Convenience and Necessity to taxicab companies. -
the Mayor observed that no Council action was required at this time.
Report on Sewer Lge System. and S `orm Drainer e Pro ram
Vice Mayor laebs, Ch- rman'of the Committee on Finance, reported
the committee re;commetidation ` •nd moved that the Council accent
the Brown:and' Laid}yell report on "W. tewader Collection and Storm
'Drainage" as the basis for decisions; that the.proposcd sewerage
system: section•, of the report be accepted as written; that the storm+
drainage, improvement program be irnp1-mcnted,.by directing the
staff to initiate; Priority No. 1 as soon as the staff feels it is fea-
sible; and then .Priority 2 and 3 will be considered along with othen
items in the capitaei r pro.vernert program. The„:notion was seconded
by Comstock; ,The Vice Mayor also announced the time and place of the next Finance Corr ittee meeting and the agenda.
Several counciixpnen complimented the quality of the Brown and Cald-
well report in the discussion thitt followed. Mr. Bernard Pawloski,
Assistant -Chief En near of the vas -Water -Sewer Divisionanswered
questions from,the-Council.
Vice Mayor DebsrYmoved an amendment, seconded*by Pearson, , that
the .C:otinci_, direct that a study of the sewer rates and fees be :nadr_•
by the, committee on Finance; that the, staff be ins'ttucted to provide
to the committee any' suggested changes in the rate schedules; and.
that the ,studyr,would`ascertain whether industrial, coammercialand
reside'ntial oustornerS. are paying e.quitable fees according to the
volumeofUsage. - -
Assistant City Manager, -Morgan said the staff had such a review
underway now. A discussion followed on the timing between t'he re-
lease of the preliminary report from Brown and Caldwell and the
issuance of the final report' in relation to the preliminary Capital
Improvement Program for 1965-70.

The Planning Commission reported that it unanimously recommended
approval of the extension of the development schedule requested by Dr.
Stewart W:::.Mitchell for the P=C District at 2855 Middlefield Road
-(across San Carlos Court from the Safeway property) for six months
(August 13, -1965" to -February 13, 1966). The Planning Officer,;,an-
swered questions from tlig Council en the developer's plans.

At the Council meeing August 30, 1965 (see page ,,470 of the minutes),
the staff was requested to draft a letter to three State legislators_re-
garding State financing opedestrian crossings of State freeways.„

pref;sed,v"erjr `clearly and diplomatically the Council's feelings on the
subjects He,- therefore;* moved, seconded by Cooley. that the letter
be sent to Senator Clark. Bradley, and Assemblymen Alfred Alquist
and George- Milias.

The City Attorniyr reported that on August 23, 1965, Judith Anne Covey,
315 Oak Avenue Redwood City, filed a claim in the sum of $500, O+b0. 00
for alleged Personal injuries ..suetained while hospitalized at the Palo
Alto -Stanford Hospital on or about April 8, 1965. He reviewed details
a
of the claim Since the Palo Alto -Stanford Hospital Center is a non-
profit corporation, organized by the City and Stanford. he stated there
is no liability ,on the part of the City for action of personnel of the
hospital, and therefore recommended that the claim be denied in its
entirety.

The City ,Attorney reported. that,;on June 16, 1965 Mantic E. Crooks,
331 Nova.Lane, Menlo Park, filed a claim in the sum of $50,000.00
for damages and personal injury sustained in an intersection accident
on May 5, 1965 at Fult`bn and Lytton involving a car driven by John
Harkins. Upon investigation, with the cooperation of the office of the
City Engineer,. the City Attorney recommended that the Council re-
ject the claim invite entirety because in his opinion, there is no negli-
gence nor any liability onthe part of the"City.
On motion of Rohr's. seconded by Debs and carried unanimously on a
voice vote, the Council denied the claim in its entirety.
Appropriations for Ma field and
University. Park Fire .StationsJA
The -Council unanimously approved the appropriations of funds in the
amount_ of $15; 000 from the Capital Improvement Fund for furnishings
and equipment_ for the: Mayfield" and University Park fire stations at
the meeting of August 30, 1965 (see pp 468-9 of the minutes)`. Be-
cause nine councilmen were not present to constitute the two-thirds
majority4vote, of the Council -required when approving the appropriation
o.funds, it was necessary ":to continue the natter to this meeting.

sweep the street.
