G. Torres Construction Company in the amount of $6, 553. 23. On motion made and dul.y seconded, the Council accepted the bid and authorized the .mayor to execute the contract with the J. G. Torres Constru:tion'Cornpany. Traffic Study. Assistant City'Manager Morgan reviewed the staff memo of December 17 to the Council which reported on traffic studies con- ducted on Middlefield Road,a.t Mitchell Paris library which had been requested by the: Council and recommended that additional signalizati 3n or traffic features were not needed at this time. On motion of Rodgers, duly seconded and carriedon a majority voice vote, - thee. Council accepted the report without further action. Palo Alto Golf Course The Assistant C':ty Manager mentioned the Council's approval in., June of 1964 of a: rate differentialfor nonresidents for certain facilities or .services and submitted a schedule of fees for the Municipal Golf Course, He read the memorandum. to the Council dated December 24 on the subject and in answer to query, compared,;;: rates presently charged at .similar facilities in Santa Clara. Alamedz , San Mateo, Stockton and Sacramento Counties. After further discussion, it was may ed, seconded and carried unanimously by Voice `vote, that the Council approve the rate differential :for. the Municipal Golf Course, effective, February 1965; Claim for Dania e (Livingston) City Attorney Mieha1ski reviewed the claim against the. City by Melodee'F.:Livingston in the amount of $85.00 for the loss of a hearing aid and recommended, from his investigation that the clairn was not a proper charge against the City, that it be rejected in its entirety. On motion of Beahrs, seconded by Byxbee and carried unanimously on a voice vote, the Council rejected the claim in its entirety. After discussion, Councilman Rohrs moved, seconded by 13yxbee, to amend the motion by also rescinding the resolutions of September 28 and November 9 which approved the site plans. The City Attorney answered questions about the consolidation of the election with the school district. (Councilman Cresap ar:-ived at this time. ) Charles Schulz, 1330 Greenwood Avenue, spoke to the amended motion, Said he felt it compatible with t_'1e referendum petition circulated; that the citieens association which he represented was not particularly eager to have an election which would destroy the school tax override; thatthey were concerned about plans for the area, but their primary goal Was the public safety building. After further discussion; the Rohrs' amendment carried on the following roll call vote: Ayes: Arnold, ;Byxbee, Comstock, Cresap, Debs, Flint, Porter, Rohrs, Zweng. Noes: Beahrs, Cooley, Dias, Rodgers, Rus, Woodward. • Couneilrna,n Cornstock ,moved an amendment to thee motion that it be the sense of the Council that the public safety building not be located in the Ernbarcadern=Ne e1'1 Road location. The ;notion was :seconded by Porter, but ;'after discussion. of its propriety,, was ruled out of order. The decision was appealed., and the Chair's ruling was sus- tained by a majority; show of hands.
