The Courdcil of the City of Palo Alto met in regular session on this
date at 7:36 p.m. with Mayor Woodward presiding.
Present: Arnold, Beahrs, Byxbee (7:40), Cooley. Dias,
Flint, Porter, Rodgers, Rohrs, Rus, Woodward,

Arastradero*Hills Annexation
'A' report was re ,eived'from the P1a.3m:ring. Commission unanimously
recommending approval of the application of Sunset International
Petroleum Cor.porationto annex approximately 220 acres of a por-
tion of the Rancho El Corte de Madera The Council received a
„ letter from Mr. R. , H. Walter, Senior Vice President of Sunset, re,
questing that the public hearing bepostponed until the next Council; :.
meeting on'iu1y -l2, 1965.
On motion of Rohrs, duly seconded and unanimously carried, the
Council continued the matter to July 12, 1965.
1955-66 Salary Plan
The Committee of the WFiole reported it had reviewed the recc>m-
mended Salary Plan for 1965-66 and returned the rr.att. r to the., ` ur:-

The City Manager transmitted to the Council a memorandum dated
June 23, �1?65, explaining. revisions and expansion of the City's
utilities rules and regulations to facilitate procedures for the effec-
tive ad;ministration of the sty's new underground ordinance which
will be in effect ,114:, 1 ; 1965. He noted that the prior regulations
ha4:been dzrested to";regulate overhead electrical installations and
the revisions are essential to implement the underground ordinance

Councilman. Porter moved that the amendments to the Electric
Utility Rules and Regulations relative to underground service be
adopted and' rttroduced.Resolution No. 3834 entitled "Resolution of
the Council: of the City' oft Palo Alto Amending ,Sections E-5, R-12
and _R-13:of` the Utilities'Rules and Regulations." The motion wag,
seconded by Rohrs, and the resolution was passed on a unanimous
voice vote.

Water end: Gas Relocation
The City Manager reported that 'five bids had been submitted for
water and` gas relocation in the Page Mill-Junipero Serra Interchange. -
He ad iced that the bid of the Underground Construction Company in
the sum 'of $31, 905.70 was the lowest bid submitted and recommended •
C e bid be awarded to this firm.
A motion by Bea) rs, duly seconded, to award the bid to the Under-
ground `Construction Company and authorizing and directing the Mayor
to execute a contract with them was carried by a unanimous voice vote.

The City Manager., reported that seven bids had been re-
ceived on Project No. 62-4 for grading and construction of drainage
and irrigation systems in Amarillo Avenue Park. He advised the
Engineer's' estimate on this project was $14, 390 and that the bid of
the J & E Construction Company in the amount of $13, 198 - 8% be-
low the Engineer's estimate - was the lowest bid submitted. , He
reconimenc:e4 the bid be awarded to this company.

Report on Lighting Tennis courts
At the. May 3,. 1965 meeting of the City Council, the staff was dire.cted'.
to .prepare a report on the legality 0f the City's right to light School
District tennis courts, the cost per court, the number of courts in-
volved and the estimated annual lighting cost.
The Assistant City: Manager reported that he hacl discussed this prop
gram with School Distric t representatives; that they are not interested
in: having the City provide lighting for the courts at Cubberley High
- • , and Palo Alto High Sc-hool*; that they favor a plan to coordinate the
use of four' courts at Mitchell Park with six improved and lighted -
" courts-4at Wilbur Junior High School; that the renovation and lighting
of•the Wilbur courts•w<Suld cost approximately $50, 000 whereas the'
expenditure at the -other two high schools would c ost from 5110, 000
to $115, 00'0 and that a written agreement between the City and the
School District would be necessary for the construction and main-
• tenance of.jointly-owned facilities on School District property. 'nit: -

Th. City Manager reported that the Board of Supervisors of the
Santa Clara County has asked the Planning .Department of each city
about their willingness to participate in a,, county -wide special cen-
sus program, >the data to be -compiled by census tract and by city.
He further reported the program would cost Palo Alto approximately

$9, 000 and the Planning Department should have an opportunity to
evaluate whether. Or riot this information will be of value to the City.
As the: deadline for this program is April, 1966, it was his feeling
that further study be undertaker_ before any commitments are made.

The City Attorney eevie`'ve.a'the claim of $16.000 filed by M. W. w.
Sullivan, 3'1'000 Page-MiU Roid, involving overhead powerlines placed -
by the City can. pcay'cr poles owned by'the .Pacific ;.gas & Electric Cor- -
pany....and located on Dr. Sulliva.n's property. He stated the City's
position In this matter' a;nd concluded that there is no liability on :the
part of the City and recoznmended the claim be rejected in its entirety.:

Councilman Beaters moved, seconded by Rodgers, that the claim filed.
by Dr. Sullivan be denied in its entirety.
Paul N. McCloskey,;: attorney fox Dr. Sullivan, stated these over-
head lines and power poles were ir.stalled by the City „on Dr. Sullivan's
property without his perxnission; that the. City indicated these lines
and poleskovere only: temporary, but with no guarantee as to when they
would be removed, that Dr. Sullivan will be burdened with a consider-
able amount of expense if the City installs underground lines along
Page Ivli11 Road, and expressed` his client's desire to see this suit
se'ttleti. He reiterated that Dr. Sullivan would void the protest and
give file City the: right,of ;way `;f he were allowed t�;., in"stalt overhead

The City Attorney noted theCity ordinances would have to be amended
in u der„ to permit the action re_qut ted by Dr.: Sullivan. He further:..

effect in the, City for several years: and he will take action to insure'
that Dir. Sullivan adheres to the ordinances.

temporary ih that the, future location of Page Mill Road is-nknown
and at present it is not practicable' to install underground lines in
that area.
