate: He recommended that an award of contract be made to Bahr
& Ledoyen.
It was moved, seconded and carried that the bid of Bahr &
Le.doyen be accepted for Project 62-3, Sherman Avenue, et al., and
that the Mayor., be authorized and directed to execute a contract
accordingly.
(Action ,on:this matter rescinded later in the meeting.)

Truck Ordinance Revision
Tile City Attorne}•.explained that the revised truck ordinance
was now ;complete and ready for adoption, and that the staff, with
the approvaat of.'Mayor Haight, had taken the liberty of putting the
ordinance on the a.genda,'although the matter had been referred to the
Committee .of the Whole.
A motior.was made by Rodgers, seconded by Dias, to remove
he matter froze the "Committee of. the Whole to the Council, and to
accept for first;rea.di:nf, the; proposed ordinance as recommended by
the staff.
Council -mar. Debs raised' a point of order, stating that consider-
ation of the truck ordinance revisionhad been referred to the Committee
of the Whole and thatpublic hearings were supposed to be held. The`
Mayor ruled" against, the point of order, advising that the Committee of
the Whole is are.agency of: the Council and the Council has complete
control of, matters going into or corning out of the Committee.
Councilman Haight (as Mayor) stated he had placed the matter
on the Council zigerida because the staff members had met with
representatives of the trucking industry and citizens' groups regarding
an amended truck ordinance, and at the meeting the conclusion of all
the parties 'involved was -that they were totally in agreement on and
satisfied. with the revised ordinance.
Discussion followed during which the City Manager told the
Council about: the meeting of thestaff, the representatives of citizens'
groups and representatives of the trucking industry, mentioning that
it was the truc es themselves who bad invited representatives of the
citizens' association.
A motion was made by Zweng to separate Rodgers' motion
into two parts, the first being a. motion to withdraw the matter from
the .Committee of the Whole. The motion was seconded and carried
by a majority voice vote.
After further discussion Byxbee moved to amend the motion
to include in the truck routes the portion of University Avenue from
El Camino Real to Alma ;Street. This motion was seconded and
carried.
A further motion was made by Bishop, seconded by Rohrs,
and unanirriously carried, to delete from the truck routes the California
Avenue portion.
Mr..' Phil .Eldridge Executive ' Manager of the grading and
paving .contra(tors,.`stated the truckers had no objection to the proposed
amendments. He also mentioned that the truckers had requested the
City D.ganager to 'submit the ordinance directly to the. Council to save
time. Donald Knapp a1s.Donald Knapp also spoke to the Council and stated, on behalf.
of all the :people who were ;a;: the meeting, that the work with the
staff had been rewarding and these people thought the truck ordinance
as revised was a fine ordinance, in fact, the finest and fairest truck
ordinance in the State of California:.

An ordinance, containing the proposed amendments,
entitled "An Ordinance of the Council of the City of Palo Alto
Amending Division XIII of Chapter 19 (Section: 19.131 and 19.132)
of the Palo Alto. Municipal Code Establishing Truck Routes" was
introduced and accepted for first reading by a unanimous voice vote.
Off -Sale Liquor License
Drive In Liquors 3Ib3Zvliddlefield Road
The City Attorney advised that his office had received notice
of an application for the transfer of an off -sale general liquor license
from 3197 Middlefield Road to 3163 Middlefield Road. He stated the
transfer was not a change; of ownership, merely a change_ of location,
and that the license had first been issued in 1953. He advised further
that investigation<indicated the licensed premises have not been a
police proble3rn`and that the premises are located three -tenths o a
mile from Our- •Lady:<otthe Rosary School. It was his opinion there
would be no basisefo'r: a protest to the transfer and he recommended
that the notice be filed without action.
A motion was made, seconded and unanimously carried to file
the notice, as rec'om:mznde;d by the City Attorney.
l .alignment of,Citt Bou ry San Antonio Overpass
A`'repor.t had been received some time ago from Joint
Committees Nos. 1 and*2, recommending to the Council that the
City's boundary -line -in the area of the intersection of San Antonio Road
and Alma. Street, as recommended by the staff, be realigned, contingent
upon an agreement.; between Palo Alto and Mountain View that no access
be permitted from the property on the south side of San Antonio Road
into. the westbound lanes of either San Antonio Road or San Antonio Way
without mutual agreeznent``of the two cities.
Consideration :;of'this matter had been continuedfrom previous
Council meetings to allow: preparation of a new map showing in detail
the proposed .realignment...
The City Manager explained the two plans, one a Palo Alto
proposal and: one a Mountain View proposal; that. Mountain View would
accept full responsibility for maintenance of the overpass if they were
allowed to annex a`por.tion of the :area.
A general discussion followed in regard to fire access and
police protection in the area, remaining within the City of Palo Alto
and the possible loss of control, of zoning. The questions of traffic
'control and "off-street parking were also discussed,
A motion was made by. Rodgers, seconded by Byxbee, to
allow Mountain View to .annex the portion of property within. the City
of Palo. Alto as indicated on the Alrna Street Annexation Plan A re-
commended by the staff. The motion was carried by a majority
voice vote.

3u_s System: Exten;sion.of'A reement with Peninsula Transit Lines)
A motion was made and seconded that the Mayor and Clerk be
authorized and directed to execute a six-month extension of the agree-
ment between: the City and Peninsula Transit Lines, based upon the
formula set forth ir, the original agreement. The original agreement
had expired on December 31, 1962.
Councilman Dias questioned the staff as to whether or not the
books of the bus company had been examined and how the staff had
arried at a,rate o.f paymert of a subsidy, The City Attorney advised
that two months' payment had been withheld in connection with the
agreement, pending examination of the bus company's books, and the
City Manager` stated; he had,` been advised that a financial statement from
the •company would,`not be; -available until the end of February or early
part of Ma*.ch:_ fie recommended that the City not enter into an
agreement until the books' of the bus company could be examined by
the City Controller,.
After further' discussion a motion was made by Zweng,
seconded by ,D'ebs, that the should riot enter into any agreement
with Peninsula 'Transit Lines until the City Controller has an oppor-
tunity to check the books of the company. The motion. was carried by
unanimous voiCevote.
Inanswer to a question, the City Manager advised he believed
the City Controller would be able to make a report to the Council at
the next meeting on February 11, 1963.
Alma Street-Liridero Drive. Intersection Closing
A letter, petition signed by all the residents of Lindero Drive
had been received and acknowledged at the last Council :meeting and
the staff was instructed to study closing of this street to traffic to
and from Alms: Street, the' Staff to report to the Council at this
meeting.
(Councilman Rodgers left the meeting
at this time 10:35 p. m. and was absent
for a short time.)
The, City Manager reported that in all probability an assess-
ment district would have to be established to pay for the cost of
closing the street:.' He advised the staff had not had time in which to
talk with other property owners living in the vicinity of this inter-
section and he believed it would be appropriate to get in touch with
people in theentire area to determine their attitude. He also stated
that the staff was of the opinion the intersection should he either
closed or re -designed, and that if thestaff were instructed to contact
other residents in the vicinity, these residents would be advised ,:y
letter and invited to review proposals with the staff.
(Councilman Rodgers returned
at 10:40 p.m. )
A motion; was made by Haight, and seconded, that the staff
present z plan for closing Lin.dero .Drive at the Alma Street inter-
section to the people in the zone of interest to determine their attitude
in regard to the closing the staff to report back to the Council.

Milton Barnett, a resident of Lindero Drive, spoke to the
Council in favor of the street closing.
The staff, in answer to questioning, agreed that public
hearings orithe proposed assessment district could be combined with
the matter of notifying the residents.
The motion wascarried by t unanimous voice vote,
Debs rriovedthat the' staff study be completed no later than
the second meeting in February of the Committee of tnc Whole. The
motion died for lack of a..second.
Sister. -City. Pro am (Progress Report
Councilman :Frances Dias, the Council appointee on the Sister -
City Program,. made ra brief report to the Council on, the progress of the
program. •She stated that the program is now forrnolly organized, that a
Board of Directors consisting of Jack Powers,Chairm;tn, Tully Knoles,
Vice -Chairman, Mrs. Frank Balbo, Secretary, Rev. Ray Farness,
Treasurer, Mrs. Ernest Johnson, Historian, Mrs, Lorrin Torrey,
Membership' Chairman, Hugo Littig; Program Chairman, Charles Heyler,
Maurice Kemp, Will filamrn, John ;Lyman, S. G. Mantel, Dr. Helen
Pryor and Linn Wintcrbot:ham, board members, had now been incorpor-
ated a,s a non-profit, organization and had adopted icy -laws, the name of
the corporation being ."Neil hbors Abroad". She adviser that the Board
of Directors was now :soliciting service organizations for money to
start the program and the Board had assessed itself a certain sum;
that the Board is,now :asking the City to pay the cost of stationery and
printing. (This cost to date had been paid out of the library budget.)
She moved that the' Council authorize an expenditure of
sufficient funds to permit the' Chairman of "Neighbors Abroad" to
attend the 1st Western Regional, Conference of the Committee on
International Municipat Cooperation at the Biltrnore Hotel in Los Angeles
on April '8 and: 9, 1963; pointing out; that in rnany cities the city govern'-
ment bears: the costof, a'Sister-City Program. The motion was seconded.
by Rohr':; and carried una.nirio:usly.
The City Manager advised that his office will take care of
the expens•esand incidentals out of the Contingent Fund in order that
moneys for `travel expenses ;arid incidental expenses will not be taken

against the proposed taking of their property for the establishment of
