(Councilman Flint arrived at 7:36 prior to the trans- action of any business, and was counted as present.) 1964-65 City.l3udget This was the tirrie and place set for the public hearing on the budget for the fiscal, year 1964-65. It was stated for the record that notice of the hearing has been given as provided by law. Mayor Woodward" declared the hearing open and there being no persons present wishing` to :.•peak, the public hearing was declared closed. After discussion by the Council, Ordinance No. 2198 entitled: "Ordinance. of. the Council of the City of Palo Alto Adopting a 'Budget for the Fiscal; Year 1964-65" was introduced and on :motion ' by Byxbee seconded by Rohrs, was adopted by the following roll call vote: Arnold, Beahrs, Byxbee, Comstock, Cooley, Debs,Dias, Flint, Rohrs, Rlls, Woodward, Cresap, Porter, Rodgers, Zweng. :Councilman, Debs moved that at a Committee of the Whole rneeting the near future, a large portion, if not the entire meeting, be devoted toconsider.ation of the Capital Improvement` report and the"`staff's' recreation report, especially with reference to the policy commitment of -the Council on the baylands and other items. System The City Manager advised that the California Stz,:e Employees' Retirement System has "recently changed its rules and procedures relative to inclusion. of casual employees in the retire. merit system.,He stated that a great majority of the City'ssumzier, casual employees are included within the requirement and it would' he necessary to set aside an unusual amount of administrative time in order to comply with thenew rule. He recommended that the City's contract with SERB be amended to exclude, all employees con'pensated'on an hourly basis'employed on or after September 1964. Resolution No,. 3754 entitled "Resolution of the Council of the City of Palo Alto of Intention to Approve an Amendment to Contract Between the Board of Administration of the State Employees' Retirement,.Syy`stem and; the City Council of. the City of Palo Alto" was . then introduced and on'motion by Debs, seconded by Beahrs, was adopted by a.unaniinous vote. Working Rules and Regulations The City Manager explained a proposed administrative chaxige in the:vacation prog:r:�rn which would establish a uniform anniversary date for employee vacation schedules. Naming of Fire Stations rpage Mill -Hanover- Area and Alma Street -Everett Avenue Area. ) On recommendation from the City Manages, it was moved by Rus that the fire station to be constructed in the Page Mill -Hanover area be named "Mayfield Station" and the one to be constructed in the Alma Street -Everett Avenue area be designated. "University Park Station." The motion was seconded by Beahrs. A substitute motion by Flint, seconded by Debs, to name the fire station in the Page Mill -Hanover area "Stanford Industrial Park Station" was declared lost on a majority voice vote. The original motion by Rus was carried by a majority vote. Street Landscaping The City Manager advised that numerous residents at. • the cul-de-sac end .of Emerson, .Ramona, South Court, Tasso and Warren Way have questioned him in regard to the feasibility of having a cyclone fence and proper planting at the cul-de-sac en.ds of their streets for safety purposes. He stated he had. ccorres- ponded with James T. Pott, the Director of Public Works, Santa Clara County, and; Mr. Pott had advised that he would be more than pleased to recommend to the County Public Works Department the installation of safety chain link fencing at the end of these cul- de -sacs, which are i.m.mediately adjacent to the Oregon Avenue Expressway.. He added that'it would be necessary for the City to provide the screen planting. A motion by:.Byxbee, seconded by Beahrs, to request the County to install the safety chain link fencing as recommended was carried by a unanimous vote. Mutual Fire Protection \Aid Agreement tate Division of Foxe-stzv° On recommendation. from. the City Ivianager, a motion by Rohrs, seconded by'Beahrs, to authorize and direct the Mayor to c:decute an agreement for: mutual fire protection between the State of. California Division of Forestry and the City of Palo Alto w:,,s carriedby a unanimous vote. Parking Lot '"H" Project No. 63-1: The City Manager reported that the construction of Parking Lot ''H'' has been completed and requested that acceptance: of completion of th.e project be a matter of record. A motion by f3eahrs , seconded by Byxbee, to accept completion, of ,Project No. 63-11, Parking lot "H", was carried by a unanimous vote, Churchill Grade Crossing The City Manager advised that the City Engineer re- ceived a proposed agreern;ent for installation of pedestrian gates. at the Churchill Avenue grade crossing which had arrived too late to be included on the agenda. On motion by Byxbee, seconded and carried, the Councilagreed to discuss the proposal at this time. The City Manager stated that the agreement submitted by Southern Pacific Railway was,unique in that it provided that Palo Alto would pay the entire cost of installation of the pedestrian gates. He stated the staff believed considering stick an agreemen% would set a precedent, since:the Public Utility Commission has established a formula on construction cost of crossing gate:, under which the railway pays 50%, the State 25% and the City 25%. He added that although this project has Council approval, the staff is of the opinion that, it is advisable to explore the reasons why there is no suggested contribution from an;: other agencies on this project. Tie Assistant City Attorney concurred with the City Manager's report. A motion was made by Cooley that the City staff be authorized to discuss this matter with Southern Pacific Railway and negotiate a contract: The motion was seconded by Dias and after discussion; was carried by a unanimous vote. Tax Cancellation Onmotion by Rohrs, seconded by Byxbee, and carried by a unanimous vote, the request of the City Controller for ad justro.ent to the tax roll for fiscal year 1964.65 on City property: taken by the State (Oregon Avenue and Bayshore Highway), Parcel No. 402-111, in the sum of $15.17 was approved. Claim for ,Darnaaes Gladys_Nic hotson: The City Attorney reported on a claim filed by Gladys Nicholson, 1933 Bayshore, Redwood City, California, in the, sum of $25,000.00 for personal injuries due to a sidewalk fall opposite the cafeteria entrance of the Palo Alto -Stanford Hospital on April 25, 1964. He advised that after investigation, it was concluded the claim is not a proper charge against the City and he recommended that the Council so find and reject the claim in its entirety. On motion by Arnold, seconded by Rus and unanimously carried, the recommendation of the City Attorney was approvedand; the claim of Gladys Nicholson denied in its entirety, Claim for Damages W. luf :The City Attorney reported on a claim filed by C. W. Cluff, 509 Hale Street, in the sum of $925.00 for damage to prop.- . erty caused .by a falling tree. He advised that after investigation, it was concluded the claim is not a proper charge against the C:ity,`. and he recommended that, the Council so find and reject the claim in its entirety. On motion by Byxbee, seconded by Arnold and unarLi • mously carried, the recommendation of the City Attorney was approved and the claim of C. W. Cluff denied in its entirety. Committee of the Whole System Mayor Woodward advised that the Council, meeting as a CornMittee of the Whole rather than operating under the standing committee system, had been extended to June 1, 1964 by Council action the first of; the year. A motion by Comstock, seconded by Dias, to continue the Committee of the Whole system to January 1, 1965 was carried by the following roll call voce: Ayes: Noes: Arnold, Beahrs, Comstock, Cooley, Debs, Dias, Flint, Rohrs. Byxbee, Rus, Woodward. Aosent: Cresap, Porter, Rodgers, Zweng. Channing House, Aga eement A request was received from Charming House for time to appear before the City Council on this date to present a proposed 6 agreement whereby'Channing. 1 -,louse would pay the City a sun: in lieu of takes for :municipal services rendered to it and its residents. Dr. Marcus Krupp, 61-0. Coleridge, a member of the Charming House.' Board of Trustees, presentedthe proposed agreement, a copy of which had been provided to each Councilman. A motion was made by Byxbee, seconded: by Cooley, to accept the agreement as presented and to authorize and direct the Mayor to execute .After a general discussion, the motion was carried by a unanimous vote; Association of Bay„.Area Governments - gan Francisco Bay. Moratoriurn The City Manager reported that the Association of Bay Area Governments. had forwarded a study draft of a proposed agree- ment and ordinance relating to the filling and deve iopment of San Francisco Bay. He advised that if the Council had any recommen- dations on these docurnents, the staff would forward them to ABAG. Discussion was held on the resolution adopted by the Council a few months previously that the City of. Palo Alto favors and supports a State moratorium on the filling of the Bay, and the City Manager advised that the resolution had been filed with the State Legislative comniittee presently making a study of the Bay. Councilman Dias ,reviewed actions taken by ABAG concerning the moratorium, mentioning again that she had stated to ABAG the Council's objections to a self-imposed moratorium but that Palo Alto's vote, was the only negative vote cast. The Assistant City Attorney advised that the proposed agreement envisaged an ordi- nance to be passeda:by each city and an agreement to be exercised under theJoint Powers Act, which would be effective for three years; that during this period the interested municipalities would have an opportunity to sec how the program worked and if it were not. effective, the legislature'might then act. A motion was made. by Dchs, seconded by Flint, that the Council restate by resolution its stand that there be a stronger moratorium and a State -imposed moratorium. The CityMaaager again advised that the City's position,: in this regard has already been made clear to the Legislative Corni- mittee and that there was tirxie to see what happens with the final, agreement and ordinance before the legislature is in session. After further discussion, the motion was declared lost on a majority voice vote. Moratorium on San Francisco Bay Development On motion made, seconded and carried unanimously, a statement of policy from the Palo Alto Charnber of Commerce concerning a moratorium on development of the San Francisco Bay shoreline was acknowledged and filed, Offsireet. Annexation of Territory Notices of public hearing on proposed annexations of territory to. Menlo Park Sanitary District and City of Menlo Park were acknowledged an,d filed, Tentative Subdivision Map A. , L. Hawley, Jr A request was. received from Riley and .Floyd, Engineers,. written on behalf of A. L.=I-Tawley, Jr, for wit'rdra.wal of an appli- cation for a tentative subdivision snap of a portion of Lot 7, Mesa Tract. The Planning Officer advised the Council that the appli.- cants have filed a lot division application. with the Planning Depart- ment which was denied and which has been appealed. A motion by Comstock to deny the application • for a tentative subdivision map died for lack of a second. After discussion, on motion by Byxbee, seconded by Dias and carried unanimously, the request was filed, Traffic Restriction Waverley'and Homer A request was received from St. Thomas Aquinas Church, Charming.. House, ' Pa.lo Alto Medical Clinic, and Howe, Finch, Spaeth 1,c ,Young for consideration of immediate installation of four-way stop signals- at the intersection of Waverley and Homer The City. Manager advised that the Traffic Engineer has reviewed this matter and has advised the traffic at this inter- section meets the, warrants. : He suggested that the City Attorney be requested to prepare the necessary resolution for the four-way.' stop signals. A motion by Arnold,duly seconded, to direct the City Attorney to prepare a resolution authorizing the four' -way stop signals as requested was carried by a unanimous vote.
