19 3 12/14J64 City Hall Palo Alto, California December 14, 1964 The Council of the City of Palo Alto met on this date in a regular session at 7:30 p.m., with Mayor Woodward presiding. Present: Arnold, .Beahrs (7:34), Byxbee, Comstock, Cooley, Cresap, Debs, Dias, Flint, Rodgers, Rohrs, Rus, Woodward, Zweng„ Absent: Porter. Minutes of November 23 Councilman Debs moved that page rections he had proposed to the mi, The motion was seconded by Flint roll call vote: 189 of the minutes show the cor. - nutes of November and November 9. but failed, to carry on the following Ayes: Comstock, Cresao,Debs, Dias, Flint. Noes: Arnold, Byxbee, Cooley, Rodgers, Rohrs, Rus, Woodward, Zweng. Councilman Byxbee moved approval of the minutes of November 23 as distr Luted. The motion was duly :seconded and carried on a voice vote, frith Debs and Flint voting no Neighbors Abroad Mayor Woodward welcomed the students from Oaxaca, Mexico, who were attending the Council meeting and introduced Councilman Dias, who is Chairman of the Council's Sister City Program. Mrs. Dias explained these were the first contingent of youth from Oaxaca; that she wouldintroduce the Palo Alto student host and asked there to intro- duce their guest. Marilyn Carter ;introduced Maria del Carmen Marra. Miramontes. Since Parma Wisniewski could not attendthe meeting, Mrs. Carter introduced Miguel Angel Villegas A.rellano, Jean Littig introduced Mario. Nunez Palacios. Karen. White introduced Manuel Javier Calleja Sanchez, Diana Walker introduced Jesus Torrez Ruiz. Barbara Hunt introduced Pablo Enrique Nunez Callas. h Mr.s. Dias then introduced Eugene Gomez from Cubberley High School who accompanied Mario to the podium to translate the greetings Mario brought to the Council trorn the Oaxacan families; from the students, who enjoy being in Palo Alto, and who are looking forward to the visit of the Palo Alto students to Oaxaca in July. Mrs. Dias announced a telegram had arrived advising that five more students were on their' way to Palo Alto from Oaxaca. Mayor Woodward observed 'this was another step, and a very important one, in the Council's'Sster City program. Report of the Citizens' Advisory Committee on. Foothills Planning..- Vice Mayor Arnold introduced the report of the Citizens' Advisory. Committee on Foothills Planning, read his letter of transmittal which accompanied the report, and moved that the report be referred to the Planning Cornmis.sion for review and report back to the Committee of the Whole`. Councilman Comstock seconded the motion. Vice Mayor Arnold. asked. that the Clerk reproduce the letter he had received from the Town. of Tortola Valley prior to the: next meeting ' :ind distribute' it to.' upaxuicrors to.asauat,a_at�,aatiuxi :Jo to t+-trex He suggested that the certificates be given to the mem- bers of the committee on_'t,he night the report is considered by the Committee of the Whole. E. R. Burns, 3;2100 Page,Mill Road, said he was speaking as a resi- dent of the connmunity and that he felt the Council should not support i report which covers jurisdictions outside the City limits; that the report placed a cloud on the title of all the lands covered in the report; that the report was discriminatory; and that the Council was now re- sponsible for the full cost of the property he had been trying to develop ,or six years. Vice Mayor Arnold pointed, out that the report was from a citizens'. advisory committee and had not yet been considered by the Council. The Arnold referral motion carried on the following roil call vote: Ayes: Arnold, Beahrs, Byxbee, Comstock, Cooley, Cresap, Debs, Dias, Flint, Rodgers, Rohrs, Rus, Woodward, Z.weng. ' Noes: None. In response to questions, the City Attorney advised that since the committee was without any legislative authority, and since the committee's report did not attempt to zone property, he did not understand how it could cloud the title on Mr. Burn's property. • 195 1.2714/64 -_ .Zone Change -. Lands Investrnent Company A5'5, 2705, and. 2723.Birch Street and 25'1,. 71, 27;777.78.a 280 arid.29 Sheridan Avenue (64-ZC-17) A report was received fromthe Planning Commission transmitting Resolution No 4 with exhibits, ' zind. recommending, by vote of 4 to 3, approval of the application.of California Lands investment Company in accordance with the findings and conditions outlined in said resolution., and recommending adoption of an ordinance rezoning the property at 2601, 2655•, 2705 and' 2723 Birch Street, and 251, 271, 276, 278, 280 and 296 Sheridan Avenue-' from R-3;P(Residentiti-Professional District, Regulations) to P -C (Planned Community District Regulations - speci- fied professional and commercial offices :agencies and uses). Mr. Fourcroy announced that the applicant, California Lands Invest- ment Company, had withdrawn the area known 2601 Birch Street from their plan. and pointed to the subject area on a wall map. He reviewed the plan which had been sent to the Council previously. Councilman Rohrs moved, seconded by Byxbce, that *he ordinance entitled "Ordinance of the Council of the City of Palo .Alto Amending' . Section 3.02 of Ordinance No. ?.324, the Zoning Ordinance, Changing the Zoning of Certain Property Known as 2655, 2705 and 2723 Birch Street aid 251, 271, 276, 278, 280 and 296 Sheridan Avenue from R -3:P to P -C" -be introduced and accepted for first reading. In answer to questions. the Planning Officer reviewed setback require- ments for the ten -story office building and the parking structure. Jerry D? nn, President of California Lands Investment Company, clari- fied the question about parking by stating that when they withdrew the area known as 2601 Birch Street which had been planned as a parking a.re.'s, they added .half a level to the parking structure to conform to trio requisite number of parking spaces; and that he felt the structure would be ar asset to, the.City. He further stated that the Planning Commission had deleted'four uses for the office building which he would. like to see reinstated - a bank, a title company, a savings and loan association, and a restaurant. He called the Council's attention'to the letter which had been sent to there by the California Avenue 'Area De,•felopment .Association, Inc., which stated they had,' no objectiOns.to these four uses. In reply to the comments on traffic,. Mr. ,Dunn observed that t1te• only two property owners in the area bounded by Birch,. Sheridan. and.' Page Mill were this City of Palo Alto and himself; that he would be interested in buying some of the City's property to add to, their garage structure or in exchanging land with the City, if necessary, to improve traffic circulation in .,:the future; and that he was sure something could be worked out to everyone's satisfaction. Albert Hoover, 535 Ramona Street, the architect, referred to the model. or. display before the Council. and said the plan was conceived as a first-class building. In answer to query, he explained the first phase 196 12/14/64 cf the office`buii;ding would be "a four-story building; that the second phase would be ,to increase it to a ten -story building; that the third phase had been deleted because it includedthe property which had sincebeen withdrawn by the applicants Court zilman Zweng, moved, seconded by Beahrs, that the motion be amended to change the zoning from R-3: A to C-2. Planning Officer Fourcroy reviewed the uses permissible under C-2 zoning. The amendment failed to carry on the following tie'vote: Ayes: Arnold, Beahrs, Rodgers, Rohrs, Rus, Woodward, Zweng. Noes: :Byxbee, Comstock Cooley, Cresap, Debs, Dias, Flint.. Stanley Bishop, 'President of the California Avenue Area Development Aksociation, Inc.. .advised that the Association approved of the plan Mr. Dunn' had outlined and requested that the four use:: which were deleted be' reinstated. Councilman Zweng moved, a.nd it was duly seconded and carried on a majority voice vote., thatthe motion be amended to provide that four Uses be added to the present, lists,nannely, a restaurant, a bank, a title company, and a savings and loan association. The original. Rohrs' motion as amended, then carried on the following roll call vote: Ayes: Arnold, Beahrs, Byxbee, Cooley, Cresap,Dias, Rodgers, Rohrs, Rus, Woodward, Zweng. Noes: Comstock, Debs, Flint. Report of the Special Subcommittee on Bonding for Parks and'Recreation Councilman Beahrs, as chairman of the Special Subcommittee on Bonding for Parks and Recreation, reportedthat four of the five members of the Council who served on the subcommittee, as well as the two ex -officio members, Mr. Lawrence Baker, chairman of the forrner Citizens' Advisory Committee on Parks and Recreation, and Mr. Frank H. Roberts, vice chairmar_ of the former Citizens' Advisory Committee on Capital Improve - merits, agreed with the recommendation to the City Council that. the City defer consideratis,n.of a bond issue at the current time as a means of financing park and recreation needs and continue on a pay-as-you-go basis; that the subcommittee also recommends that the staff should continue: 4'4- its review oft anci, need for, such projects as may require bond financing 6 during the next year. Councilman Debs asked, as the sole dissenting voice on the subcommittee, that the record show that he felt they should have looked at long-range financing for the City's needs. 1.9 7 1.2/14/64 After discussion,- Councilman Zweng moved that the report and the subject of long-range financing for parks and recreation needs of the City be moved to the Committee of the Whole. The motion was duly; seconded, and after further discussion, carried on a majority voice vote. Miscellaneous Street Improvements - Project 62-5 e Resolution No. 3787 entitled "A Resolution Calling for Sealed Proposals; Miscellaneous 'Streets Improvements (West Da.yshore Frontage Road, Diablo Way, Horner Avenue, Maybell Way)" was introduced and on notion made and seconded was adopted unanimously on a ma.jor1T_y voice vote. Annexation, Pcrti3O.nof Page, Mill Road The City Manager referred to a map and described the portions of Page Mill Road which the County had indicated they wished to annex to Palo Alto. As directed by the Council, the staff had advised the County that the City was riot in favor of annexation of the portion which was not within the boundaries of the City, and had questioned the intent of the County on the portion which bordered the City. Mr. Keithley reported the County had just notified the City that an incorrect map had prompted the mistake on the portion not adjacent to the City limits; and that the Local Agency For.matior. Commission had modified and confined the proposed annexation'to than portion which abuts the present boundaries: of Palo Alto. He advised the Council that the annexation would make Palo Alto responsible for total street maintenance on both sides of the street which included frontage to Los Altos Hills property. Vice Mayor Arnold introduced, Resolution No. 3738 entitled "Resolution of the Council of the City of Palo Alto Opposing Annexation of a Portion of Page :Mill Rd:ad to the City of Palo Alto" and moved its adoption. The motion was seconded by 8yxbee, and after discussion, carried on a majority voice vote. El Camino, Real Widening Project 64-1 City Manager Keithley read his report of Decernb' r 10 on the El Camino) Real Revolving Fund whichhad been distributed to the: Council previcusiy, :ind added that the staff had :net with members of the Chamber of Coin'- rnerce, with representatives of owners and with tenants within the subject area; that this -proposed widening had been and was being well publicized; and that it will take considerable timer to accomplish the project. Councilman Debs stated.he felt the referendum should not be placed on the same ballot with the school district election and therefore moved' an amendment to the motion that the referendum be placed on the May 1 1 ballot of the municipal election. The amendment was Seconded by Flint and was followed by a discussion of the advisability of consolidating. the election with the school district, but failed to carry On the following roll call vote: Ayes:. Councilman Bybee said he thought the Stone structure was excellent; that in recent years the cooperative spirit between the people and the Council had broken down and :not much was being accomplished; that he was in favor of doing somethingnow and reviewed the previous referendum' measures. CouncilmanCooley spoke in favor` of the Dias motion and urged the . people to visit the present public Safety building to see- the crourdeti.: conditions'and th'e kinds of administrative work that is handled there. Councilman Comstock spoke in favor of placing the matter on the ballot. Kenneth McDougall, 517 Byron Street, spoke against the motion and urged the, Council to rescind their previous action.
