HomeMy WebLinkAbout12201965_188 12/20/65 City Hall Palo Alto, California December 20, 1965 The Council of the City of Palo Alto met in a regular meeting held on this date in lieu of the regular meeting date of December 27, 1965. Mayor Arnold convened the meeting at 9:40 p. m. Present: Arnold, Beahrs, Comstock, Cooley, Debs, Dias, Fliait, Pearson, Ropers, RUE, Sher, Woodward. Absent: Worthington. Minutes of December 6, 1965 Councilman Rus moved that the City Clerk review her notes and record in the minutes for the next meeting the comments he made regarding the truck ordinance. The Mayor suggested the Clerk prepare an exti act and submit it to Mr. Rus for review, and that he bring it back for Council approval. Councilman Dias called attention to page 66, the fourth paragraph, and requested the deletion of the second sentence in toto. She also requested deletion of the last sentence of the fifth paragraph on page b9, explaining that she dice not agree to withdraw her motion and that, therefore, the sixth paragraph on page 70 should read: "The Dias substitute motion carried on the following roll call vJte: " Approval of the minutes of December 6, 1965 was continued to the next meeting. Agenda Change Councilman Comstock advised that the Council had agreed to place Oral Communications immediately after Special Orders of the Day and Public Hearings on a trial basis through January. (see page 63 of the minutes of December 6, 1965). As no one wished to be heard on matters other than those rernaiaing on the agenda, the Council returned to the regular order of the agenda. Capital Improvements Expenditure Funds Vice Mayor Debs moved on behalf of the Committee on Finance that no further study be given to the 1965-70 Capital Improvements Expenditure Funds (pages 2 and 3 of the Capital Improvements Pro- gram) until the new capital improvements program beginning 1966- 67 is presented to the Council (see the minutes of December 7;- 1965 of the Committee on Finance). After discussion, the Mayor voted no action was required bl• the Council. 89 12/20/65 Santa Clara County Mass Transit Committee Councilman Dias reported that the Santa Clara County Mass Transit Committee had been dissolved and read a report on its activities over the past 34 months which culminated in the receipt of a federal grant for the study of mass transit for Santa Clara County. The final recommendation of this study was to merge the Mass Transit Committee with the Santa Clara Trafficways Committee into an or- ganization named the Transportation Policy ,Committee- which is charged with the responsibility of finding a solution to the critical transportation problems in Santa Clara County and its relationship to the Bay Area. Mayor Arnold thanked Mrs. Dias for the report and in the discussion which followed announced that Councilman Cooley was the Council representative on the newly forayed Transportation Policy Committee. Truck Ordinance The Council received a letter from the City Attorney dated Decem- ber 16, 1965 regarding the ,proposed amendments to Section 19. 132 of the Palo Alto Municipal Code, the truck route regulations, which had been consolidated (see Council minutes of December 6, 1965, pp. e3-68). The Council also received letters regarding these pro- posed changes from die following: 1. Palo Alto Chamber of Commerce, dated December 15, 1965. 2. Downtown Palo Alto, Inc. , dated December 20, 1965. 3. W. L. Gallagher, dated December 8, 1965. 4. William J. Zeutzius, Assistant General Counsel for the California Engineering & Grading Contractors Association, Inc., delivered December 20, 1965. Councilman Comstock moved the adoption of the consolidated ordi- nance, including the recommendations of the City Attorney, en- titled "Ordinance of the Council of the City of Palo Alto Amending Section 19. 1 32 of the Palo Alto Municipal Code Establishing Truck Routes." The motion was seconded by Sher. After discussion, Councilman Rus moved, seconded by Woodward, that the entire truck situation be referred to the Cornrnittee on Plan- ning and Procedures for further study. After discussion, the motion carried on the following roll call vote: Ayes: Arnold, Beahrs, Cooley, Dias, Rohrs, Rus, Woodward. Noes: Comstock, Debs, Flint, Pearson, Sher. Councilman Comstock, as chairman of the committee, announced the Committee on Planning and Procedures would study the amendments to the truck route regulations at its next meeting scheduled for January 17, 1966. 90 12/20/65 The Council discussed separating :4te consolidated ordinance into three separate ordinances as first introduced December 6, 1965. Mayor Arnold moved, seconded by Flint, that the Council. recon- sider its referral motion for the purpose of separating the Embar- cadero Road amendment from the proposed ordinance. The motion lost on the following tie vote: Ayes: Arnold, Debs, Flint, Pearson, Rohrs, Sher. Noes: Beahrs, Comstock, Cooley, Dias, Rus, Woodward. Resolution Determinin General Prevailing Rates oTT er Diem Wages in ontracts for u is or s The Council received a memorandum from the City Attorney dated December 15, 1965 pertaining to a proposed resolution adopting a new wage scale as revised September 1, 1965 as required under certain sections of the Labor Code. Coun-:ilrnan Beahrs introduced Resolution No. 3862 entitled "Reso- lution of the Council of the City of Palo Alto Determining the Gen- eral Prevailing Rates of Per Diem Wages in Contracts for Public Works for the City of Palo Alto" and moved its adoption. The motion was seconded by Comstock and carried unanimously on a voice vote. Southern Pacific Gornpan} The Council received a memorandum dated December 16, 1965 from the City Manager which recommended approval of a license agreement with the Southern Pacific Company to permit construction of an underground conduit System along the Southern Pacific right of way between Hansen Way and El Camino Real. The City Manager reviewed his recommendation and referred to the exhibit displayed on the Council, chamber wall. After discussion, Councilman Rohrs mowtd, seconded by Beahrs, that the Council approve the Southern Pacific license agreement and authorize and direct the Mayor to execute the agreement in be- half of the City of Palo Alto. After discussion, the motion wab declared carried with Debs voting no. Bids: Underground Electrical Conduit System The City Manager reviewed his memorandum to the Council dated December 16, 1965 which reported on the bids received to furnish and install from a point on the Southern Pacific Railroad right of way, along a public t.tiLty easement to a pole riser on Pate Mill - Road, a complete underground electric. system of ducts, manholes and junction boxes. After discussion, Councilman Dias moved, seconded by Comstock and carried unanimously, that the Council accept the low bid of Industrial Electric Construction Company in the amount rd $10. 400.00. 91 12/20/65 Clainka for Damages - Betty Koffman The City Attorney reported that a claim in the amoant of $10,000.00 was filed by Betty Hoffman, 879 Barron Avenue, for personal in- juries due to a fall at the intersection of Barron Avenue and LaCalle Court on August 5, 1965; that upon investigation he would recommend that this was not a proper charge against the City and the clairn be rejected in its entirety. On motion of Comstock, seconded by Dias and carried unanimously, the r.ouncil denied the claim in its entirety. Foothills Park - Dr. Russel V. Lee ProzertY Mayor Arnold moved, seconded by Beahrs, that the Mayor be author- ized and directed for and on behalf of the City to execute an agree- ment with Russel V. and Dorothy Womack Lee for the acquisition of several parcels of land adjacent to Foothills Park by purchase, gift and option in the form distributed to the City Council prior to this meeting and with the change of the date in thy: last Z.entence on page 2, paragraph 4(a) to "January 20" and he further moved the adop- tion of an ordinance entitled "Ordinance of the Council of the City of Palo Alto Making an Additional Appropriation in the Capital Improve- ment Fund (Acquisition of Land from Russel V. and Dorothy Womi- ck Lee)." After discussion the motion lost on the following roll call vote as nine votes are required (Charter: Article 111, Sec, 12): Ayes: Arnold, Beahrs, Comstock, Cooley, Dias, Pearson, Rohrs, Sher, Noes: Debs, Flint, Pus, Woodward. General Plan - ,Baylla ds See Page 97 Councilman Sher reviewed the recent actions of the Plannir.g Com- mission and Council regarding the proposals of the Audubon Society for improvements to the City's baylands. He moved the introduction of an ordinance entitled "Ordinance of the Council of the City of Palo Alto Making Additional Appropriation in the Capital Improvement Fund (Lee Property and Baylande),, rria.king an appropriation in the Capital improvement Fund of $150,000 for the construction of walk- ways, boardwalks, observation platforms and interpretive center in the baylands (which were recommendations lb and lc of the Citizens Advisory Committee or the Baylands). The motion was duly seconded and after discussion lost on the following roll call vote as nine votes are required. Ayes: Arnold, Comstock, Debs, Flint, Pearson, Rohrs, Sher. It was moved and duly seconded that the Mayor be authorized and directed for and on behalf of the City to execute an agreement with "Russel V. and Dorothy Womack Lee for the acquisition of several parcels of land adjacent to Foothills Park by purchase, gift and op- tion in the form distributes to the City Council prior to this meeting and with the change of the date in the last sentence on page 2, para- graph 4(a) to "January 2d" and the adoption of Ordinance No. 2273 entitled "Ordinance of the Council of the City of Palo Alto Making an Additional Appropriation in the Capital Improvement Fund (Acqui- sition of Land from Rnssel V. and Dorothy Womack Lee). " After discussion the motion received the following votes on roll call: Ayes: Arnold, Beahrs, Comstock, Cooley, Dias, Pearson, Rohrs, Sher. Noes: r'tint, Rus, Woodward. Abstaining: Debs. After the roll call Vice Mayor Debs stated that he wished to vote "Aye:'" The motion and accompanying ordinance were then declared passed and adopted by a vote of 9-3. Property Adjacent to Mitchell Park r vsr Councilman Shoe moved, seconded by Comstock, that the Council instruct the City Manager to report on costs of acquiring Nolte improved and unimproved property on Middlefield Road adjacent to Mitchell Park, and the feasibility and cost of adapting the buildings for use as a Junior Museurz or other City facili ties, After discus- sion, the motion was declared carried on a majority voice vote. Traffic Circulation on Park Boulevard Councilman Comstock referred to his memorandum to the Council dated December 154, 1965 and moved, seconded by Rohrs, that the Council direct the staff to study the traffic circulation problems of Park Boulevard and report to the Committee on Planning and Pr ,•_ cedures. The :notion lost on the following tie vote: Ayes: Arnold, Beahrs, Comstock, Cooley, Dias, Rohrs. Noes: Debi, Flint, Pearson, Rus, Sher, Woodward. 93 12/20/65 Reaoluticm of Commendation 1 1 On motion of the Mayor, seconded by Deb and carried unanimously, the Council adopted a Resolution expressing genuine appreciation to the employees of the City for their faithful, diligent and conscien- tious service, and extending warmest and best wishes to the munici- pal employees and their families for a Merry Christmas and a very happy N+.u, V,ar, There being uo further business to come before the Council, the meeting was adjourned at 11:23 p. m.
