City Hall, Palo Alto, California April 13, 1964 The Council of the City of Palo Alto met in regular session on .this dateat 7:30 p.m., Mayor Cresap presiding. Present:. Arnold, Beaters, Byxbee, Comstock, Cooley, Cresap, Debs, Dias, Flint, Rodgers, Rohrs, Rt:s, Woodward. Absent: Porter, Zweng. Mayor Cresap welcomed Miss Phanaw Kumnerdjan from Thailand.' He stated that Miss Phanaw is a participant in the ;Specialist Program of the Bureau of Educational and Cultural Affairs of the United States Department of State; that she has already visited Honolulu, Washington, D.C. New York City, Cleveland, Ohio and Cedar Rapids, Iowa; and that her main professional interests and objectives .in corning to Palo Alto were to observe and study the cultural programs and activities sponsored by the Palo Alto Recre- ation Department. Minutes of Previous Meeting The minutes of the meeting of March 23, 1964 were approved as distributed. Winow Road Freeway' A reement A report was received from the Committee of the Whole recommending that the proposed Willow Road Freeway agreement, as amended by the staff, be approved and the Mayor authorized and directed to e\ecute i:t,. A motion was made by Woodward and seconded that the agreernent be approved as recommended. An amendment to the motion was made by Comstock, seconded by Debs, that the Willow Road Freeway agreement be modified to remove:the full interchange at Middlefield Road and to provide in its place an overcrossing similar to the one designed for Cowper Street: In answer to question, Mr. Arthur Hayier, Design, Engineer for th,e Division of Highways, advised it would be more difficult and disrupting to construct an interchange at Middlefield Road after completion of the freeway in the event it should be found necessary it th.e future to construct the interchange as initially planned, -The Mayor- acknowledged a letter from .Albert F. The motion was seconded by Debs. (Councilman Zweng arrived at the meeting at7:45.) May.,r. Traffic Engineer Parker, at the Council's request, re- viewed traffic figures and other data with reference to the Middle- field Road interchange and a general discussion followed. Mr . Albert F. Smith, 1991 Middlefield Road, contended that hutting an interchange at Middlefield would only result in more traffic and also expressed concern that widening of the street would result in an interchange at Oregon. (Councilman Rus left the meeting at 8:10) Hotel -Motel Tax On motion by Woodward, seconded by Rohrs, and carried by a majority voice vote, the Council approved the recom- mendation of the Committee of the Whole to take no action at the present time in regard toa hotel -motel tax. Amendment to Zonin Ordinance (Ordinance No. 13241 A report was received from the Committee of the Whole recommending adoption of a,proposed amendrnent to Section 7.02 of Ordinance No. 1324 (the Zoning Ordinance) as recommended by the Planning Commission. Ordinance -entitled "Ordinance of the Council of the City of Palo Alto Amending Section 7.02 of Ordinance No. 1324, the Zoning Ordinance, Adding Apartments and Deleting Boarding and Lodging Houses in R-2 Districts" was introduced and on motion by Woodward, seconded by Rohrs, was accepted for first reading by a majority vote. Mass -Transportation Study A recommendation was received from the Committee of the Whole that the Board of Supervisors of Santa Clara County be requested to include a sum of $120,000 in the County General. Fund Budget for -`196.1-65, to be used for the first phase of a proposed mass transportation study. ',A motion was made by Woodward, seconded by Arnold, to uphold the recommendation of the Commit- tee of the Whole. Councilman Arnold reviewed the meeting of the Santa Clara CountyTrafficways Committee held a week previously. He repor,ted;'that,theBoard of Supervisors had referred for considera- tion at the' Budget Session the request for $120, 000 to implement the Coordinated Mass Transportation Planning Program (Comatrapp) and had also directed the County Executive to contact various juris- dictions in the County on the balance of the program; that the Board also had endorsed :HR3881 . He advised further that at this meeting almost -every delegate wanted more data in regard to financing, particularly on whether it should be based on assessed valuation or population figures. He pointed out that almost every city in the County has comparable figures of population and assessed valuation except Palo Alto --its assessed valuation being 10.81% as against 6.69% population --and advised that he had stated at the meeting that any financing of the proposed project should be on a population basis. The City Manager agreed with Mr. Arnold that Palo Alto should be assessed only on the basis of population and stated that to his knowledge a spread of costs in the County has never been based on assessed valuation. Councilman Dias advised the Council that at the meet- ing of March 25 of the Mass Transportation Committee she had re- ported that Palo Alto would look with a dim view upon any assessment formula established on assessed valuation. She moved to amend the motion to add the words "and that Pale Alto support and urge a form- ula other than assessed valuation for City participation". After discussion and at the request of the Council, Vice Mayor Woodward restated his motion that the Council instruct its representative to the Trafficways Committee to support the inclusion of the sum of $120.000 in the County's General Fund Budget for the fiscal year 1964-65, to be used for the first phase of the proposed mass transportation study, and to urge the Board of Supervisors and/or the Mass Transportation Committee to consider, in reference to City participation, using a formula based on population. A substitute motion was made by Rodgers that the Council's delegate to the Trafficways Committee be instructed to make the recommendation that the Board of Supervisors include the sum of $120,000 in the County's General Fund Budget and ad- vise the Board that Palo Alto will participate in any sums relating to the Mass Transportation Study only in the event that the formula. is ascertained according to population. The substitute motion was seconded by Beahrs. Vice Mayor Woodward withdrew his original motion, leaving the substitute motion made by Rodgers before the Council. After a short discussion, the substitute motion was carried by a unanimous vote. Councilman Flint moved that the Council recommend to the County that interested citizens' groups be allowed representa- tion or:. the Mass Transportation Committee, as well as having each city in. the County also represented. The motion was seconded by Rodgers. After discussion, the Council, at Flint's request, agreed to vote separately on the two items in his motion with reference to City representation and representation -If ,_.itizens' groups. Roberts, 1370 Lincoln Avenue, presented various photographs of the properties in this area and distributed a report outlining.so:ne of the reasons of nearby residents for ob- jecting to the proposed lot division. Mr. Harry L. Browne, 1505 University Avenue, read for the record a letter to the Council from the University and Crescent Park Association .containing a resolution that "the Palo Alto City Council should and is requested to deny the appeal of Harry Sander for a division of lot identified as 1365 Lincoln Avenue, Ptn. Lot 4, Block 113, Crescent Park". He filed the letter with the City Clerk. Mr. Henry Sander, 1550 Waverley Street, stated he was the agent for Mr. John Page, the owner of the: property at 1365 Lincoln He urged th.at the lot division be granted and des- cribed the lot in question and the proposed buildings to be erected on the site: Dr. Thomas F. Ball, 1449 University Avenue, also addressed the Council in opposition to the lot division. After discussion, Woodward withdrew his motion and made another motion that the Council support th.e decision of the Zoning Administrator and deny the request for a lot division. The motion; was seconded by Zweng and carried by a majority voice vote. Francis - ouito located, at Jaynes Road and Wilkie, Way and an irregular shaped parcel having a 50 -foot frontage on El Camino Real. Traffic Engineer Recommendations The City M'anag4;r reported on traffic engineering recommendations (Item No. 1,1 of the Agenda) for a number of changes in the Guard -arid -Go system and parking restrictions. He directed attention to his report dated April 10, 1964, which had been distributed to the Council and which contained the pro- posed changes and the reasons for recommending them, Councilman Rodgers called attention to a correction to' be .n,i.;ade on the First Guard -and -Go revision, i.e. remove existing stop signs on Forest at Lincoln, instead of Hamilton, motion was made by Arnold; seconded by Woodward, to delete from the proposed parking restrictions Item .13(2) -- "Remove existing 'No Parking Any Tirne' onnorth side of Page Mill Road from El Camino Real to Ash Street and replace with 'No Parking, 7:00 to 9:00 a, m, and 4:00 to 6:00 p.m., and Two - Hour :Parking, 9:00 a. tri, to 4:00 p.m. ' After. discussion, the motion failed by a majority voice vote. Resolution No. 3732 entitled "Resolution of the Council of the City of Palo Alto Amending Resolution 2971 to Amend 'Guard - and -Go' Traffic Control System in Certain Areas of the City" was introduced and .on motion by. Zweng, seconded by. Arnold. was adopted by a unanimous vote. Ordinance No. 2.1.88, an emergency ordinance, effective immediately, entitled "Ordinance of the Council of the City of Palo Alto Amending Section 19.152 of the Palo Alto Municipal Code -De- creasing the Speed Limit on Portions of Hillview Avenue and De- claring an Emergency" was introduced and on motion: by Zweng, seconded by Arnold,, was adopted by.a unanimous vote. Public Works, Standard Specifications At the request of the City Manager a report on recom- mended standard specifications for Public. Works was continued to a future.Council meeting. City Audit' The City Managerreported that the staff has reviewed: the proposal of Lybrand;; Ross Bros, & Montgomery for audit of the City's records and accounts for the current fiscal year. He. recommended that the proposal, in the sum of $5,700, be a,ccepted. A motion by 1Debs, duly seconded, to accept the proposal of Lybrand, Ross Bros Montgomery _ by Three-Ways Occupancy,' 60 kV Line Poles After_an explanation by the City Manager on a joint agreement of Pacific Telephone, Pacific Gas and Electric and the City of Palo Alto for three-way occupancy on 60 kv line poles, a motion by Zweng toy authorize and direct the Mayor to execute the joint agreement wasrcarried by a unanimous vote. He stated for the record that the City Manager has-reported`his findings to the Council, that it has been considered by'the Council at its meeting this evening, and that at his request the report on these bids should be continued until the next Council meeting. A motion: by Debs to consider the report at the next, Committee of the Whole rxieeting was seconded and after discussion, was lost by a majority voice vote. The matter was then continued.. to the next Council meeting. Arne:ndment'to Gas Rate Schedule The' City Manager advised that Pacific Gas and Electric Co. had recently reduced its rates on natural gas service by a modest amount and he recommended, in order to be consistent with past City Council policy, that a similar reduction be made in the City's ' gas service .schedule; that such a reduction would amount to about :8%, or about 90 per year to the average customer. lie further recommended that if the Council approved the new schedule the rate be adopted as of ,April 22, 1964, the billing cycle date. A motion made by Byxbee, duly seconded, to approve the rate reduction as recommended by the staff was carried by a unanimous vote. Palo Alto: Lawn Bowlin Contract ssastisassaw- The City Manager reported that the existing agreement between the City and Palo' Alto Lawn Bowling Club included an op- tion agreement for the Club to lease for an additional ten years the building, known as the Palo Alto Lawn Bowling Club House. He ad- vised that the Club had indicated its desire to exercise the option and he recommended` thata new contract be executed. A motion by Rohrs, duly seconded, to authorize and .. direct the Mayor to execute the new agreement with Palo Alto Lawn Bowling Club .was carried by a unanimous vote. Architectural Services; - Civic Center The City Manager recommended to the Council the selection of Edward D. Stone as the architect for the Civic Center complex. A motion by Zweng,, seconded by Cooley, to approve Mr. Stone a,a: the architect, in accordance with the City Manager's recommendation.. and to authorize and direct the Mayor to execute a con r a:'. was carried by a, unanimous vote. University Avenue stating that in his opinion there are, no legal grounds_ for protesting the issuance: of this license and recommend- ing ing that the application be filed without protest, On motion by !'weng, seconded and unanirnously carried, the recommendation of t'rie City Attorney was approved and the appli- cation filed without protest. Councilman Rodgers called attention to Item 27 of the Agenda' -.- a; letter .from]; tile: Woman's Club of Palo Alto with refer ence to' issuance of l;iquor' .licenses to establishments nearschools,. churches, playgrounds and hospitals. He commented that he was extremely surprised, to see a letter such as this, since for appr°oxi mately thirty years- control of alcoholic beverage licenses has been exercised by the State, first by the Board of Equalization and then in 1954 by the Department of Alcoholic Beverage Control. He com- mented also on the Proposition`which will appear on the June 2, 1964 ballot, and felt the Letter fror i the Woman's Club was definitely misleading. He reiterated previous statements that the only reason Proposition 3 :is appear'.ng' on the ballot is to clear the Charter of obsolete and superseded provisions. At, the suggestion of the Mayor, a motion was made by Rodgers', seconded by Dias and unanimously carried that the City Attorney be directed to write a "Letter to the Editor'', Palo Alto Times, in as attempt to clear up apparent misconception of sortie members of the public in regard to the ballot proposition. Palo .Alto. Stanford Hospital Boa T merest an :Rec erition Expense City:Controller Mitchell read the last paragraph of his. letter of March 24, 1964 which had been distributed to the Council, in regard to the. interest and redemption pay_nent of $45,000 on;the Hospital bonds due April 1 He requested that the Council author- ize: a tr.angfer of $45; 000 from the Special, Projects Account of the General Fundto the Hospital Improvement Fund. Orn motion by Rohrs, seconded by Dias and carriedby a unanimous voice vote, the City Controller was authorized to make the $45,000 transfer requested. Councilman Comstock called attention to the statement. from the Palo: Alto -Stanford Hospital Center covering the principles'", and objectives of the 1964-65 fiscal operation of the Hospital, which haci ocen sent to the Council. He moved rcfe.rrat of this statement to the Commtte of t}' Whole for discussion at the meeting on April 20, - The rnotion was seconded by Debs and carried by a unani- mous vote. City -School Traffic Safety Committee Councilman Cooley questioned the Traffic Engineer about :action taken by the City -School Traffic Safety Committee in regard to bicycles... The Traffic .Engineer advised that the present school: district policy prohibits :bicycle riding to school by pupils below the third'ga ade unless'the.: parent specifically requests the privilege • in writing; that concern of the PTA over the problem of bicycle riding to school in theGreendell area prompted a 60 -day experi- ment far prohibiting':riding bicycles to school; that the experiment:. results were so gratifying that; the City -School Traffic Safety Com- mittee supported the'?'TA's• request and recommended that the practice be made a, permanent one. He :mentioned that after cir- culating questionnaires to parents of Gree.ndell School students,, the PTA Safety Committee requested, however, that the Traffic Cornrnittee'rescind the special Greende:ll bicycle policy. Mr. Parker cited statistical, data on bicycle traffic hazards and ad- vised that the Traffic Committee had voted unanimously to alert all parents of children in Palo Alto schools of the hazards of bi- cycle r, idi;ng co,mpa: e,d to walling to school. A :notion was made by Cooley that the staff be directed to. ,o to the City -School Traffic Safety Co m-nittee and ask 'recon- sideration of the r, ecotie riendation. The motion, died for lack of a second. Remodeling of Council. Chamber Councilman. Cooley moved, that the staff be requested' to furnish cost estimates on replacement of the Council Chamber railing, relocation of the speaker stand, and installation of venti- lating fans in the Council Chamber. Discussion followed in which it was pointed out that the Councilhad just authorized execution of a contract with an architect to design the proposed additions and renovation to the City Hall.: The motion was declared lost on a voice vote. (Councilman Zweng left the meeting at 10:40. ) Lower Foothills Park' A motion was made by Flint that the Council request the other cities in the Fifth Supervisorial District to consider ask- ing the County to establish a lower foothills park accessible to the urban area in the district. The motion was seconded and after discussion was de- feated on the following roll call vote: Ayes: Beahrs, Comstock, Cooley, Debs, Flint, Rohr's.
