He. pointed out that in',ord:er for the propositon to be placed on the ba.hot in June it would be necessary to follow a time schedule. The recommendations of the committee were discussed and Mr. Lawry'answered various questions. At the Mayor's suggestion, - Councilman Cooley' rephrased his rnotion that the report be referred to the Cornmittee of the Whole and that, in the meantime, the City Attorney be irxstructed•to dr.s.ft a proposed amendment to be sub- mitted to thevoters. Further discussion followed on the recom rnenciations and the time element involved. At the conclusion of discussion the rephrased motion by Cooley was carried by Ca major - ity voice vote, Debs voting no. eouncilmart Dias requested that a correction be made in the opinions `surnrnaried in the report of the Chart; Review Com- mittee to indicate that her statement had been in favor of either a three or six year.tern, provided that one-third of the Council was elected at each election: Zoning Ordinance Amendment (Ordinance No. 1324) A report wa's made by Vice Mayor Woodward that the Committee of the Whole recommends amendment of the Zoning Ordinance to permit dwelling units as an accessory use in C-1, C-2, C-3, M-1 and M-2' zone',districts , and to eliminate dwelling units except as an accessory use ir,. a C-1 zone district; that the Committee of the Whole also' recommends disapproval of a Planning-. Commission proposal that decisions on variances and use permits be taken from the Zoning Administrator. He made a motion, seconded by Rohrs,. that an ordinance incorporating these recom- mendations be accepted for first reading. At the request of Councilman, Debs, the recommendations were voted on separately. The first recommendation in regard to accessory uses was' carried by a unanimous vote. A (notion was, made by Rodgers, duly secon.cled, to disapprove the pr,o.posa,to take decisions on variances and use permits from the zoning Administrator, as rec.ornrnencdedby the Committee of', the Whole. Report of Mayor's Charter Review Committee Mayor ,Cresap announced that another citizens' committee, thy. - Mayor's Charter Review Committee, had been working; diligently for a number of. Months.. He commended the committee fora mag- nificent job and advised the Council that Mr. Joseph S. Lawry was present to make a token presentation of the report. The •comrnittee'srecommendations are as follows: (i) that the size of the Council be reduced from 15 to 9; (2) that the term remain six years; (3) that the limitation on number of terms be repealed; and (4) that three councilrn:en be c-.leeted each two years, with the currentterms of the fifteen councilmen continuing until they would otherwise have expired, Mr. Lawry •advised •that copies of the committee's report -- had been sent to the Council. He -commended the subcommittee which had prepared the report and stated he woul.d attempt to answer and questions. Mayor C.resap pointed out that the: report did not contain a recommendation concerning the assignment of the matter of a Board of Zoning Appeals, and he advised the Council that he had requested the committee to drop this matter. Councilman Zweng, after also commending the committed for its work, moved that the City Attorney be instructed to incorpor- ate the committee's recommendations into a charter ame ndmer:; proposition to be submitted to the voters on the June 2, 1964 primary ballot. The motion was seconded by Rodgers. Councilman Cooley moved that the committee's report be referred to. the Cor inittee'of the Whole for discussion and examin— ation. Road o er apgoo was received from the Planning Commission 415 recommending extension of the P -C development schedule for proper- ty located at 980 Middlefield Road (Roller & Hapgood) for a period of 120 days, calling for completion by June 22, 1965. The Planning Officer advised that a resolution in regard to this extension should. stipulate that construction would start by June 22, 1964 with comple.tion by June 22, 1965. On motion by' Woodward. seconded by Zweng, Resolution No. ,33714 entitled "Resolution. of the Council of the City of Palo Alto Amending Ordinanc'e No :.2152, Being the P -C Development Plan for Property at 980' Middlefield, Road" was introduced and adopted by a unanimous vote Use Pe'rm'it (A:'M E.'' Zion Church, 3549 Middlefield Road) A report wa,s.: re.ceivec;;:from the Planning Commission recommending denial of the appeal of the A. M. E. Zion Church from the decision of the Zoning Administrator to deny a use permit to allow location and construction; of a church and related facilities' at 3549 .Middlefield Road, Zone District R.1:13-8. A motion wasmade by Rodgers, Seconded by Flint, to uphold the Planning Cornmis: ion` s recommendation and deny the use permit. Mr, Frank Crist, jr., 531 Cowper. Street, representing the A. M.E. Zion Church, requested that the Council defer this matter until the ne•.t scheduled meeting. He mentioned that sure rounding property owners hadapproved the location of this church.. Councilman:Porter moved to delay the matter in accord arc with Mr. Grist's request until the, nett Council meeting. The motion was seconded 1 y Woodward. 'The appeal of the church was discussed at considerable length and Vice Chairman Stromquist o.f the PlanningCoMmission reviewed the Commission's discussions. in relation'to this matter. John- son from thedecision of. the Zoning Administrator to deny a use permit for the location zLnd construction of an apartment structure containing 120 dweFling units at 43.6, 446 and 454 Hamilton Avenue, Tone District`C-2.S,' subject to conditions listedin the Planning Cornmission minutes of January 29, 1964. In answer to question the Planning Officer explained his reasons ;for denial of the use permit. A motion was made. by Byxbee, seconded by 3eahrs, to uphold the Planning Cornrinission.'s recommendation and grant the use permit requested, Mr. John Hanna, 61,0 University Avenue, addressed the Council -:in protest against allowing more apartments in the subject area and urged that this area be kept for commercial development. He mentioned, also, the increased density in this zoning if the use p�rrnit was granted and spoke of a proposed, commercial development at: ,his site. Mr. Milton Johnson, representing Hamilton Apartments Inc. , explained the proposed apartment building and answered vari- ous questions. (Councilmen Rodgers and Porter were absent for a short time. ) After a.prolonged discussion a motion by Arnold. seconded, by Flint, to refer this item to the Committee of the Whole for further consideration was defeated by a majority voice vote. Project No. 62-8, Portions of FoothillF, Annexation No. 3 ' anitary Trunk Sewers and :Water Supply System``' The' Assistant City :Manager explained a proposed reso- lution to allow acquisition of sewer and water facilities easements in connection with this project and a motion was made by Woodward, secanded:by Rus. to.adopt `the resolution as outlined.
